SUMMARY

Banks are required to issue chip cards from March 31, 2021

On December 31, 2020, the State Bank of Vietnam issues the Circular No. 22/2020/TT-NHNN on amending and supplementing a number of articles of the Circular No. 19/2016/TT-NHNN dated June 30, 2016 by the Governor of the State Bank of Vietnam on bank card operations.

Specifically, to change the deadline for 100% acquirers’ automated teller machines (ATM) and point of sale (POS) machines operating in Vietnam to comply with basis standards for domestic chip cards to December 31, 2021 instead of December 31, 2020 as in previous regulations.

Besides, from March 31, 2021, organizations issuing cards with BIN (bank identification number) granted by the State Bank must comply with basis standards for domestic chip cards.

This Circular takes effect on February 16, 2021.

CIRCULAR

On amending and supplementing a number of articles of the Circular No. 19/2016/TT-NHNN dated June 30, 2016 by the Governor of the State Bank of Vietnam on bank card operations

Pursuant to the Law on State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credit Institutions dated June 16, 2010 and the Law Amending and Supplementing a Number of Articles of the Law on Credit Institutions dated November 20, 2017;

Pursuant to the Government's Decree No. 101/2012/ND-CP dated November 22, 2012, on non-cash payments; the Government's Decree 80/2016/ND-CP dated July 01, 2016, on amending and supplementing a number of articles of the Decree No. 101/2012/ND-CP; the Government's Decree 16/2019/ND-CP dated February 01, 2019, on amending and supplementing a number of articles of the Decrees on business conditions under the State management of the State Bank of Vietnam;

Pursuant to the Government’s Decree No. 16/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of Payment Department;

The Governor of the State Bank of Vietnam hereby promulgates the Circular on amending and supplementing a number of the articles of the Circular No. 19/2016/TT-NHNN dated June 30, 2016 the Governor of the State Bank of Vietnam on bank card operations (hereinafter referred to as the Circular No. 19/2016/TT-NHNN).

 

Article 1. To amend and supplement a number of articles of the Circular No. 19/2016/TT-NHNN

1. To amend and supplement Clause 2, Article 27a (supplemented according to Clause 5, Article 1 of the Circular No. 41/2018/TT-NHNN dated December 28, 2018 of the Governor of the State Bank of Vietnam on amending and supplementing a number of articles of the Circular No. 19/2016/TT-NHNN) as follows:

“2. By December 31, 2021, 100% acquirers’ automated teller machines (ATM) and point of sale (POS) machines that are operating in Vietnam shall comply with basis standards for domestic chip cards.”.

2. To amend and supplement Clause 2, Article 27a (supplemented according to Clause 5, Article 1 of the Circular No. 41/2018/TT-NHNN dated December 28, 2018 of the Governor of the State Bank of Vietnam on amending and supplementing a number of articles of the Circular No. 19/2016/TT-NHNN) as follows:

“4. From March 31, 2021, organizations issuing cards with BIN (bank identification number) granted by the State Bank must comply with basis standards for domestic chip cards.”.

Article 2. Responsibility for implementation organization

Chief of Office, Director of the Payment Department, Heads of units affiliated to the State Bank of Vietnam; credit institutions and foreign bank branches, switching companies and electronic clearing companies shall be responsible for the implementation of this Circular.

Article 3. Implementation provisions

1. This Circular takes effect on December 16, 2021, excluding regulations in Clause 2 of this Article.

2. Clause 1, Article 1 of this Circular takes effect on January 01, 2021./.
