CIRCULAR

Promulgating the Procedures for technical safety inspection on tower cranes, builders hoists and gondolas in construction

Pursuant to the Law on Occupational Safety and Health dated June 25, 2015;

Pursuant to the Government’s Decree No. 62/2013/ND-CP dated June 25, 2013, defining the functions, tasks, powers and organizational structure of the Ministry of Construction;

Pursuant to the Government’s Decree No. 44/2016/ND-CP dated May 15, 2016, detailing some articles of the Law on Occupational Safety and Health regarding technical inspection of occupational safety, training of occupational safety and sanitation and monitoring of occupational environment;

At the request of the Director of the State Authority for Construction Quality Inspection;

The Minister of Construction hereby issues the Circular promulgating the Procedures for technical safety inspection on tower cranes, builders hoists and gondolas in construction.

Article 1. To promulgate together with this Circular:

1. Procedures for technical safety inspection on tower cranes - QTKD: 01-2016/BXD.

2. Procedures for technical safety inspection on builders hoists - QTKD: 02-2016/BXD.

3. Procedures for technical safety inspection on gondolas in construction - QTKD: 03-2016/BXD.

Article 2. Scope and subjects of application are prescribed in the Procedures for technical safety inspection attached to this Circular.

Article 3. Within 15 days from the date of issuing the inspection result certificates for machinery and equipment under the procedures for technical safety inspection specified in Article 1 of this Circular, organizations involved in occupational safety inspection activities shall send a copy of the inspection result certificate to the State Authority for Construction Quality Inspection for summarization and monitoring.

Article 4. This Circular takes effect from February 15, 2017.

Article 5. Implementation organization

1. The State Authority for Construction Quality Inspection shall organize the implementation of this Circular; summarize and report the Ministry of Construction proposals on amendment and supplementation to each procedure for technical safety inspection according to the technological development of machinery and equipment with strict requirements on occupational safety under the Ministry of Construction’s management.

2. Organizations involved in occupational safety inspection activities and enterprises, agencies, organizations and individuals owning, managing and using tower cranes, builders hoists and gondolas in construction shall implement this Circular. Any difficulty arising in the course of implementation should be reported to the Ministry of Construction for study and handling./.
