CIRCULAR
Promulgating the List of foods; food containers and food packaging materials in direct contact with food classified as medium-risk products and goods under the Ministry of Health’s management
Pursuant to the Law on Food Safety No. 55/2010/QH12;
Pursuant to the Law on Product and Goods Quality No. 05/2007/QH12, amended and supplemented under the Law Amending and Supplementing a Number of Articles of the Law on Product and Goods Quality No. 78/2025/QH15;
Pursuant to the Government’s Decree No. 37/2026/ND-CP detailing a number of articles of, and providing measures for organizing and guiding the implementation of, the Law on Product and Goods Quality;
Pursuant to the Government's Decree No. 15/2018/ND-CP detailing a number of articles of the Law on Food Safety;
Pursuant to the Government’s Decree No. 42/2025/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Health;
At the proposal of the Director of the Vietnam Food Administration;
The Minister of Health hereby issues the Circular promulgating the List of foods; food containers and food packaging materials in direct contact with food classified as medium-risk products and goods under the Ministry of Health’s management.
Article 1. List of foods; food containers and food packaging materials in direct contact with food classified as medium-risk products and goods under the Ministry of Health’s management
To promulgate the List of foods; food containers and food packaging materials in direct contact with food classified as medium-risk products and goods under the Ministry of Health’s management, in the Appendix to this Circular.
Article 2. Reference provisions
In case any legal documents referred to in this Circular are amended, supplemented, replaced or newly promulgated, the amending, supplementing, replacing or newly promulgated ones shall prevail.
Article 3. Implementation organization
1. The Director of the Vietnam Food Administration shall
a) Organize the implementation, provide guidance, and conduct inspection of the implementation of this Circular.
b) Continue to review and propose updates to, and supplementation of, the List of foods; food containers and food packaging materials intended for direct contact with food classified as medium-risk and high-risk products and goods under the Ministry of Health’s management.
2. Provincial-level People’s Committees shall
a) Organize the implementation of this Circular within their localities in accordance with their assigned functions, duties, and powers;
b) Direct specialized agencies to manage and inspect the products included in the List to this Circular in accordance with law.
Article 4. Effect
This Circular takes effect from July 01, 2026.
Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Health (via the Vietnam Food Administration) for study and settlement./.
