DECISION
ON ORGANIZING THE RECEIPT OF INDIVIDUALS', ORGANIZATIONS' AND ENTERPRISES' INQUIRIES AND PETITIONS ON ADMINISTRATIVE PROCEDURES VIA THE GOVERNMENT'S WEBSITE UNDER THE PROVISIONS OF THE PRIME MINISTER'S DECISION NO. 22/2006/QD-TTG OF JANUARY 24, 2006
THE MINISTER-DIRECTOR OF THE GOVERNMENT OFFICE
Pursuant to the Government's Decree No. 18/2003/ND-CP of February 20, 2003, defining the functions, tasks, powers and organizational structure of the Government Office;
Pursuant to the Prime Minister's Decision No. 22/2006/QD-TTg of January 24, 2006, assigning the task of handling individuals', organizations' and enterprises' inquiries and petitions on administrative procedures;
Pursuant to the Prime Minister's Decision No. 250/2005/QD-TTg of October 10, 2005, on the organization and operation of the Internet website of the Government of the Socialist Republic of Vietnam;
In order to create favorable conditions for individuals, organizations and enterprises to report their problems in carrying out administrative procedures and their petitions for amendment or abrogation of administrative procedures in the management domains under the provisions of Decision No. 22/2006/QD-TTg of January 24, 2006;
After obtaining the consent of the Prime Minister,
DECIDES:
Article 1.- To organize the receipt of individuals', organizations' and enterprises' inquiries and petitions on administrative procedures via the Government's website under the provisions of the Prime Minister's Decision No. 22/2006/QD-TTg of January 24, 2006, with the following specific contents:
1. Receiving individuals', organizations' and enterprises' inquiries on problems in carrying out administrative procedures specified in documents of state administrative agencies or competent persons.
2. Receiving individuals', organizations' and enterprises' inquiries on delays in the completion of administrative procedures by state administrative agencies or competent persons and on administrative procedures which are arbitrarily established by managing agencies and state cadres and civil servants of various levels, causing difficulties to individuals and organizations and restricting production and business activities of enterprises of all economic sectors.
3. Receiving petitions for amendment or annulment of administrative procedures which are no longer suitable to the practical situation, obstructing production and business activities of enterprises and people.
Article 2.- Responsibilities of the Government's website
1. To coordinate with the Administrative Reform Department in organizing the receipt of individuals', organizations' and enterprises' inquiries and petitions on administrative procedures via the Government's website in accordance with the provisions of Article 1 of this Decision.
2. To gather individuals', organizations' and enterprises' inquiries and petitions mentioned in Article 1 and promptly send them to the Administrative Reform Department.
3. To coordinate with the Administrative Reform Department in periodically reporting the results and situation of handling individuals', organizations' and enterprises' inquiries and petitions on administrative procedures stated in Article 1.
Article 3.- Responsibilities of the Administrative Reform Department
1. To receive via the Government's website individuals', organizations' and enterprises' inquiries and petitions on administrative procedures according to the provisions of Clause 2, Article 2 of this Decision.
2. To assume the prime responsibility for, and coordinate with functional units of the Government Office in, considering and handling individuals', organizations' and enterprises' problems and petitions on administrative procedures according to the provisions of Article 2 of Decision No. 22/2006/QD-TTg of January 24, 2006.
3. To promptly supply the Government's website with information on the results and situation of handling individuals', organizations' and enterprises' problems and petitions on administrative procedures according to the provisions of Clause 3, Article 2 of this Decision.
Article 4.- This Decision shall take effect 15 days after its publication in "CONG BAO."
The director of the Administrative Reform Department, the editor-in-chief of the Government's website and concerned units shall have to implement this Decision.
