Announcing the detailed List of used digital technology products banned from import and their HS codes

Pursuant to the Law on the Digital Technology Industry;

Pursuant to the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 292/2026/ND-CP dated July 22, 2026 detailing a number of articles and measures for organizing and guiding the implementation of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 353/2025/ND-CP dated December 31, 2025, detailing a number of articles, and providing measures to organize and guide the implementation, of the Law on the Digital Technology Industry;

Pursuant to Government's Decree No. 225/2026/ND-CP dated June 24, 20236, defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;

At the request of the Director of the Authority of Information Technology Industry;

The Minister of Information and Communications hereby promulgates the Circular announcing the detailed List of used digital technology products banned from import and their HS codes.

Article 1. List of used digital technology products banned from import
To announce the detailed List of used digital technology products banned from import and their HS codes in accordance with the Government’s Decree No. 292/2026/ND-CP dated July 22, 2026, detailing a number of articles and measures for organizing and guiding the implementation of the Law on Foreign Trade Management (hereinafter referred to as the List).

Article 2. Principles for formulation and regulations on application of the List

1. Principles for compilation of the List:

a) The List, together with the HS codes, is formulated in accordance with the Minister of Finance’s Circular No. 31/2022/TT-BTC dated June 08, 2022, on promulgating Vietnam Nomenclature of Exports and Imports;

b) In case where the HS codes included in the List to this Circular are inconsistent with those in Vietnam Nomenclature of Exports and Imports, the customs law shall apply;

c) The List shall be amended and supplemented in accordance with the law applicable from time to time.

2. Regulations on application of the List:

a) Where the List specifies a four-digit heading, the prohibition shall apply to all eight-digit HS codes under that heading;

b) Where the List specifies a six-digit subheading, the prohibition shall apply to all eight-digit HS codes under that subheading;

c) Where the List specifies an eight-digit HS code, the prohibition shall apply only to that eight-digit code;

d) Used parts, accessories, component assemblies and electronic components of products on the List shall also be banned from import;

dd) Refurbished digital technology products bearing HS codes on the List to this Circular shall be banned from import.

Refurbished digital technology products specified at this Point mean used digital technology products that have been repaired or had components replaced to restore the functions, quality and appearance to a condition equivalent to that of new products; they must satisfy the technical regulations and standards, warranty requirements and goods labeling regulations applicable to new products in accordance with law;

e) Used technology lines, machinery, equipment and tools that satisfy the criteria for import in accordance with the law on the digital technology industry and directly serve investment projects for manufacturing, packaging or testing semiconductor integrated circuit products, or activities involving training, research and development of digital technology products and services, shall not be included in the List.

Article 3. Implementation provisions

1. This Circular takes effect from January 01, 2027.

2. Circular No. 11/2018/TT-BTTTT dated October 15, 2018, of the Ministry of Information and Communications, detailing the List of used information technology products prohibited from import with their HS codes, ceases to be effective from the effective date of this Circular, except as provided in Clause 3 of this Article.

3. The import of goods included in the List of used information technology products prohibited from import that have been permitted for import before the effective date of this Circular, shall continue to be imported in accordance with the contents and within the validity period of the written import permission.

4. In case the legal documents referred to in this Circular are amended, supplemented or replaced, the amending, supplementing or replacing ones shall prevail.

5. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Science and Technology for consideration and settlement according to the competence./.
