SUMMARY

To suspend export of lime and dolomite calcined or sintered manually after 2020

 

From July 25, 2017, all the provisions in the export of lime or calcined or sintered dolomite shall be applicable to the Circular No. 09/2017/TT-BXD of the Ministry of Construction on Jun 05, 2017.

This Circular points out clearly that volume of lime and calcined or sintered dolomite for export produced by manual producers must decrease gradually according to elimination road map mentioned in the planning promulgated by the People’s Committees of provinces and central-affiliated cities, provided that export of lime and dolomite calcined or sintered manually will suspend after 2020. The exporter must submit a copy of mining license for the purpose of production of lime and calcined or sintered dolomite as prescribed to customs authority.

Lime or dolomite calcined or sintered industrially for export must be produced from an industrial producer referred to in a planning for lime industrial development by 2020, with an orientation to 2030 which has been approved by the competent authority; the volume of lime and calcined or sintered dolomite for export produced by each producer may not exceed the capacity referred to in an investment license issued by a competent authority and in the planning; the exporter must submit a copy of mining license for the purpose of production of lime and calcined or sintered dolomite as prescribed to the customs authority.

THE MINISTRY OF CONSTRUCTION

Circular No. 09/2017/TT-BXD dated June 5, 2017 of the Ministry of Construction guiding the export of lime or calcined or sintered dolomite
Pursuant to the Government's Decree No. 62/2013/ND-CP dated June 25, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Construction;
Pursuant to the Government's Decree No. 24a/2016/ND-CP on management of building materials;
At the request of Director of Department of Building Materials;
The Minister of Construction promulgates a Circular on guidelines for export of lime or calcined or sintered dolomite.
Article 1. Scope of adjustment and subject of application
1. This Circular provides guidelines for conditions for export of lime (HS codes 2522.10.00; 2522.20.000; 2522.30.00) and calcined or sintered dolomite (HS code 2518.20.00), applications, procedures applicable to exporters of lime or calcined or sintered dolomite prescribed by customs authorities.2. This Circular applies to authorities, organizations, enterprises engaging in extraction, production, and import of lime or calcined or sintered dolomite.
Article 2. Conditions for lime or dolomite calcined or sintered industrially for export
1. Lime or dolomite calcined or sintered industrially for export must be produced from an industrial producer referred to in a planning for lime industrial development by 2020, with an orientation to 2030 which has been approved by the competent authority (hereinafter referred to as planning).
2. The volume of lime and calcined or sintered dolomite for export produced by each producer may not exceed the capacity referred to in an investment license issued by a competent authority and in the planning.
3. The exporter must submit a copy of mining license for the purpose of production of lime and calcined or sintered dolomite as prescribed to the customs authority.
Article 3. Conditions for lime or dolomite calcined or sintered manually for export
1. Volume of lime and calcined or sintered dolomite for export produced by manual producers must decrease gradually according to elimination road map mentioned in the planning promulgated by the People’s Committees of provinces and central-affiliated cities, provided that export of lime and dolomite calcined or sintered manually will suspend after 2020.
2. According to balance of need of lime and calcined or sintered dolomite for domestic use and export and opinions of the People’s Committees of provinces and central-affiliated cities, the Ministry of Construction shall provide guidelines for export of lime and dolomite applicable to manual producers.
3. The exporter must submit a copy of mining license for the purpose of production of lime and calcined or sintered dolomite as prescribed to customs authority.
