THE MINISTRY OF HEALTH

Pursuant to the Government’s Decree No. 63/2012/ND-CP dated August 31, 2012 defining the rights and responsibilities, powers and organizational structure of the Ministry of Health

Pursuant to the Government’s Decree No.187/2013/ND-CP dated November 20, 2013 detailing the Law on Commerce concerning international trade and purchase, sale, transit and processing agents;

Pursuant to the Government’s Decree No.08/2015/ND-CP dated January 21, 2015on specific provisions and enforcement of the Law on customs in respect of customs procedures, inspection, supervision and control;

Upon request the Director of the Department of Food Safety;

The Minister of Health hereby issues this Circular introducing the nomenclature of foods, food additives, food processing aids and food packaging materials and containers according to their code specified in the import-export tariff schedule under the administration by the Ministry of Health.

Article 1. Introduction of nomenclature

A nomenclature of foods, food additives, food processing aids and food packaging materials and containers according to their code specified in the import-export tariff schedule under the administration by the Ministry of Health is issued together with this Circular.

Article 2. Principles of application

1. Importers of products which are specified on the above-mentioned nomenclature but their code is absent or just 04 or 06 digits of the code are specified shall provide customs authorities with full information on such imports including composition, functions and technical documents (if any), and shall take on responsibilities for such declared information and use such imports in the right manner.

2. In the event that any dispute arises in connection to the code in the Nomenclature attached hereto, the Vietnam Food Administration - Ministry of Health shall take charge of and cooperate with the General Department of Customs –Ministry of Finance to review and decide the code.

Article 3.Effect and implementation

1. This Circular takes effect on December 21, 2016.

2. Directors of Departments of Foods Safety, Heads of affiliates and members of the Ministry of Health, Directors of Departments of Health of provinces and relevant entities shall implement this Circular.

Any problem arising in the course of implementation of this Circular should be promptly reported to Departments of Food Safety. /.
