Circular 19/2022/TT-BNNPTNT List of pesticides banned from use in Vietnam

CIRCULAR

Promulgating the List of pesticides permitted for use in Vietnam and the List of pesticides banned from use in Vietnam^[1]

Pursuant to the November 25, 2013 Law on Plant Protection and Quarantine;

Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development promulgates the Circular promulgating the List of pesticides permitted for use in Vietnam and the List of pesticides banned from use in Vietnam.

Article 1. To promulgate together with this Circular:

1. The List of pesticides permitted for use in Vietnam, provided in Appendix I to this Circular, including:

a/ Pesticides for use in agriculture:

- Insecticides: 689 active ingredients with 1,670 trade names.

- Fungicides: 651 active ingredients with 1,492 trade names.

- Herbicides: 256 active ingredients with 765 trade names.

- Rat killers: 8 active ingredients with 37 trade names.

- Growth regulators: 58 active ingredients with 172 trade names.

- Insect attractants: 8 active ingredients with 8 trade names.

- Snail killers: 31 active ingredients with 152 trade names.

- Adjuvants (spreaders): 5 active ingredients with 6 trade names.

b/ Termiticides: 14 active ingredients with 21 trade names.

c/ Forest product preservatives: 7 active ingredients with 8 trade names.

d/ Warehouse disinfectants: 3 active ingredients with 9 trade names.

dd/ Pesticides for use for golf courses:

- Fungicides: 2 active ingredients with 2 trade names.

- Herbicide: 1 active ingredient with 1 trade name.

- Growth regulator: 1 active ingredient with 1 trade name.

e/ Seed treatments:

- Insecticides: 10 active ingredients with 16 trade names.

- Fungicides: 13 active ingredients with 13 trade names.

g/ Post-harvest preservatives for agricultural products

- 1 active ingredient with 1 trade name.

2. The List of pesticides banned from use in Vietnam, provided in Appendix II to this Circular, including:

a/ Insecticides and forest product preservatives: 23 active ingredients.

b/ Fungicides: 6 active ingredients.

c/ Rat killers: 1 active ingredient.

d/ Herbicides: 1 active ingredient.

3. The table of HS codes for pesticides permitted for use  or banned from use in Vietnam must comply with Sections 22 and 23 of Appendix I to the Minister of Agriculture and Rural Development’s Circular No. 11/2021/TT-BNNPTNT of September 20, 2021, promulgating tables of HS codes for the list of goods falling under the state management by the Ministry of Agriculture and Rural Development and the list of imported and exported goods subject to specialized inspection in the field of agriculture and rural development. In case the legal documents promulgating tables of HS codes have been revised or replaced, the revising or replacing documents shall prevail.

Article 2. Effect

1. This Circular takes effect on January 16, 2023.

2. The Minister of Agriculture and Rural Development’s Circular No. 19/2021/TT-BNNPTNT of December 28, 2021, promulgating the List of pesticides permitted for use in Vietnam and the List of pesticides banned from use in Vietnam, ceases to be effective on the effective date of this Circular.

Article 3. Implementation responsibility

1. The Director of the Plant Protection Department and heads of units of the Ministry of Agriculture and Rural Development, directors of provincial-level Departments of Agriculture and Rural Development, and related organizations and individuals shall implement this Circular.

2. Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development (through the Plant Protection Department) for consideration and timely settlement.-
