CIRCULAR
Amending and supplementing a number of articles of circulars on providing the quarantine of terrestrial animals and animal products

Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Animal Health dated June 19, 2015;
Pursuant to the Government’s Decree No. 13/2020/ND-CP dated January 21, 2020, guiding in detail the Law on Animal Husbandry;
Pursuant to the Government’s Decree No. 26/2019/ND-CP dated March 08, 2019, guiding in detail the Law on Fisheries;
At the request of the Director of the Department of Animal Health;
The Minister of Agriculture and Rural Development promulgates the Circular amending and supplementing a number of articles of circulars on providing the quarantine of terrestrial animals and animal products.
Article 1. To amend and supplement a number of articles of the Circular No. 25/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of Agriculture and Rural Development, providing the quarantine of terrestrial animals and animal products (amended and supplemented by the Circular No. 35/2018/TT-BNNPTNT dated December 25, 2018 of the Minister of Agriculture and Rural Development)
1. To amend and supplement Clause 2 of Article 9a as follows:
“2. Before the import of animal feeds and aquatic feeds of animal origin, the goods owner shall submit a dossier of registration for quarantine to the Department of Animal Health in accordance with Clause 1, Article 45 of the Law on Animal Health (a written request made according to Form 19 or Form 20 of Appendix V to this Circular). The Department of Animal Health shall, in accordance with Clause 2, Article 46 of the Law on Animal Health, send the document on guiding the quarantine to the goods owner and the animal quarantine agency at border gate via the Vietnam National Single Window portal (if the dossier is submitted through the Vietnam National Single Window portal) or via email (if the dossier is submitted directly or by postal service, public postal service, email or fax).”
2. To amend and supplement Clause 3, Clause 4 of Article 9a as follows:
“3. Before goods arrive at the border gate, the goods owner shall send a dossier to the animal quarantine agency at the border gate via the Vietnam National Single Window portal or by post, public portal, or send it via email, fax, then send the original dossier, or send directly. The dossier is prescribed in Clause 2, Article 45 of the Law on Animal Health (Form 20a of Appendix V to this Circular) and Point b, Clause 3, Article 18 of the Decree No. 13/2020/ND-CP; Clause 2, Article 29 of the Decree No. 26/2019/ND-CP.
4. The animal quarantine agency at the border gate shall comply with Clause 3, Article 9 of this Circular and Clause 2, Clause 4, Article 18 of the Decree No. 13/2020/ND-CP, Article 29 of the Decree No. 26/2019/ND-CP.”
3. To add Point c after Point b, Clause 3, Article 19 as follows:
“c) In case the Department of Animal Health and the competent agency of the exporting country have an agreement on electronic animal and animal product quarantine certificates, using electronic quarantine certificates.”
Article 2. To amend and supplement some Appendices, Forms of the Circular No. 25/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of Agriculture and Rural Development, providing the quarantine of terrestrial animals and animal products (amended and supplemented in the Circular No. 35/2018/TT-BNNPTNT dated December 25, 2018 of the Minister of Agriculture and Rural Development)
1. To replace Form 20a – certificate of registration for quarantine and certification of the quality of imported animal feeds and aquatic feeds of animal origin in Appendix V with Form 20a in the Appendix to this Circular.
2. To add No. 5 after the No. 4 of Table 1 in Appendix XI as follows:

*Notes:
- Based on the epidemic situation of the exporting country, the Department of Animal Health shall guide criteria of diseases that must be tested for quarantine.
- In case of detection of new diseases that are not prescribed in Table 1, Section I of this Appendix, the Department of Animal Health shall report to the Ministry of Agriculture and Rural Development for consideration and decision on criteria of the quarantine of such diseases.
- The samples shall be randomly taken according to the lots. The number of samples according to the estimated prevalence of disease 5% (in accordance with Table 2 of this Appendix).
- Based on clinical symptoms, the animal quarantine agency at the border gate shall take samples for testing to check the pathogens prescribed in Appendix III.”
4. To amend and supplement Point c Clause 1 Section II of Appendix XII as follows:
“c) Pathogens:

Taking samples by frequency shall be applied to the total number of the imported lots from January 1 to December 31 in the same 01 (one) year; taking samples and testing of pathogens shall comply with Vietnam's regulations, standards, technical regulations and international regulations.
Based on the actual situation of goods and animal diseases of the exporting country to test pathogens according to Appendix III to this Circular.”
5. To amend and supplement Point a, Point b Clause 2 Section II of Appendix XII as follows:
“a) Pathogens:
a1) Terrestrial animal products used as animal feeds and aquatic feeds:

b) Frequency of taking samples
b1) Complete compound feed, concentrate feed, supplementary feed, finished aquaculture feed: For every 5 lots, samples of a lot shall be taken to inspect pathogens according to Point a of this Clause.
b2) Raw materials derived from animals used to product animal feeds and aquatic feeds: taking samples of each lot to inspect pathogens according to Point a of this Clause.
b3) For feeds, raw materials specified at Points b1 and b2 of this Clause that contain many components from products of different types of animals: taking samples to test no more than 02 criteria of the respective pathogens according to Point a of this Clause.
b4) Taking samples and testing of pathogens shall comply with Vietnam's regulations, standards, technical regulations and international regulations.”
6. To add Section V after Section IV of Appendix XII as follows:
"V. TAKING SAMPLES FOR QUANRANTINE
1. For imported animals specified in Table 1 Section I of Appendix XII to this Circular: 05 samples are combined into a pooled sample for testing pathogens.
2. For imported animal products specified in Section II of Appendix XII to this Circular:
a) A lot with 01 to 02 items: taking samples of all items; in each item, 05 samples are combined into a pooled sample for testing pathogens.
b) A lot with 03 or more items: taking samples of 03 items with the largest quantity/mass; in each item, 05 samples are combined into a pooled sample for testing pathogens.
3. Principles of pooling samples: samples are pooled only if samples are same species, same type of animals, same lots, same countries and territories.
4. If it is not possible to pool samples for testing according to the pooled samples, pathogens are tested on single samples.
5. When a lot of imported animal products does not meet the sensory requirements, taking samples to inspect the physico-chemical properties, harmful microorganisms pathogens in accordance with Vietnam’s relevant regulations and standards, international regulations.”
7. To repeal Point d Clause 1, Point d Clause 2 Section II of Appendix XII to this Circular.
8. To repeal Section III of Appendix XII to this Circular.
Article 3. Effect
1. This Circular takes effect from October 06, 2022.
2. For dossiers of registration and declaration of quarantine of terrestrial animals and terrestrial animal products; quarantine and inspection of quality of imported animal feeds and aquatic feeds of animal origin before customs clearance for lots subject to both quarantine of animal products and state inspection of quality that are submitted before the effective date of this Circular, comply with law regulations effective at the time of submission of dossiers.
3. To repeal Article 12 of the Circular No. 25/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of Agriculture and Rural Development.
4. To repeal Article 12 of the Circular No. 35/2018/TT-BNNPTNT dated December 25, 2018 of the Minister of Agriculture and Rural Development, amending and supplementing a number of articles of the Circular No. 25/2016/TT-BNNPTNT dated June 30, 2016 and the Circular No. 20/2017/TT-BNNPTNT dated November 10, 2017 of the Minister of Agriculture and Rural Development.
5. The Director of the Department of Animal Health and heads of relevant units, organizations and individuals shall implement this Circular.
Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Agriculture and Rural Development (via the Department of Animal Health) for consideration and decision./.
