CIRCULAR

Providing the issuance of press releases on legal documents promulgated by the Government or the Prime Minister^[1]

Pursuant to the June 20, 2012 Law on Law Dissemination and Education;

Pursuant to the June 22, 2015 Law on Promulgation of Legal Documents; and the June 18, 2020 Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 96/2017/ND-CP of August 16, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Justice;

Pursuant to the Government’s Decree No. 34/2016/ND-CP of May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 154/2020/ND-CP of December 31, 2020, amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP of May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 09/2017/ND-CP of February 9, 2017, providing in detail the making of statements and provision of information by state administrative agencies to the press;

At the proposal of the Chief of the Office,

The Minister of Justice promulgates the Circular providing the issuance of press releases on legal documents promulgated by the Government or the Prime Minister.

Article 1. Scope of regulation, subjects of application

1. This Circular provides the compilation and issuance of press releases on legal documents promulgated by the Government or the Prime Minister (below referred to as press releases) specified in Clauses 2 and 3, Article12 of the Law on Law Dissemination and Education, except legal documents containing state secrets.

2. This Circular applies to the Ministry of Justice, the Government Office and agencies in charge of drafting legal documents to be promulgated by the Government or the Prime Minister.

Article 2. Principles of implementation

1. Agencies in charge of drafting legal documents to be promulgated by the Government or the Prime Minister (below referred to as drafting agencies) shall be held responsible for the accuracy and timeliness of information they provide to the Ministry of Justice for compilation or correction (when necessary) of press releases.

2. To ensure regular, continuous and close coordination among related agencies and units in compilation of press releases.

3. To promote proactiveness and activeness and enhance responsibilities of drafting agencies in coordinated compilation of press releases.

Article 3. Provision of information serving the compilation of press releases

1. By the 5^th every month, drafting agencies shall provide information on legal documents that they draft and have been promulgated by the Government or the Prime Minister in the previous month to the Ministry of Justice to serve the compilation of press releases (using the form provided in the Appendix to this Circular).

2. To-be-provided information includes the title, date of promulgation; promulgating agency; effect; necessity for and purposes of promulgation, and principal contents of each legal document.

3. The Ministry of Justice shall assume the prime responsibility for, and coordinate with the Government Office in, supervising and urging the provision of information serving the compilation of press releases.

Article 4. Compilation, issuance and publication of press releases

1. The Ministry of Justice shall, based on information on legal documents provided by drafting agencies every month, summarize and prepare contents, and then compile and issue press releases on legal documents promulgated by the Government or the Prime Minister no later than the 10^th of the following month.

2. The Ministry of Justice shall publish press releases on its Portal and the online newspaper Phap luat Viet Nam right after signing them for promulgation.

3. The Government Office shall publish press releases on the Government’s Portal and online newspaper of the Government right after receiving such press releases from the Ministry of Justice.

Article 5. Correction of press releases

1. If detecting an error in the contents of a press release already issued, the drafting agency shall itself or at the Ministry of Justice’s request promptly re-provide accurate information to the Ministry of Justice for the latter to issue a written correction. The drafting agency shall send a document on re-provision of information to the Ministry of Justice within 2 working days after receiving the latter’s request or detecting the error in the press release.

2. The Ministry of Justice shall issue a written correction within 2 working days after receiving the drafting agency’s document on re-provision of information.

3. The correction must be published on the online newspapers and portals as specified in Clauses 2 and 3, Article 4 of this Circular.

Article 6. Implementation provisions

1. This Circular takes effect on January 1, 2022.

2. This Circular replaces the Minister of Justice’s Circular No. 12/2013/TT-BTP of August 7, 2013, providing the procedures for issuing press releases on legal documents promulgated by the Government or the Prime Minister.-
