DECISION
PROMULGATING THE RATES OF CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND QUALITY OF MOTORIZED VEHICLES AND ASSORTED SPECIAL-USE VEHICULAR EQUIPMENT AND MACHINERY
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No. 86/2002/ND-CP of November 5, 2002 defining the functions, tasks, powers and organizational structure of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;Pursuant to August 28, 2001 Ordinance No. 38/2001/PL-UBTVQH on Charges and Fees; pursuant to the Government’s Decree No. 57/2002/ND-CP of June 3, 2002 detailing the implementation of the Ordinance on Charges and Fees;
At the proposals of the Ministry of Communications and Transport in Official Dispatch No. 4365/BGTVT-TCKT of November 19, 2002 and of the director of the Enterprise Finance Department,
DECIDES:
Article 1.- To promulgate together with this Decision the Regulation on the rates of charges for inspection of the technical safety and quality of motorized vehicles and assorted special-use vehicular equipment and machinery, including:
1. Charges for inspection of the technical safety of motorized vehicles currently in circulation.
2. Charges for inspection of the technical safety of special-use vehicular equipment and machinery currently in circulation.
3. Charges for inspection of the technical safety and quality of motorized vehicles and special-use vehicles in transformation.
4. Charges for inspection of the quality of components and motorized vehicles in being tested for manufacture and assembly.
5. Charge for inspection of the technical safety and quality of motorized vehicles, special-use vehicular equipment and machinery in manufacture and assembly in Vietnam.
6. Charges for inspection of the technical safety and quality of imported motorized vehicles, special-use vehicular equipment and machinery.
7. Charges for inspection of the quality of devices for checking motorized vehicles.
Article 2.- The charge rates in this Table are inclusive of value-added tax but exclusive of the fee for the granting of quality and technical safety certificates for motorized vehicles, assorted special-use vehicular equipment and machinery, and expenses for accommodation, travel and communication in service of the inspection work in places over 100 km far from the inspection offices.
Article 3.- Where an international agreement which the Socialist Republic of Vietnam has signed or acceded to contains provisions different from this Table of Charges, the provisions of such international agreement shall apply.
Article 4.- The charge payers prescribed in this Decision are organizations and individuals for whom the Vietnam registry offices inspect the technical safety and quality of their motorized vehicles and assorted special-use vehicular equipment and machinery in manufacture, assembly, importation, transformation and circulation, and inspect devices used for checking motorized vehicles.
Article 5.- Several terms used in this Table of Charges are construed as follows:
1. Motorized vehicles include automobiles, tractors, motorized two-wheelers, motorized three-wheelers, mopeds and vehicles of similar kinds, including motorized vehicles used for the disabled.
2. Special-use vehicular equipment and machinery include communications and transport equipment, construction machinery, agricultural and forestry machinery joining in road traffic.
Article 6.- This Decision takes effect as from February 1, 2003 and replaces Decision No. 138/1999/QD-BVGCP of December 28, 1999 of the Government Pricing Committee on the charges for technical inspection, the charges for quality inspection of assorted equipment, construction machinery and road motorized means, and relevant guiding documents.
Article 7.- Organizations and individuals being charge payers, inspection agencies and concerned agencies shall have to implement this Decision.

THE TABLE OF THE RATES OF CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND QUALITY OF MOTORIZED VEHICLES AND ASSORTED SPECIAL-USE VEHICULAR EQUIPMENT AND MACHINERY

I. CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY OF MOTORIZED VEHICLES CURRENTLY IN CIRCULATION

2. For motorized vehicles which, through inspection, fail to satisfy the technical safety and environmental protection standards, and must be maintained and/or repaired before having their sub-standard components re-inspected, the charges for subsequent inspections shall be collected as follows:
2.1. If re-inspection is conducted two times at most within one day (during working hours), no charge shall be collected. For vehicles which fail to satisfy technical safety standards through an inspection conducted in the afternoon and are re-inspected before the end of the working hours in the following morning, their inspection shall be regarded as being conducted within one day. For vehicles which are re-inspected from the third time on, the charge for each re-inspection shall be equal to 50% of the rate prescribed in Table 1.
2.2. If the re-inspection is conducted with seven days (excluding holidays as according to the prescribed regime), counting from the date of the first inspection, the charge for each re-inspection shall be equal to 50% of the rate prescribed in Table 1.
3. The charge for inspection of motorized vehicles for granting the provisional technical safety and environmental protection certificates (valid for no more than 15 days) shall be equal to 50% of the rate specified in Table 1.
4. The charge for inspection of the nature of technical expertise or quality evaluation at the requests of organizations and individuals can be negotiated but shall not exceed three times the rates specified in Table 1.

2. When inspections show that special-use vehicular equipment or machinery fail to satisfy technical safety and environmental protection standards, and must be repaired before having their sub-standard components, the charges for subsequent inspections shall be collected as follows:
2.1. If the re-inspection is conducted no more than twice in one day (within working hours), no charge shall be collected. For special-use equipment or machinery which fail to satisfy technical safety standards through an inspection conducted in the afternoon and are re-inspected before the end of the working hours in the following morning, their re-inspection shall be regarded as being conducted within one day. For special-use equipment or machinery which are re-inspected from the third time on, the charge for each re-inspection shall be equal to 50% of the rate prescribed in Table 2.
2.2. If the re-inspection is conducted one day after the day of the first inspection, the charge for each re-inspection shall be equal to 50% of the rate prescribed in Table 2.
3. For other special-use vehicular equipment or machinery not yet prescribed in this Table of Charges, their owners and the inspecting agencies shall base themselves on the State’s regulations to reach agreement on specific inspection charges on the principle of harmonization of the two parties’ interests.
4. The charge for inspection of the nature of technical expertise or quality evaluation at the requests of organizations and individuals shall be agreed upon at a level not exceeding three times of the rate prescribed in Table 2.
III. CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND QUALITY OF MOTORIZED VEHICLES AND SPECIAL-USE VEHICULAR MACHINERY IN TRANSFORMATION

2. The charge rate prescribed at Point 6 of Table 4 for testing many models of the same kind must not exceed VND 1,000,000/kind.

2. The product sale prices for calculation of the charges for inspection of the technical safety and quality prescribed in Table 5 are exclusive of value added tax.
3. For motorized vehicles and special-use equipment and machinery subject to design approval, the design approval charges shall be equal to 8% of the design costs.
VI. CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND QUALITY OF IMPORTED SPECIAL-USE MOTORIZED VEHICLES, EQUIPMENT AND MACHINERY

3. The charge for inspection and expertise for notification of the quality of special-use motorized vehicles, equipment and machinery shall be equal to 50% of the rate prescribed in Table 6.
VII. CHARGES FOR INSPECTION OF THE QUALITY OF FOR MOTORIZED VEHICLE-CHECKING EQUIPMENT

3. Where the checking equipment suddenly break down and must be repaired and re-inspected ahead of schedule, the inspection charge prescribed in Table 7 shall apply.-
