SUMMARY

45 types of machinery, equipment subject to occupational hygiene and safety requirements

On December 30, 2012, the Ministry of Labor, War Invalids and Social Affairs issues the Circular No. 36/2019/TT-BLDTBXH on promulgating the List of machinery, equipment and materials subject occupational hygiene and safety requirements.

Accordingly, there are 45 types of machinery, equipment and materials subject to occupational hygiene and safety requirements. To be specific: Boilers, of all types, working under the pressure of over 0.7 bar; water heaters for the temperature of exceeding 115°C; Oil heating boilers; Systems supplying, preparing and fueling compressed gas, liquefied gas, liquefied petroleum gas and dissolved gas; Electric winches for railways; Forklift trucks powered by engine for lifting of cargoes with the load capacity of 1,000 kg or more; Elevators of all types; Escalators and conveyors for transport of people...

In addition, this Circular also provides some types of machinery, equipment and materials used in army and police sectors subject to occupational hygiene and safety requirements. To be specific: Types of chemical mace, tear gas; Police electric sticks; Rubber bullet guns; Smoke bombs and explosives; Letter bomb handling equipment; Scrap shredders (in ammunition); Ammunition pneumatic gripper devices; Bomb and ammunition lift trucks; Bomb and bullet cutters; Mortar and bomb removal devices...

This Circular takes effect on March 01, 2020.

CIRCULAR

Promulgating the list of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health[1]

 

Pursuant to June 25, 2015 Law No. 84/2015/QH13 on Occupational Safety and Health;

Pursuant to the Government’s Decree No. 44/2016/ND-CP of May 15, 2016, detailing a number of articles of the Law on Occupational Safety and Health regarding technical inspection of occupational safety, occupational safety and health training and working environment monitoring;

Pursuant to the Government’s Decree No. 14/2017/ND-CP of February 17, 2017, defining functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

At the proposal of the Director of the Bureau for Safe Work;

The Minister of Labor, Invalids and Social Affairs promulgates the Circular promulgating the list of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health.

 

Article 1.List of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health

To promulgate together with this Circular the list of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health.

Article 2.Organization of implementation

1. Based on socio-economic development conditions and state management requirements, ministries shall, when being requested to amend and supplement the list of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health, send their official letters to the Ministry of Labor, Invalids and Social Affairs within their management competence provided in Article 33 of the Law on Occupational Safety and Health, with the following principal contents:

a/ Name of the machinery, equipment, supplies, or substances subject to strict requirements of occupational safety and health which need to be revised or added in/to the list, including scientific names and commercial names (if any);

b/ Evaluation of necessity, feasibility and impacts of revision of the list of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health (enclosed with draft inspection procedures, if any).

2. The Bureau for Safe Work of the Ministry of Labor, Invalids and Social Affairs shall sum up and report to the Ministry of Labor, Invalids, and Social Affairs proposals on revision of the list of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health prescribed by ministries under regulations.

3. Provincial-level Departments of Labor, Invalids and Social Affairs shall coordinate with related agencies in disseminating, and guiding the implementation of, this Circular among enterprises, agencies, organizations, cooperatives, households and individuals using machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health in their localities; and annually sum up and send reports on the implementation of this Circular, together with reports on occupational safety and health work in their localities to the Ministry of Labor, Invalids and Social Affairs.

Article 3.Effect

1. This Circular takes effect on March 1, 2020.

2. The Ministry of Labor, Invalids and Social Affairs’ Circular No. 53/2016/TT-BLDTBXH of December 28, 2016, promulgating the list of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health, ceases to be effective on the effective date of this Circular.

3. Any problems arising in the course of implementation of this Circular should be promptly reported in writing to the Ministry of Labor, Invalids and Social Affairs for consideration and settlement.-

LIST OF MACHINERY, EQUIPMENT, SUPPLIES AND SUBSTANCES SUBJECT TO STRICT REQUIREMENTS ON OCCUPATIONAL SAFETY AND HEALTH

Section I

Machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health

Boilers of all types (including also super heaters and heating boilers) working under a pressure of over 0.7 bar; water heaters with a temperature of over 115°C.

Oil heating boilers.

3

Class-I and class-II pipeline systems for steam and hot water with an outer diameter of 51 mm or larger, and class-III and class-IV pipelines with an outer diameter of 76 mm or larger as classified by Vietnam standards TCVN 6158:1996 and TCVN 6159:1996.

Pressure vessels capable to work under a pressure of over 0.7 bar (excluding hydrostatic pressure) as classified by Vietnam standard TCVN 8366:2010 and pressure vessels capable to work under a pressure of over 210 bar.

Tanks, cisterns, and barrels for storage and transport of liquefied gas, liquefied petroleum gas, compressed natural gas or liquid under a pressure of over 0.7 bar or storage and transport of liquid or powder under no pressure but may be capable to work under a pressure of over 0.7 bar after release as classified by Vietnam standard TCVN 8366:2010.

Bottles for storage and transport of compressed gas, liquefied gas, compressed natural gas, liquefied petroleum gas and dissolved gas under a pressure of over 0.7 bar.

Systems for supplying, processing and fueling compressed gas, liquefied gas, liquefied petroleum gas and dissolved gas.

Fixed gas pipeline systems, submarine gas pipelines, medical gas pipeline systems, and pipeline systems of compressed gas, liquefied gas, and dissolved gas.

Refrigerating system as classified in Vietnam standard TCVN 6739:2015, including refrigerating systems using refrigerants of groups A3, B2L, B2 and B3; using refrigerants of group A2 with a fueling volume of 1.5 kg or more; and using refrigerants of groups A1, A2L and B1 with a fueling volume of 5 kg or more.

Forklift trucks for lifting people: Self-propelled forklift trucks, forklift trucks using hydraulic transmission and manual transmission for lifting people upward exceeding 2 m.
