DECISION

On the expansion, and promulgation of the Regulation on operation, of the Ho Chi Minh City Hi-Tech Park[1]

 

THE PRIME MINISTER

Pursuant to the February 18, 2025 Law on Organisation of the Government;

Pursuant to the November 13, 2008 Law on High Technology;

Pursuant to the Government’s Decree No. 10/2024/ND-CP of February 1, 2024, on hi-tech parks;

At proposal of the Minister of Science and Technology in Report No. 104/TTr-BKHCN of May 27, 2026, and of the Chairperson of the People’s Committee of Ho Chi Minh City in Report No. 548/TTr-UBND of May 13, 2026,

 

DECIDES:

Article 1. To expand the Ho Chi Minh City Hi-Tech Park, with the expanded area covering 194.84 hectares in Long Phuoc ward, Ho Chi Minh City.

The expanded area of the Ho Chi Minh City Hi-Tech Park constitutes part of the Ho Chi Minh City Hi-Tech Park and shall perform the tasks of scientific research and development of high technologies and strategic technologies; carry out the experimental production of hi-tech products and strategic technology products that are research and development outcomes obtained in the Ho Chi Minh City Hi-Tech Park; provide support for the incubation, training, transfer and commercialisation of high technologies and strategic technologies; and perform other tasks and functions of a hi-tech park in accordance with the law on high technology.

Article 2. To promulgate together with this Decision the Regulation on operation of the Ho Chi Minh City Hi-Tech Park.

Article 3. After being expanded, the Ho Chi Minh City Hi-Tech Park shall operate in accordance with the current regulations on hi-tech parks, this Decision and other relevant legal documents.

Article 4. The People’s Committee of Ho Chi Minh City shall:

1. Assume the prime responsibility for directing and organising the implementation, and ensuring the allocation of resources (capital and human resources) for the performance of tasks relating to construction and development investment, state management, support policies and other tasks concerning the Ho Chi Minh City Hi-Tech Park following its expansion, in accordance with the approved objectives and tasks; and take responsibility before the Government for the operation and investment efficiency of the Ho Chi Minh City Hi-Tech Park following its expansion.

2. Organise the formulation, appraisal and approval of zoning plans and detailed plans, and determine the boundaries and location of the expanded area of the Ho Chi Minh City Hi-Tech Park, ensuring consistency with the location and area specified in Article 1 of this Decision.

3. Proactively decide or submit to the competent authority for decision according to the competence provided by the law on high technology, issues arising during the performance of tasks that require adjustment or supplementation; and promptly resolve arising issues so as not to affect the task performance progress.

4. Take full responsibility for contents of its reports, proposals and recommendations concerning the expansion of the Ho Chi Minh City Hi-Tech Park set out in Report No. 548/TTr-UBND of May 13, 2026.

5. Assume the prime responsibility for, and coordinate with related ministries and agencies in, evaluating and reporting on the implementation and operation efficiency of the Ho Chi Minh City Hi-Tech Park.

Article 5. The Ministry of Science and Technology shall:

1. Guide, inspect and supervise to ensure that the Ho Chi Minh City Hi-Tech Park, following its expansion, operates efficiently and in accordance with the approved objectives and tasks.

2. Take full responsibility for contents of its reports, proposals and recommendations concerning the expansion of the Ho Chi Minh City Hi-Tech Park and the promulgation of the Regulation on operation of the Ho Chi Minh City Hi-Tech Park set out in Report No. 104/TTr-BKHCN of May 27, 2026.

Article 6. Related ministries and agencies shall, within the ambit of their functions and tasks, coordinate with and guide the People’s Committee of Ho Chi Minh City in organising the construction and state management of the Ho Chi Minh City Hi-Tech Park following its expansion.

Article 7. Implementation provisions

1. This Decision takes effect on the date of its signing.

2. Ministers, heads of ministerial-level agencies, the Chairperson of the People’s Committee of Ho Chi Minh City, and related organisations and individuals shall implement this Decision in accordance with law.-

REGULATION

On operation of the Ho Chi Minh City Hi-Tech Park

(Promulgated together with the Prime Minister’s Decision No. 1061/QD-TTg
June 13, 2026)

Article 1. Scope of regulation and subjects of application

1. The Regulation provides investment, construction and development, and state management in the Ho Chi Minh City Hi-Tech Park (below referred to as the Hi-Tech Park), including the expanded area of the Hi-Tech Park specified in Article 1 of this Decision (below referred to as the Expanded Area) and the area of the Hi-Tech Park established under the Prime Minister’s Decision No. 145/2002/QD-TTg of October 24, 2002, on the establishment of the hi-tech park under the People’s Committee of Ho Chi Minh City.

2. This Regulation applies to state management agencies, and organisations and individuals involved in activities the Hi-Tech Park.

Article 2. Objectives and tasks of development

To perform the tasks of a hi-tech park in accordance with the law on high technology, focusing on the following objectives:

1. To develop a modern, synchronous, smart and environmentally friendly system of technical infrastructure, digital infrastructure and technological infrastructure; the technical infrastructure system must ensure convenient connectivity with the surrounding areas; to strive to achieve carbon neutrality before 2050, for the Expanded Area.

2. For the Expanded Area, to perform the tasks of scientific research and development of high technologies and strategic technologies; experimental production of hi-tech products and strategic technology products that are research and development outcomes obtained in the Hi-Tech Park; to apply regulatory sandbox for new technologies, products and policies on high technologies and strategic technologies; to provide support for incubation, joint training, transfer and commercialisation of high technologies and strategic technologies, and perform other tasks and functions of the Hi-Tech Park in accordance with the law on high technology.

3. To establish advanced technology research and development centres at the forefront of the fields of microelectronics and information technology, automation, biotechnology and new materials, etc.; to enable connection to form industrial clusters leading research and development activities in order to promote the industrial symbiosis model and closely link with the training and research divisions of universities; to serve as the core of the innovation ecosystem of the Eastern Interactive Innovation Urban Area of Ho Chi Minh City in order to promote technological development, a knowledge- and innovation-based economy, and improve the quality and scale of human resources.

Article 3. Requirements for operation

1. The zoning plan and detailed plan (if any) of the Expanded Area must facilitate the performance of the main functions and tasks, namely hi-tech and strategic technology activities, in accordance with the objectives and tasks specified in Article 2 of the Regulation and current laws.

2. The master-plan design and architecture and technical and social infrastructure serving the Hi-Tech Park must be synchronous, modern and environmentally friendly, have aesthetic qualities, provide smart management utilities to meet operational needs, be oriented towards smart city standards, and ensure synchronous connectivity within the Hi-Tech Park and the surrounding areas.

3. Investment in the construction and attraction of investment in the Hi-Tech Park must comply with development orientations and objectives; nature, functions and tasks; priority sectors and fields; and principles and criteria set out by the law on high technology and relevant laws.

4. State management agencies, investors and organisations, enterprises and individuals involved in the operation of the Hi-Tech Park shall perform their responsibilities, exercise their rights and fulfil their obligations in accordance with the law on high technology and relevant laws.

Article 4. Sources of investment capital for construction and development

1. Investment capital for the construction and development of the Hi-Tech Park comes from the state budget, investment capital of organisations and individuals, and other lawful sources of capital in accordance with law.

2. Regarding state budget funds in case no central budget funds are allocated, Ho Chi Minh City shall allocate local budget funds for investment in and construction of the Expanded Area in accordance with the objectives and tasks and the laws on high technology, public investment, and the state budget, and other relevant laws.

3. Ho Chi Minh City shall ensure the allocation of local budget funds for state management activities, implementation of support policies and performance of other tasks serving the operation and functioning of the Hi-Tech Park in accordance with law.

Article 5. Investment incentives and support

In addition to investment incentive and support policies provided by the law on high technology and other relevant laws, the People’s Committee of Ho Chi Minh City shall promulgate according to its competence, or submit to the competent authority for promulgation, policies and measures, and allocate resources to attract and support investment projects, hi-tech and strategic technology activities, and the development of high-quality human resources in the Hi-Tech Park under regulations.

Article 6. Hi-tech and strategic technology activities

Investment projects engaged in hi-tech and strategic technology activities in the Hi-Tech Park must adhere to the principles and satisfy the criteria applicable to each type specified by the law on high technology, have objectives and activities consistent with the development objectives and tasks of the Hi-Tech Park specified in Article 2 of the Regulation, and comply with current laws.

Article 7. State management

1. The People’s Committee of Ho Chi Minh City is the management agency in charge of the Hi-Tech Park and shall assume the prime responsibility for directing and organising the performance of its investment, construction and development tasks, ensuring investment capital and performing the state management of the Hi-Tech Park following its expansion in accordance with the approved objectives and tasks, ensuring the schedule and complying with the law on high technology and relevant laws; and shall take responsibility before the Government for the activities and investment efficiency of the Hi-Tech Park.

2. The Hi-Tech Park Management Board, organised in accordance with law, is an agency under the People’s Committee of Ho Chi Minh City, which performs the state management of the Hi-Tech Park in accordance with the functions, tasks, powers and organisational structure of the Hi-Tech Park Management Board provided by the law on high technology and relevant laws and according to the decentralisation  and authorisation; guides and assists enterprises and investors in carrying out administrative procedures under the “single-window, inter-agency single-window” mechanism; facilitates the effective implementation of activities in the Hi-Tech Park; and ensure the  effectiveness of the inspection and supervision of investment, construction and development in the Hi-Tech Park.

3. Agencies under the People’s Committee of Ho Chi Minh City shall, within the ambit of their assigned state management functions and tasks, coordinate with the Hi-Tech Park Management Board in performing the state management of investment, construction and development of the Hi-Tech Park.

4. Ministries and related agencies shall, within the ambit of their assigned functions, tasks and powers, coordinate with and provide guidance to the People’s Committee of Ho Chi Minh City in performing the state management of investment, construction and development activities of the Hi-Tech Park.
