CIRCULAR
GUIDING THE HANDLING OF CONVERSION OF THE INVESTMENT AND CONSTRUCTION PROJECTS MANAGEMENT ACCORDING TO THE GOVERNMENT’S DECREE No. 12/2000/ND-CP OF MAY 5, 2000 WHICH AMENDS AND SUPPLEMENTS DECREE No. 52/1999/ND-CP
On May 5, 2000, the Government issued Decree No. 12/2000/ND-CP amending and supplementing a number of articles of the Regulation on Investment and Construction Management, issued together with the Government’s Decree No. 52/1999/ND-CP of July 8, 1999, in which the scale of investment project classification has changed according to Groups A, B, C.
In furtherance of the Government’s Decree No. 12/2000/ND-CP, as provided for in Article 3 on guiding and inspecting the implementation of this Decree, after consulting with the Ministry of Investment and Planning and the Ministry of Finance, the Ministry of Construction hereby guides the handling of conversion of a number of provisions on management of investment projects according to the Government’s Decree No. 12/2000/ND-CP as follows:
In furtherance of the Government’s Decree No. 12/2000/ND-CP, as provided for in Article 3 on guiding and inspecting the implementation of this Decree, after consulting with the Ministry of Investment and Planning and the Ministry of Finance, the Ministry of Construction hereby guides the handling of conversion of a number of provisions on management of investment projects according to the Government’s Decree No. 12/2000/ND-CP as follows:
For the investment projects (including constituent projects and/or sub-projects) which are classified as group A projects under Decree No. 52/2000/ND-CP, but are now classified as Group B projects under Decree No. 12/2000/ND-CP, they shall be handled on the case by case basis:
1. In cases where the investment projects have not yet been approved by the Prime Minister, the submission for approval shall comply with the provisions prescribed for Group B projects in the Government’s Decree No. 12/2000/ND-CP of May 5, 2000.
2. In cases where the investment projects or a number of next steps have also been approved by the Prime Minister as provided for Group A projects, they must not be submitted for re-approval; the next steps shall comply with the provisions prescribed for the Group B projects.
