Circular No. 41/2018/TT-NHNN dated November 28, 2018 of the State Bank of Vietnam on amending and supplementing a number of article of the Circular No. 19/2016/TT-NHNN datedJune 30, 2016 of the State Bank of Vietnam on bank card operation
Pursuant to the Law on the State bank of Vietnam No. 46/2010/QH12 dated June 16, 2010;
Pursuant to the Government s Decree No. 16/2017/ND-CP dated February 17, 2017 defining the functions, tasks, entitlements and organizational structure of the State bank of Vietnam;
At the request of the Director of the Payment Department;
The Governor of the State bank ofVietnam promulgates a Circular on amending and supplementing a number of article of the Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the State Bank of Vietnam on bank card operation
Article 1.To amend and supplement a number the Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the State Bank of Vietnam on bank card operation
1. To supplement Clause 26 into Article 3 as follow:
“The basic standard of domestic chip card is the Basic Standards TCCS 01: 2018/NHNNVN on Technical requirements for contact chip technology of domestic card payment in Vietnam and TCCS 02: 2018/NHNNVN on the Technical requirements for contactless chip technology of domestic card payment in Vietnam published by the Governor of the State Bank of Vietnam enclosed with the Decision No. 1927/QD-NHNN dated October 5, 2018.”
2. To supplement Clause 5 into Article 9 as follow:
“Card issuer must comply with the Basic Standard for domestic chip cards and issuing cards with BIN code issued by the State Bank according to the conversion schedule specified in Article 27b hereinafter”.
3. To supplement Clause 1a into Article 22 as follow:
“1a. Acquirer must comply with the Domestic Standard for chip cards applicable to ATM and card acceptance devices at the point of sale of Acquirer according to conversion schedule specified in Article 27a hereinafter.”
4. To supplement Clause 6 into Article 24 as follow:
“Switching company and clearing company shall take responsibility to update the switching card transactions and the electronic clearing systems to ensure the connection with the Card Issuer and Acquirer during the conversion processspecified in Chapter IVa hereinafter.”
5. To supplement Chapter IVa after Chapter IV as follow:
“CHAPTER IVa
CONVERSION SCHEDULE
Article 27a. For acquirer
1. By December 31, 2019, at least 35% ATM and 50% terminals at point of sale operating in Vietnam of the acquirer meet the requirements of the Basic Standards of domestic chip card.
2. By December 31, 2020, 100% ATM and terminals at point of sale operating in Vietnam of the acquirer meet the requirements of the Basic Standards of domestic chip card.
Article 27b. For card issuer
1. By December 31, 2019, at least 30% circulating card have State Bank issued BIN code of the card issuer meet the requirements of the Basic Standards of domestic chip card.
2. By December 31, 2020, at least 60% circulating card have State Bank issued BIN code of the card issuer meet the requirements of the Basic Standards of domestic chip card.
3. By December 31, 2021, 100% circulating card have State Bank issued BIN code of the card issuer meet the requirements of the Basic Standards of domestic chip card.
Article 27c. Responsibility of card issuer and acquirer
During the conversion progress, card issuer and acquirer shall have to card operations are continuous, stable, safe and ensure the legal rights of cardholders.”
6. To amend and supplement Clause 2 Article 32 (which amended and supplemented by the Circular No. 26/2017/TT-NHNN dated December 29, 2017 of the Governor of the State Bank of Vietnam on amend and supplement a number of the Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the Governor of the State Bank of Vietnam on bank card operation) as follow:
“2. Clause 2 Article 24 of this Circular takes effect on January 01, 2020.”
Article 2. Implementation responsibility
The Chief officers, Directors of Payment Department, Heads of affiliates of the State Bank of Vietnam, Director of branches of the State Bank of provinces and central-affiliated cities, Presidents of the Board of Directors, Presidents of the Member assembly, General Directors (Directors) of credit institutions, branches of foreign banks, switching companies and clearing companies, and relevant organizations and individuals shall implement this Circular.
Article 3. Effect
1. This Circular takes effect on February 18, 2019.
2. Clause 6 Article 1 herein takes effect on January 01, 2019.
