CIRCULAR

ON AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE CIRCULAR NO. 225/2016/TT-BTC DATED NOVEMBER 11, 2016 OF THE MINISTER OF FINANCE, PROVIDING FOR RATE, COLLECTION, PAYMENT, MANAGEMENT AND USE OF THE APPRAISAL FEE FOR ISSUANCE OF BIOSAFETY CERTIFICATE OF GENETICALLY MODIFIED ORGANISMS ELIGIBILITY FOR USE AS FOOD, ANIMAL FEED

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to the Government’s Decree’s No. 120/2016/ND-CP dated August 23, 2016 on detailing and guiding the implementation of a number of Articles of the Law on Fees and Charges;

Pursuant to the Government’s Decree No. 87/2017/ND-CP of July 26, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

Pursuant to the Resolution No. 75/NQ-CP dated August 09, 2017 of the Government on the Government’s Regular Meeting on July 2017;

At the proposal of the Director of the Tax Policy Department,

The Minister of Finance hereby promulgate the Circular on amending and supplementing a number of Articles of the Circular No. 225/2016/TT-BTC of the Minister of Finance providing for rate, collection, payment, management and use of the appraisal fee for issuance of biosafety certificate of genetically modified organisms eligibility for use as food, animal feed.

Article 1.To amend and supplement Article 2 of the Circular No. 225/2016/TT-BTC dated November 11, 2016 of the Minister of Finance as follows:

“Article 2. Charge and fee payers

Organizations and individuals requesting for appraisal of applications of genetically modified organisms eligibility for use as food as prescribed in Clause 1 Article 1 of the Government’s Decree No. 108/2011/ND-CP dated November 30, 2011 on biosafety with genetically modified organisms, genetic specimens and products of genetically modified organisms; requesting for appraisal of applications of genetically modified organisms eligibility for use as animal feed as prescribed in Article 33 of the Government’s Decree No. 69/2010/ND-CP shall pay appraisal fees and charges for issuance of biosafety certificates of genetically modified organisms eligibility for use as food, animal feed in accordance with this Circular”.

Article 2.To amend and supplement Article 4 of the Circular No. 225/2016/TT-BTC dated November 11, 2016 of the Minister of Finance as follows:

“Article 4. Charge and fee rates

Rate of appraisal fee for grant of biosafety certificate of genetically modified organisms eligibility for use as food and animal feed is VND 105,000,000 per once time of appraisal”.

Article 3. Implementation provisions

1. This Circular takes effect on October 08, 2018.

2. Any problem arising in the course of implementation should be promptly reported to the Ministry of Finance for consideration and settlement./.
