CIRCULAR
Guiding the collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes[1]
Pursuant to the November 17, 2020 Law on Environmental Protection;
Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
At the proposal of the Directors of the Department of Science, Technology and Environment and the Department of Livestock Production;
The Minister of Agriculture and Rural Development promulgates the Circular guiding the collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
1. This Circular guides the collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes.
2. This Circular does not regulate the collection and treatment of animal husbandry wastes in epidemic-hit areas.
Article 2. Subjects of application
This Circular applies to organizations and individuals engaged in the collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes.
Article 3. Interpretation of terms
In this Circular, the terms below are construed as follows:
1. Animal husbandry wastes to be reused for other purposes include solid organic wastes and wastewater generated from animal husbandry activities.
2. Treatment of animal husbandry wastes means application of appropriate technological solutions or technical measures to treat animal husbandry wastes into manure and irrigation water for plants, aquatic animal feed or for reuse for other purposes.
3. Agricultural by-products (plant by-products) means auxiliary products generated from the process of tending, harvesting or preliminarily processing crop products in areas under plant cultivation.
4. Other purposes means the use of animal husbandry wastes and agricultural by-products as raw materials, fuels and materials for other production activities.
Chapter II
COLLECTION AND TREATMENT OF ANIMAL HUSBANDRY WASTES AND AGRICULTURAL BY-PRODUCTS TO BE REUSED FOR OTHER PURPOSES
Article 4. Collection of animal husbandry wastes
1. Collection of solid organic wastes
a/ Solid organic wastes in household-based animal husbandry shall be collected for treatment in accordance with Point a, Clause 1, Article 5 of this Circular in order to prevent environmental pollution;
b/ Solid organic wastes in farm-based animal husbandry shall be collected and transported to gathering places in premises of animal husbandry farms and treated under Point b, Clause 1, Article 5 of this Circular, in order to prevent environmental pollution. Solid organic wastes shall be collected every day from cattle-raising facilities or collected in intervals from poultry-raising facilities and animal husbandry facilities using bio mattresses;
c/ Places for gathering solid wastes in premises of animal husbandry farms for treatment must be far from stables, water supply sources and animal feed warehouses.
2. Animal husbandry wastewater shall be collected for treatment by separate systems in accordance with Clause 2, Article 5 of this Circular.
Article 5. Treatment of animal husbandry wastes
1. Treatment of solid organic wastes
a/ Solid organic wastes in household-based animal husbandry shall be treated by one or a group of the following measures: composting, using biogas technology bio-preparations, use of bio mattresses or other solutions, so as to be used for plants;
b/ Solid organic wastes in farm-based animal husbandry that have been treated up to national technical regulations may be used for plants or as aquatic animal feed. Pending the issuance of national technical regulations, the treatment of solid organic wastes must comply with guidance of specialized management agencies;
c/ The transportation of untreated solid organic wastes out of animal husbandry establishments must comply with the law on environmental protection.
2. Treatment of animal husbandry wastewater
a/ The treatment of household-based animal husbandry wastewater by applying one or a group of the following measures: use of biogas technology or bio-ponds, bio-preparations or other solutions so as to be used for plants and must minimize foul odor and spill of wastewater into adjacent areas.
b/ Farm-based animal husbandry wastewater meeting national technical regulations on animal husbandry wastewater used for plants may be used to water plants or for other purposes in farm premises. The use of animal husbandry wastewater must minimize foul odor and spill of wastewater into adjacent areas.
3. The use of bio-preparations and application of technological advances and new techniques in animal husbandry waste treatment process is encouraged.
Article 6. Collection and treatment of agricultural by-products to be reused for other purposes
The collection and treatment of agricultural by-products to be reused for other purposes must comply with the Minister of Agriculture and Rural Development’s Circular No. 19/2019/TT-BNNPTNT of November 15, 2019, on collection, disposal and use of plant by-products.
Chapter III
ORGANIZATION OF IMPLEMENTATION
Article 7. Responsibilities of units of the Ministry of Agriculture and Rural Development
1. The Department of Science, Technology and Environment shall monitor the implementation of this Circular for summarization and reporting to the Ministry.
2. The Departments of Livestock Production and Crop Production
a/ To guide and inspect the implementation of this Circular in the fields assigned to them; to report implementation results to the Ministry (via the Department of Science, Technology and Environment) for summarization;
b/ To assume the prime responsibility for, and coordinate with related agencies and units in, drafting technical documents guiding the collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes as appropriate to reality.
Article 8. Responsibilities of provincial-level Departments of Agriculture and Rural Development
1. To advise provincial-level People’s Committees on organization of the collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes in their localities.
2. To guide and examine the implementation of this Circular in their localities and report implementation results to the Ministry of Agriculture and Rural Development (via the Department of Science, Technology and Environment).
Article 9. Responsibilities of organizations and individuals engaged in collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes
1. To comply with this Circular and relevant laws.
2. To provide information and promptly report to provincial-level Departments of Agriculture and Rural Development on difficulties and problems in the collection and treatment of animal husbandry wastes and agricultural by-products to be reused for other purposes.
Article 10. Effect
This Circular takes effect on January 1, 2022.
Any problems arising in the course of implementation should be promptly reported to the Ministry of Agriculture and Rural Development (via the Department of Science, Technology and Environment) for study, amendment and supplementation.-
