SUMMARY

List of HS codes in agriculture, plant protection products

The list of harmonized system (HS) codes for exports and imports in aquaculture environmental remediation products; plant protection products; fertilizers..prescribed by the Ministry of Agriculture and Rural Development at the Circular No. 24/2017/TT-BNNPTNT on November 15, 2017.

Circular No. 24/2017/TT-BNNPTNT dated November 15, 2017 of the Ministry of Agriculture and Rural Development on promulgating list of harmonized system (HS) codes for exports and imports under management of the ministry of agriculture and rural development

Pursuant to the Government s Decree No. 15/2017/ND-CP dated February 17, 2017 specifying functions, duties, entitlements and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government s Decree No. 187/2013/ND-CP dated November 20, 2013 on guidelines for the Law on Commerce in respect of international trade of goods and activities of agency for sale and purchase, processing and transit of goods involving foreign parties;

At the request of Director of the Legal Department; Directors of General Departments of:  Forestry, Aquaculture; Directors of Departments of: Plant Protection, Farming, Veterinary, Animal Husbandry, Agro-Forestry-Fishery Quality Control, Cooperative Economy and Rural Development;

The Minister of Agriculture and Rural development promulgates a Circular on list of harmonized system (HS) codes for exports and imports under management of the ministry of agriculture and rural development

Article 1. Issue together with this Circular the following Appendices:

1. Appendix 01: List of HS codes for plant protection products;

2. Appendix 02: List of HS codes for plant protection products banned in Vietnam;

3. Appendix 03: List of HS codes for regulated articles subject to plant quarantine in Vietnam;

4. Appendix 04: List of HS codes for fertilizers;

5. Appendix 05: List of HS codes for food of imported vegetable original subject to food safety inspection under management of the Ministry of Agriculture and Rural Development;

6. Appendix 06: List of HS codes for plant varieties permissible for business in Vietnam;

7. Appendix 07: List of HS codes for round logs, saw logs of all kinds from natural forest timber in the country banned from export;

8. Appendix 08: List of HS codes for combined food of agricultural-forestry-aquatic origin imported to Vietnam under management of the Ministry of Agriculture and Rural Development;

9. Appendix 09: List of HS codes for salt (including table salt and denatured salt);

Article 2.Effect

1. This Circular takes effect January 1, 2018.

2. This Circular supersedes documents and Appendices below:

a) Decision No. 38/2008/QD-BNN dated February 28, 2008 of the Minister of Agriculture and Rural Development promulgating the list of HS codes for aquatic exports and imports;

b) Decision No. 2515/QD-BNN-BVTV dated June 29, 2015 of the Minister of Agriculture and Rural development promulgating list of HS codes for articles subject to plant quarantine in Vietnam;

c) Decision No. 2766/QD-BNN-CN dated July 13, 2015 of the Minister of Agriculture and Rural development promulgating list of HS codes for domestic animals permissible for business in Vietnam;

d) Decision No. 5481/QD-BNN-CN dated December 30, 2005 of the Minister of Agriculture and Rural development promulgating list of HS codes for precious domestic animals banned from export;

dd) Decision No. 4069/QD-BNN-QLCL dated October 14, 2015 of the Minister of Agriculture and Rural development publishing the list of imports subject to food safety inspection before customs clearance under management of the Ministry of Agriculture and Rural Development;

e) Decision No. 13/QD-BNN-TCTS dated January 5, 2016 of the Minister of Agriculture and Rural Development promulgating the list of HS codes for list of aquaculture products in Vietnam;

g) Decision No. 4758/QD-BNN-TY dated November 18, 2015 of the Minister of Agriculture and Rural development promulgating  list of HS codes of terrestrial animals and animal products subject to quarantine in Vietnam;

h) Decision No. 2432/QD-BNN-TT dated July 13, 2015 of the Minister of Agriculture and Rural development promulgating list of HS codes for plant varieties permissible for business in Vietnam;

i) Circular No. 24/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of Agriculture and Rural development promulgating list of HS codes for round logs, saw logs of all kinds from natural forest timber in the country banned from export and exported goods subject to licenses being firewood, coal made of logs derived from natural forest timber in the country;

k) Appendix IB. List of veterinary medicine permission for import to circulate in Vietnam issued together with Circular No. 10/2016/TT-BNNPTNT dated June 1, 2016 of the Minister of Agriculture and Rural development;

l) Part B, Appendix IC. List of aquatic medicine permission permitted to circulated in Vietnam issued together with Circular No. 10/2016/TT-BNNPTNT dated June 1, 2016 of the Minister of Agriculture and Rural development;

m) Appendix III of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural development promulgating the list of plant protection products permissible for use or banned in Vietnam; publishing list of HS codes for plant protection products permissible for use or banned in Vietnam.

3. HS codes prescribed in Appendix II of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural development promulgating the list of plant protection products permissible for use or banned in Vietnam; publishing list of HS codes for plant protection products permissible for use or banned in Vietnam.

Article 3. Implementationorganization

The Chief of the Ministry Office, Director of the Legal Department, Heads of units affiliated to Ministries and relevant entities shall implement this Circular.

Any difficulties arising in the course of implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development for consideration./.
