CIRCULAR
On promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations

Pursuant to the Law on Occupational Safety and Health dated June 25, 2015;
Pursuant to the Government’s Decree No. 14/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;
At the proposal of the Director of the Bureau for Safe Work;
The Minister of Labor, War Invalids and Social Affairs hereby issues the Circular on promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations.
Article 1. List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations
To promulgate together with this Circular the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations.
Article 2. Implementation organization
On an annual basis, ministries managing sectors and fields, employers shall actively review and assess the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations according to the methods provided by the Minister of Labor, War Invalids and Social Affairs in order to propose for amendment and supplementation of the List in compliance with the socio-economic, technology and science development and management in each period.
Article 3. Effect
1. This Circular takes effect on March 01, 2021.
2. From the effective date of this Circular, the following Decisions and Circulars shall cease to be effective:
a) Decision No. 1453/LDTBXH-QD dated October 13, 1995 of the Minister of Labor, War Invalids and Social Affairs on temporarily promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations;
b) Decision No. 915/LDTBXH-QD dated July 30, 1996 of the Minister of Labor, War Invalids and Social Affairs on temporarily promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations;
c) Decision No. 1629/LDTBXH-QD dated December 26, 1996 of the Minister of Labor, War Invalids and Social Affairs on temporarily promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations;
d) Decision No. 190/1999/QD-BLDTBXH dated March 03, 1999 of the Minister of Labor, War Invalids and Social Affairs on temporarily promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations;
dd) Decision No. 1580/2000/QD-BLDTBXH dated December 26, 2000 of the Minister of Labor, War Invalids and Social Affairs on temporarily promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations;
e) Decision No. 1152/2003/QD-BLDTBXH dated September 18, 2003 of the Minister of Labor, War Invalids and Social Affairs on temporarily promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations;
g) Circular No. 36/2012/TT-BLDTBXH dated December 28, 2012 of the Minister of Labor, War Invalids and Social Affairs on additionally promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations;
h) Circular No. 15/2016/TT-BLDTBXH dated June 28, 2016 of the Minister of Labor, War Invalids and Social Affairs on promulgating the List of heavy, hazardous, dangerous jobs or occupations and extremely heavy, hazardous, dangerous jobs or occupations.
3. The time the employees do the jobs and occupations provided in the annulled Decisions and Circulars as prescribed in Clause 2 of this Article is still counted as the time doing heavy, hazardous, dangerous jobs and occupations or extremely heavy, hazardous, dangerous jobs and occupations until the effective date of this Circular.
4. Any difficulties arising in the course of implementation should be reported to the Ministry of Labor, War Invalids and Social Affairs for consideration and solutions./.
