Decision 01/2022/QD-TTg promulgating the list of sectors, greenhouse gas-emitting establishments subject to greenhouse gas inventory

DECISION

Promulgating the lists of sectors and establishments emitting greenhouse gases subject to greenhouse gas inventory^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the November 17, 2020 Law on Environmental Protection;

Pursuant to the Government’s Decree No. 06/2022/ND-CP of January 7, 2022, providing the mitigation of greenhouse gas emissions and protection of the ozone layer;

At the proposal of the Minister of Natural Resources and Environment,

Article 1. To promulgate the lists of sectors and establishments emitting greenhouse gases subject to greenhouse gas inventory, including:

1. The list of sectors subject to greenhouse gas inventory provided in Appendix I;

2. The list of the industry and trade sector’s establishments emitting greenhouse gases subject to greenhouse gas inventory provided in Appendix II;

3.  The list of the transport sector’s establishments emitting greenhouse gases subject to greenhouse gas inventory provided in Appendix III;

4. The list of the construction sector’s establishments emitting greenhouse gases subject to greenhouse gas inventory provided in Appendix IV;

5. The list of the natural resources and environment sector’s establishments emitting greenhouse gases subject to greenhouse gas inventory provided in Appendix V.

Article 2. Organization of implementation

1. Pursuant to the Law on Environmental Protection, the Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with Ministries of Industry and Trade, Transport, Agriculture and Rural Development, and Construction, and provincial-level People’s Committees in, reviewing the lists of sectors and establishments emitting greenhouse gases subject to greenhouse gas inventory, and submit them to the Prime Minister for decision and update under regulations.

2. Establishments emitting greenhouse gases subject to greenhouse gas inventory specified in Article 1 shall take initiative in sending information on their total energy amount consumed and operational capacity to the Ministry of Natural Resources and Environment for review; on that basis, the Ministry of Natural Resources and Environment shall summarize and report to the Prime Minister for consideration and decision the modification and update of the lists.

3. Ministers of Natural Resources, Industry and Trade, Transport, Agriculture and Rural Development, and Construction, and chairpersons of provincial-level People’s Committees shall bear responsibility for the accuracy, consistency, equity and transparency in updating and modifying the lists in line with international commitments to which Vietnam is a contracting party and in conformity with socio-economic development situation and conditions, and create favorable conditions for organizations and individuals to implement.

Article 3. Effect

1. This Decision takes effect on January 18, 2022.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and at-law representatives of establishments on the lists of establishments emitting greenhouse gases subject to greenhouse gas inventory shall implement this Decision.-
