SUMMARY

Change Product Specific Rules in RCEP

On November 18 2022, the Ministry of Industry and Trade issues Circular No. 32/2022/TT-BCT amending the Minister of Industry and Trade’s Circular No. 05/2022/TT-BCT of February 18, 2022, providing the Rules of Origin within the framework of the Regional Comprehensive Economic Partnership Agreement (RCEP).

Accordingly, the Ministry of Industry and Trade changes the Certificate of origin (C/O), Form RCEP, and C/O continuation sheet, Form RCEP) mentioned at Point c, Clause 1, Article 4 of Circular No. 05/2022/TT-BCT with Appendix II to this Circular.

Product Specific Rules is also replaced with Appendix I to this Circular.

This Circular takes effect on January 1, 2023.

CIRCULAR

Amending the Minister of Industry and Trade’s Circular No. 05/2022/TT-BCT of February 18, 2022, providing the Rules of Origin within the framework of the Regional Comprehensive Economic Partnership Agreement

 

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 31/2018/ND-CP of March 8, 2018, detailing the Law on Foreign Trade Management regarding origin of goods;

To implement the Regional Comprehensive Economic Partnership Agreement signed electronically on November 15, 2020;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular amending the Minister of Industry and Trade’s Circular No. 05/2022/TT-BCT of February 18, 2022, providing the Rules of Origin within the framework of the Regional Comprehensive Economic Partnership Agreement (below referred to as Circular No. 05/2022/TT-BCT).

 

Article 1. To amend and supplement Article 4 of Circular No. 05/2022/TT-BCT as follows:

1. To replace Appendix I (Product Specific Rules) mentioned at Point a, Clause 1, Article 4 of Circular No. 05/2022/TT-BCT with Appendix I to this Circular.

2. To replace Appendix III (Certificate of origin (C/O), Form RCEP, and C/O continuation sheet, Form RCEP) mentioned at Point c, Clause 1, Article 4 of Circular No. 05/2022/TT-BCT with Appendix II to this Circular.

Article 2. Implementation provisions

1. This Circular takes effect on January 1, 2023.

2. In case the legal documents referred to in this Circular have been revised or replaced, the revising or replacing documents shall prevail.-
