Circular 11/2021/TT-BNNPTNT lists of imported and exported goods subject to specialized inspection in the field of agriculture and rural development

CIRCULAR

Promulgating tables of HS codes for lists of goods under the state management by the Ministry of Agriculture and Rural Development and lists of imported and exported goods subject to specialized inspection in the field of agriculture and rural development^[1]

Pursuant to the Government’s Decree No. 15/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 85/2019/ND-CP of November 14, 2019, prescribing the performance of administrative procedures under the national single-window mechanism and the ASEAN Single-Window mechanism and specialized inspection of imported and exported goods;

At the proposal of the Director of the Legal Affairs Department; Director General of the Directorate of Fisheries; Director General of the Vietnam Administration of Forestry; and Directors of the Departments of Plant Protection, Animal Health, Livestock Production, Crop Production, and Cooperatives and Rural Development;

The Minister of Agriculture and Rural Development promulgates the Circular promulgating tables of HS codes for lists of goods under the state management by the Ministry of Agriculture and Rural Development and lists of imported and exported goods subject to specialized inspection in the field of agriculture and rural development.

Article 1. To promulgate together with this Circular:

1. Appendix I: Tables of HS codes for lists of goods under the state management by the Ministry of Agriculture and Rural Development, including:

Section 1: Table of HS codes for the list of terrestrial animals and animal products subject to quarantine.

Section 2: Table of HS codes for the list of other animals in livestock production.

Section 3: Table of HS codes for the list of animal breeds banned from export.

Section 4: Table of HS codes for the list of animal breeds in need of conservation.

Section 5: Table of HS codes for the list of aquatic animals and animal products subject to quarantine.

Section 6: Table of HS codes for the list of aquatic species permitted for production and trading in Vietnam.

Section 7: Table of HS codes for the list of aquatic species subject to conditional export.

Section 8: Table of HS codes for the list of aquatic species banned from export.

Section 9: Table of HS codes for Vietnam’s list of objects subject to plant quarantine.

Section 10: Table of HS codes for the list of food originating from imported plants.

Section 11: Table of HS codes for the list of plant varieties.

Section 12: Table of HS codes for the list of plant genetic resources banned from export.

Section 13: Table of HS codes for the list of salt products (including also table salt and denatured salt).

Section 14: Table of HS codes for commercial animal feed products which are published on the Portal of the Ministry of Agriculture and Rural Development.

Section 15: Table of HS codes for the list of chemicals, bioproducts and microorganisms banned from use in animal feeds.

Section 16: Table of HS codes for the list of chemicals, bio-preparations, microorganisms and animal feed ingredients permitted for use in aquaculture in Vietnam, aquatic animal feeds and aquaculture environment treatment finished-products.

Section 17: Table of HS codes for the list of chemicals, bio-preparations and microorganisms banned from use in aquatic animal feeds and aquaculture environment treatment products.

Section18: Table of HS codes for the list of veterinary drugs and veterinary drug materials permitted for import and circulation in Vietnam.

Section 19: Table of HS codes for the list of fertilizers.

Section 20: Table of HS codes for the list of assorted logs and sawn timber from domestic natural forests.

Section 21: Table of HS codes for the list of timber and timber products for which legal timber dossiers are required upon their export.

Section 22: Table of HS codes for the list of pesticides.

Section 23: Table of HS codes for the list of pesticides banned from use in Vietnam.

Section 24: Table of HS codes for the list of products in the field of fishing.

Section 25: Table of HS codes for the list of livestock waste treatment products.

Section 26: Table of HS codes for the list of agricultural machinery and equipment.

2. Appendix II: Table of HS codes for the list of imported goods subject to specialized inspection before customs clearance under the state management by the Ministry of Agriculture and Rural Development: 1,639 (one thousand, six hundred and thirty-nine) commodity codes.

3. Appendix III: Table of HS codes for the list of imported goods subject to specialized inspection after customs clearance under the state management by the Ministry of Agriculture and Rural Development: 3 (three) commodity codes.

4. The specialized inspection of exported goods under the state management by the Ministry of Agriculture and Rural Development shall be carried out at the request of enterprises to serve customs clearance for goods in importing countries.

Article 2. Effect

1. This Circular takes effect on November 6, 2021.

2. This Circular replaces the Minister of Agriculture and Rural Development’s Circular No. 15/2018/TT-BNNPTNT of October 29, 2018, promulgating tables of HS codes for lists of goods under the management by the Ministry of Agriculture and Rural Development.

Article 3. Implementation responsibility

1. The Chief of the Office, Director of the Legal Affairs Department, and heads of units of the Ministry of Agriculture and Rural Development, and related agencies, organizations and individuals shall implement this Circular.

2. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for study and revision as appropriate.-
