CIRCULAR

Repealing Circulars in the field of voluntary supplementary pensions promulgated by the Minister of Finance

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15, amended and supplemented under Law No. 87/2025/QH15;

Pursuant to the Government’s Decree No. 29/2025/ND-CP of February 26, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Finance, amended and supplemented under Decree No. 166/2025/ND-CP of June 30, 2025;

Pursuant to the Government’s Decree No. 78/2025/ND-CP of April 01, 2025, detailing a number of articles of, and measures for organizing and guiding the implementation of, the Law on Promulgation of Legal Documents, amended and supplemented under Decree No. 187/2025/ND-CP of July 01, 2025;

Pursuant to the Government’s Decree No. 85/2026/ND-CP of March 25, 2026, on supplementary pension insurance;

At the proposal of the Director of the Financial Institutions Department;

The Minister of Finance hereby promulgates the Circular repealing Circulars in the field of voluntary supplementary pensions promulgated by the Minister of Finance.

Article 1. To entirety repeal Circulars in the field of voluntary supplementary pensions promulgated by the Minister of Finance

1. To repeal Circular No. 86/2017/TT-BTC of August 15, 2017, of the Minister of Finance, providing the guidance on a number of articles of Decree No. 88/2016/ND-CP dated July 01, 2016, of the Government, on voluntary supplementary pension program (hereinafter referred to as Circular No. 86/2017/TT-BTC), except for the provisions of Clause 2 of this Article.

2. Enterprises managing voluntary supplementary pension funds established under the Government’s Decree No. 88/2016/ND-CP of July 01, 2016, on the voluntary supplementary pension program shall continue to comply with Clauses 2 and 3, Article 3 of Circular No. 86/2017/TT-BTC while adjusting their investment portfolios and investment structures under Point c, Clause 3, Article 44 of the Government’s Decree No. 85/2026/ND-CP of March 25, 2026, on supplementary pension insurance, within 12 months from the effective date of this Decree. Clauses 2 and 3, Article 3 of Circular No. 86/2017/TT-BTC shall be repealed from May 10, 2027.

Article 2. Implementation provisions

1. This Circular takes effect on September 15, 2026.

2. The Chief of the Office of the Ministry of Finance, the Director of the Financial Institutions Department, heads of related units under the Ministry of Finance, and related agencies, organizations and individuals shall implement this Circular.
