CIRCULAR
STIPULATING A LIST OF GOODS PRODUCED IN BORDERING COUNTRIES AND IMPORTED INTO THE SOCIALIST REPUBLIC OF VIETNAM IN THE FORM OF PURCHASE, SALE AND EXCHANGE OF GOODS AMONG BORDER INHABITANTS
Pursuant to the Government’s Decree No. 95/2012/ND-CP of November 12, 2012 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Decision No. 254/2006/QD-TTg of November 07, 2006, of the Prime Minister, on management of border trading activities with bordering countries, amended and supplemented by the Decision No. 139/2009/QD-TTg of December 23, 2009 of the Prime Minister;
After reaching agreement with concerned ministries and branches and People’s Committees of bordering provinces, the Minister of Industry and Trade stipulates a list of goods permitted to import into the Socialist Republic of Vietnam in the form of purchase, sale and exchange of goods among border inhabitants as follows:
Article 1.The list of goods produced in bordering countries and imported in the form of purchase, sale and exchange of goods among border inhabitants
1.The list of goods produced in bordering countries and imported in the form of purchase, sale and exchange of goods among border inhabitants is provided in an appendix to this Circular.
2.Goods items apart from provisions in this Circular are not permitted to import into the Socialist Republic of Vietnamin the form of purchase, sale and exchange of goods among border inhabitants.
Article 2. Restraints and supplementation of goods items
1.In case of assurance for food safety, prevention of epidemics across the border or national foods security, the Minister of Industry and Trade shall, after reaching agreement with members of The Steering Committee of border trade, issue decision to not allow border residents to import some of goods items in the List of goods specified in clause 1 Article 1 of this Circular for each border-gate area or province or all border routes.
2.In case of production impulse or provision of goods which are essential for daily life of border residents or due to influences of epidemics, natural disaster, the Minister of Industry and Trade shall, after reaching agreement with members of The Steering Committee of border trade, issue decision to allow border residents to import and enjoy norm of import tax exemption for some of goods items apart from the List of goods specified in clause 1 Article 1 of this Circular for each border-gate area or province or all border routes.
Article 3. Effectiveness
1. This Circular takes effect on March 01, 2013 and replaces the Circular No. 10/2010/TT-BCTof March 29, 2010 of the Ministry of Industry and Trade stipulating a list of goods produced in bordering countries and imported into the Socialist Republic of Vietnam in the form of purchase, sale and exchange of goods among border inhabitants during 2010-2012.
2. While this Circular has not yet taken effect, as from January 01, 2013 until ending February 28, 2013, the Circular No. 10/2010/TT-BCT of March 29, 2010 of the Ministry of Industry and Trade stipulating a list of goods produced in bordering countries and imported into the Socialist Republic of Vietnam in the form of purchase, sale and exchange of goods among border inhabitants during 2010-2012 is continued to implement.
3. In the course of implementation, any arising problems should be reported to the Ministry of Industry and Trade for timely consideration and settlement.
