SUMMARY

Regulations on aviation security training programs

On November 16, 2017, the Ministry of Transport issues the Circular No. 43/2017/TT-BGTVT providing regulations on aviation security training.

According to this Circular, programs of training and fostering of aviation security forces include the programs such as: Aviation security screening training program to equip students with the professional knowledge, skills in the aviation examination and security screening of passengers, luggage, goods, postal parcels and objects conveyed on board the aircraft with 516-hour course duration; Security control training program to equip students with professional knowledge, skills in aviation security inspection and supervision at terminals, airports with course duration of 432 hours.

Additionally, mobile security training program is provided to equip students with the occupational knowledge, skills and manners for patrol, guarding, escorting, crowd control, aircraft and vehicle inspection and search within course duration of 456 hours; etc.

Besides, security screeners, security controllers and mobile security officers shall undergo periodic training once (01) a year. A security screener omitting dangerous articles during his mission or an aviation security controller failing to perform mission for at least 06 (six) consecutive months shall undergo relevant recurrent training before resuming work.

The Circular takes effect on January 15, 2018.

CIRCULAR

Providing regulations on aviation security training

 

Pursuant to the Law on Vietnam Civil Aviation No. 66/2006/QH11 dated June 29, 2006; Law on amendments to some Articles of the Law on Vietnam Civil Aviation No. 66/2006/QH11 dated November 21, 2014;

Pursuant to Government's Decree No. 92/2015/ND-CP dated October 13, 2015, on aviation security;

Pursuant to the Government’s Decree No. 92/2016/ND-CP dated July 01, 2016, on conditional business lines in civil aviation;

Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the request of the Directors of the Personnel and Organization Department and the Civil Aviation Authority of Vietnam;

The Minister of Transport promulgates the Circular providing regulations on aviation security training.

 

Chapter I

GENERAL PROVISIONS

 

Article 1. Scope of regulation

This Circular stipulates the training and fostering in civil aviation security.

Article 2. Subjects of application

This Circular applies to organizations and individuals involved in the training and fostering in civil aviation security in Vietnam.

Article 3. Teaching time and conversion of teaching time

1. Teaching time in the training and fostering program is measured in hours.

2. Conversion of teaching time: 01 (one) hour of theoretical teaching shall be considered as 45 minutes; 01 (one) hour of practical training shall be considered as 60 minutes.

 

Chapter II

TRAINING AND FOSTERING OF AVIATION SECURITY FORCES


Section 1

TRAINING AND FOSTERING PROGRAMS

 

Article 4. Aviation security screening training program

1. Objectives: To equip students with the professional knowledge, skills and manners to conduct the aviation examination and security screening of passengers, luggage, goods, postal parcels and objects conveyed on board the aircraft.

2. Persons eligible to attend the training courses: must be Vietnamese citizens aged 18 or older, have an explicit personal history, be physically fit and graduate from upper secondary schools.

3. Course duration: 516 hours. In which theoretical teaching duration is 306 hours, practical training is 210 hours.

Article 5. Security control training program

1. Objectives: To equip students with professional knowledge, skills and attitudes in aviation security inspection and supervision at terminals, public areas, airports, and guarding in restricted areas.

2. Persons eligible to attend the training courses: must be Vietnamese citizens aged 18 or older, have an explicit personal history, be physically fit and graduate from upper secondary schools.

3. Course duration: 432 hours. In which theoretical teaching duration is 282 hours, practical training duration is 150 hours.

Article 6. Mobile security training program

1. Objectives: To equip students with the occupational knowledge, skills and manners for patrol, guarding, escorting, crowd control, aircraft and vehicle inspection and search.

2. Persons eligible to attend the training courses: must be Vietnamese citizens aged 18 or older, have an explicit personal history, be physically fit and graduate from upper secondary schools.

3. Duration: 456 hours. In which theoretical teaching duration is 278 hours, practical training duration is 178 hours.

Article 7. Aviation security management professional training program

1. Objectives: To equip students with the occupational knowledge and skills in aviation security management.

2. Subjects: managers at all levels in the aviation security force of airports enterprises, Vietnamese airlines, enterprises providing air navigation services, enterprises providing aircraft and aircraft equipment repair and maintenance services and enterprises conducting general aviation business as defined in the aviation security program and aviation security regulation.

1. Objectives: To equip students with the occupational knowledge and skills in formulating emergency plans for aviation security and measures against illegal interference in aviation security.

2. Subjects: Managers at all levels in the aviation security force of airports enterprises, Vietnamese airlines, enterprises providing air navigation services, enterprises providing aircraft and aircraft equipment repair and maintenance services and enterprises providing general aviation services defined in the aviations security program and aviation security regulation; managers in the units that carry out measures against illegal interference in civil aviation activities.

Article 17. Periodic training interval

1. Security screeners, security controllers and mobile security officers shall undergo periodic training once (01) a year.

2. A security screener omitting dangerous articles during his mission or an aviation security controller failing to perform mission for at least 06 (six) consecutive months shall undergo relevant recurrent training before resuming work.

3. Managers at all levels in the aviation security force, aviation security teachers, aviation security supervisors and internal security supervisors shall undergo recurrent training every 02 (two) years.

 

Section 3. ORGANIZATION OF TRAINING AND FOSTERING FOR AVIATION SECURITY FORCE

 

Article 18. Textbooks and documents

1. Aviation security training institutions shall compile, verify and publish aviation security force training textbooks and documents.

2. Contents of aviation security force training textbooks and documents shall comply with this Circular and the International Civil Aviation Organization’s standards and recommended practices.

3. Aviation security force training textbooks and documents shall be managed in the same way as the restricted security documents are managed.

Article 19. Aviation security force teachers

1. Aviation security force teachers shall comply with Clause 2 Article 26 of the Government’s Decree No. 92/2014/ND-CP dated July 01, 2014, on conditional business lines in civil aviation.

2. Teachers for training programs in respect of aviation security management, aviation security teaching, aviation security inspection and aviation security crisis management shall comply with Clause 1 of this Article and obtain a certificate of completion of training course corresponding to the training program.

3. Teachers for periodic training programs in respect of aviation security management, aviation security teaching and aviation security inspection shall be selected by the aviation security training institution from among teachers and experts who have extensive experience in and knowledge of aviation security.

4. Aviation communication English, martial arts, weapon and explosive teachers must obtain a certificate issued by a competent agency.

5. Based on standards specified in Clauses 1, 2 and 3 of this Article, aviation security controller training institutions shall compile a list of aviation security force teachers and submit it to the Civil Aviation Authority of Vietnam.

Article 20. Training and practice infrastructure and equipment

1. Training and practice infrastructure and equipment for aviation security inspector training programs shall comply with Article 25 of the Government’s Decree No. 92/2016/ND-CP dated July 01, 2016, on conditional business lines in civil aviation.

2. Practice equipment for aviation security inspector training programs includes:

a) Software used for security screening training;

b) X-ray screening machine;

c) Door frame metal detectors;

d) Hand-held metal detectors;

dd) Explosive detection devices;

e) Under vehicle search mirrors;

g) Specimens and models of weapons, explosives and dangerous articles;

h) Camera surveillance system;

i) Equipment related to training contents.

3. Practice equipment for training programs for aviation security teaching and inspection shall be conformable with training contents.

Article 21. Testing and issuance of course completion certificate

1. Testing:

a) The theory examination shall include multiple-choice questions, essay or interview. The practical examination shall be conducted with existing equipment or simulation software. Students of aviation security screening, security control and mobile security training programs shall take an examination upon finishing each subject; each examination lasts for at least 15 minutes;

b) Theoretical test scores, practical test scores are calculated on a 100-point scale. Students who achieve a course completion test result of 80 points or more for each of the theory and practical tests are awarded a certificate of course completion.

2. Certificate issuance:

a) Students who have completed professional training courses for aviation security controllers shall be granted professional certificates by aviation security controller training institutions according to the form specified in the Circular of the Minister of Transport providing regulations on aviation staff, aviation staff training and professional training institutions and facilities for assessing English proficiency of aviation staff;

b) Students completing training courses in aviation security management, crisis management, aviation security teaching, and aviation security supervisors who are trained and trained by the aviation staff training and professional training institutions shall be granted a certificate of course completion according to the form specified in Appendix 1 issued with this Circular;

c) Students’ completion of the aviation security recurrent training programs specified in Articles 11 - 16 of this Circular shall be certified in writing by the director of the aviation security controller training institution.

3. Students participating in the training programs to be issued with at least two certificates shall be exempted from general subjects and general subjects on aviation security included in the training program.

4. The certificate issued by the training institution affiliated to the International Civil Aviation Organization to learners completing aviation security teacher, aviation security inspector, aviation security management and aviation security crisis management training programs and the certificate specified at Point b Clause 2 of this Article are equally authentic.

Article 22. Dossiers of training provided for aviation security force

1. A dossier of training provided for aviation security force comprises:

a) The final examination result;

b) The decision on recognition of course completion issued by the director of the aviation security controller training institution;

c) The copy of the course completion certificate.

2. A dossier of recurrent training provided for aviation security force comprises:

a) The final examination result;

b) The decision on recognition of course completion issued by the director of the aviation security controller training institution.

 

Chapter III

Article 49. Periodic aviation security awareness training program for persons regularly working in restricted areas

1. Objective: update students on essential knowledge of aviation security and methods of handling aviation security situations related to their mission.

2. Students:

a) Non-aviation service providers’ employees working in restricted areas of airports and airfields;

b) Employees of the technical aviation service providers and aviation equipment repair and maintenance enterprises operating in restricted areas of an airport/airfield;

c) Staff controlling and operating aviation vehicles and equipment regularly operating in restricted areas of airports and airfields;

d) Drivers and aircraft refueling staff;

dd) Environmental hygiene service providers’ employees working in restricted areas of airports and airfields.

Article 50. Time limit for periodic training

1. Flight crew members must undergo periodic training once a year.

2. The entities specified in Articles 38 to 49 of this Circular must undergo periodic training every 03 (three) years.


Section 3

ORGANIZING AVIATION SECURITY AWARENESS TRAINING

 

Article 51. Course books and materials

1. Contents of aviation security awareness training course books and materials shall comply with this Circular and the International Civil Aviation Organization’s standards and practice recommendation.

2. Aviation security awareness training course books and materials must be managed in the same way as the restricted security documents are managed.

Article 52. Aviation security awareness teachers

1. An aviation security awareness teacher shall satisfy the following criteria:

a) Possessing a certificate of supplemental training in teaching or a certificate of completion of training course for aviation security teacher granted by the International Civil Aviation Organization or International Air Transport Association.

b) Possessing a certificate of supplemental training in aviation security awareness teaching specified at Point b, Clause 4, Article 9 and having 5-year experience in the aviation industry.

2. Based on the criteria defined in Clause 1 of this Article, units shall make a list of aviation security awareness teachers and report on it to the Civil Aviation Authority of Vietnam for inspection and monitoring.

Article 53. Examination and grant of certificates of aviation security awareness

1. Examination for the grant of certificates of aviation security awareness may apply methods of multiple-choice questions, essay or interview. The examination shall be graded on a 100-point scale.

2. Students who get at least 80 grades shall be granted a course completion certificate made according to the form in the Appendix 2 to this Circular.

3. The aviation security awareness training dossier includes:

a) The final examination result;

b) The decision on recognition of course completion granted by the head of the training institution;

c) The copy of the course completion certificate.

4. The periodic aviation security awareness training dossier includes:

a) The final examination result;

b) The decision on recognition of course completion granted by the director of the training institution.


Chapter IV

RESPONSIBILITIES OF AGENCIES AND ORGANIZATIONS FOR AVIATION SECURITY TRAINING
 

Article 54. Responsibilities of Civil Aviation Authority of Vietnam

1. Guiding and supervising aviation security-controlling force training institutions, relevant units, organizations and individuals in the implementation of this Circular.

2. Inspecting the provision of aviation security and aviation security awareness training by aviation security controller training institutions, enterprises and units in aviation sector.

3. Carrying out international cooperation in aviation security training in Vietnam.

Article 55. Responsibilities of aviation security controller training institutions

1. Providing aviation security force training and aviation security awareness training in accordance with this Circular.

2. Making a list of teachers for aviation security forces and reporting on it to the Civil Aviation Authority of Vietnam.

3. Formulating, updating and issuing aviation security force training programs and aviation security awareness training programs in accordance with this Circular and reporting on them to the Civil Aviation Authority of Vietnam.

4. Compiling and appraising course books, and materials used for aviation security force training and aviation security awareness training in accordance with this Circular.

5. Implementing measures to improve the quality of aviation security training; providing supplemental training and updating aviation security knowledge, legal knowledge and teaching skills for aviation security teachers.

6. Submitting a consolidated report on the aviation security training to the Civil Aviation Authority of Vietnam by December 15 of every year.

7. Archiving aviation security training dossiers according to the law on archives.

8. Being subject to inspection and supervision of the Ministry of Transport, the Civil Aviation Authority of Vietnam and competent state agencies according to current regulations.

Article 56. Responsibilities of enterprises and units for aviation security training

1. Aviation enterprises and units in aviation sector:

a) Making a list of aviation security awareness teachers, compiling course books of aviation security awareness training and reporting on them to the Civil Aviation Authority of Vietnam;

b) Internally implementing aviation security awareness training;

c) Sending the entities defined in this Circular to participate in aviation security training programs as prescribed;

d) Archiving the aviation security awareness training dossiers according to law regulations on archives;

dd) Implementing measures to improve the quality of aviation security training; providing supplemental training and updating on aviation security knowledge, legal knowledge and teaching skills of aviation security teachers.

e) Submitting a consolidated report on aviation security training to the Civil Aviation Authority of Vietnam by December 15 of every year;

g) Being subject to inspection and supervision of the Ministry of Transport, Civil Aviation Authority of Vietnam and competent state agencies according to current regulations.

2. Enterprises and units whose aviation security control staff engage in the carriage of dangerous goods by air must provide training in dangerous goods according to law regulations on civil aviation safety with respect to aircraft and aircraft operation.

3. Enterprises and units not having any aviation security training awareness teachers or course books shall coordinate with the enterprises and units satisfying requirements for teachers or course books in organizing aviation security awareness training of the enterprises and units.


 

Chapter V

IMPLEMENTATION PROVISIONS
 

Article 57. Effect

The Circular takes effect on January 15, 2018 and replaces the Circular No. 29/2014/TT-BGTVT dated July 29, 2014 of the Minister of Transport on providing regulations on aviation security training.

Article 58. Organization of implementation

Chief of the Ministry Office, Chief Inspector of the Ministry, Directors of Agencies, Director of Civil Aviation Authority of Vietnam, heads of organizations and individuals relevant shall be responsible for implementing this Circular./.
