CIRCULAR
ON AMENDMENTS AND SUPPLEMENTS TO A NUMBER OF POINTS OF CIRCULAR No. 05/1999/TT-BKH OF NOVEMBER 11, 1999 OF THE MINISTRY OF PLANNING AND INVESTMENT GUIDING THE MANAGEMENT OF PLANNING PROJECTS
Pursuant to the Regulation on Investment and Construction Management, promulgated together with the Government’s Decree No.52/1999/ND-CP of July 8, 1999;
Pursuant to Point 3, Clause 2, Article 1 of the Government’s Decree No. 12/2000/ND-CP of May 5, 2000 amending and supplementing a number of articles of the Regulation on Investment and Construction Management, promulgated together with the Government’s Decree No. 52/1999/ND-CP of July 8, 1999;
The Ministry of Planning and Investment hereby guides the amendment and supplement of a number of points as follows:
Pursuant to Point 3, Clause 2, Article 1 of the Government’s Decree No. 12/2000/ND-CP of May 5, 2000 amending and supplementing a number of articles of the Regulation on Investment and Construction Management, promulgated together with the Government’s Decree No. 52/1999/ND-CP of July 8, 1999;
The Ministry of Planning and Investment hereby guides the amendment and supplement of a number of points as follows:
1. To supplement Item 2.2, Point 2 (funds for formulation of planning projects) of the Planning and Investment Ministry’s Circular No.05/1999/TT-BKH of November 11, 1999 guiding the management of planning projects as follows:
"2.2 Planning projects using the State budget capital, incorporated in annual investment plans, include:
.....
- Branch development planning projects, including planning for industrial park system; planning for land use throughout the country, in economic zones and key economic zones".
- Regional construction planning projects, general urban and rural planning; detailed urban center planning."
2. To supplement Point 3 on the competence to appraise planning projects as follows:
- The Ministry of Planning and Investment shall assume the prime responsibility in organizing the appraisal of overall planning projects for socio-economic development of the whole country; overall planning projects for socio-economic development of economic zones and key economic zones; overall planning projects for socio-economic development of the provinces or centrally-run cities which occupy important positions, planning for the development of important branches and fields under the Prime Minister’s decisions.
In each planning period, the Prime Minister shall consider and approve the list of branches, fields, provinces, centrally-run cities, which occupy important positions in the national economy.
Particularly for the planning projects involving many branches and/or regions, depending on each specific case, the Ministry of Planning and Investment shall submit to the Prime Minister who shall assign the State Council for Appraisal of Investment Projects for evaluation then submit it to the Prime Minister for approval.
- The ministries and the People’s Committees of the provinces or centrally-run cities shall assume the prime responsibility in organizing the appraisal of planning projects according to division of responsibility for management of capital of the planning projects mentioned at Point 3 of the Planning and Investment Ministry’s Circular No. 05/1999/TT-BKH of November 11, 1999.
3. To amend and supplement Point 3, Item 3.1 of Circular No. 05/1999/TT-BKH of November 11, 1999 guiding the management of planning projects as follows:
"The branch-managing ministries shall organize the implementation of branch development planning projects; the General Land Administration shall perform the State management over the land use planning, and directly implement the land use planning projects throughout the country, in economic zones and key economic zones".
4. To change Point 3 of Circular No. 05/1999/TT-BKH of November 11, 1999 into Point 4; similarly Points 4,5,6,7 into Points 5,6,7,8.
This Circular takes effect after its promulgation.
