CIRCULAR

Providing guidance on the pilot auction of import tariff quota
for sugar in 2020

Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017, on defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018, on detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 62/2017/ND-CP dated May 16, 2017, on detailing and guiding the implementation of a number of articles of the Law on Property Auction;

Pursuant to the Government’s Decree No. 151/2017/ND-CP dated December 26, 2017, on detailing a number of articles of the Law on Management and Use of Public Property;

At the proposal of the Director of the Agency of Foreign Trade,

The Minister of Industry and Trade hereby promulgates the Circular on providing guidance on the pilot auction of import tariff quota for sugar in 2020.

 

Article 1. Scope of regulation

This Circular prescribed the volume of import tariff quota for sugar (HS code: 1701) and principles of pilot auction of tariff quota for the import of sugar in 2020.

Article 2. Subjects of application

1. Traders that directly use sugar as a production material and traders that use coarse sugar for making refined sugar.

2. Organizations and individuals involved in the import of sugar under the 2020 tariff quota.

Article 3. Sugar import tariff quota for auction in 2020

The volume of import tariff quota for sugar put for auction in 2020 is 103,000 tons, including:

1. The import tariff quota for coarse sugar is 72,000 tons.

2. The import tariff quota for refined sugar is 31,000 tons.

Article 4. Auction principles

1. The principles, order and procedures for property auction must comply with the law on property auction as suitable to the characteristics of property put up for auction.

2. The Ministry of Industry and Trade shall form a Council for pilot auction of tariff quota for the import of sugar in 2020 to administer the auction.

3. The auction Council’s Chairperson shall issue the Regulation on pilot auction of tariff quota for the import of sugar in 2020.

Article 5. Notification of assigning the right to use quota

1. After receiving the auction Council’s report on auction results, the Ministry of Industry and Trade shall issue a written notice assigning the right to use tariff quota for the import of sugar to auction-winning traders.

2. The use of the written notice assigning the right to use tariff quota for the import of sugar to auction-winning traders for performance of customs procedures must comply with the customs law.

Article 6. Effect

This Circular takes effect from November 13, 2020 to the end of December 31, 2022./.
