CIRCULAR
Amending and supplementing a number of Articles of the Circular No. 48/2013/TT-BNNPTNT dated November 12, 2013 of the Minister of Agriculture and Rural development on inspection and validation of food safety for exported fishery products and the Circular No. 02/2017/TT-BNNPTNT dated February 13, 2017 of the Minister of Agriculture and Rural development on amending and supplementing a number of Articles of the Circular No. 48/2013/TT-BNNPTNT
Pursuant to the Law on Food Safety dated June 17, 2010;
Pursuant to the Law on Product and Goods Quality dated November 21, 2007;
Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008 detailing the implementation of a number of Articles of the Law on Product and Goods Quality and the Degree No. 74/2018/ND-CP dated May 15, 2018 amending and supplementing a number of Articles of the Government’s Decree No. 132/2008/ND-CP;
Pursuant to the Government’s Decree No. 15/2018/ND-CP dated February 22, 2018, elaborating on the implementation of a number of articles of the Law on Food Safety;
Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 prescribing the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Upon the request of the Director of the Agro-Forestry-Fisheries Quality Assurance Department,
The Minister of Agriculture and Rural Development hereby promulgates the Circular Amending and supplementing a number of Articles of the Circular No. 48/2013/TT-BNNPTNT dated November 12, 2013 of the Minister of Agriculture and Rural development on inspection and validation of food safety for exported fishery products and the Circular No. 02/2017/TT-BNNPTNT dated February 13, 2017 of the Minister of Agriculture and Rural development on amending and supplementing a number of Articles of the Circular No. 48/2013/TT-BNNPTNT.
Article 1. To amend and supplement a number of Articles of the Circular No. 48/2013/TT-BNNPTNT dated November 12, 2013 of the Minister of Agriculture and Rural development on inspection and validation of food safety for exported fishery products
1. To amend and supplement Point a, Clause 1, Article 2 as follows:
“a) Establishments exporting fishery products to states and territories that require consignments to be granted Certificates by the Department of Agro-Forestry-Fisheries Quality Assurance.”
2. To amend and supplement Point a, Clause 3, Article 2 as follows:
“a) Establishments for domestic consumption only or establishments that export fishery products to states and territories that do not require consignments to be granted Certificates by the Department of Agro-Forestry-Fisheries Quality Assurance.”
3. To amend Article 5 as follows:
“Article 5. Evaluation authority
The agency that evaluates and grants Certificates of Food safety and the agency that evaluates and grants Certificates shall be Department of Agro-Forestry-Fisheries Quality Assurance (hereinafter referred to as Evaluation authority).”
4. To amend Article 6 as follows:
“Article 6. Requirements for inspectors and Head of the evaluation team”
5. To amend the name of the Chapter II as follows:
“Chapter II: Evaluation of conditions for food safety”
6. To amend Article 10 as follows:
“Article 10. Dossiers for registration and report on information adjustment”
