Circular 06/2022/TT-BGTVT amending Circular 36/2015/TT-BGTVT on management of domestic air transport freight and aviation service prices

CIRCULAR

Amending and supplementing a number of articles of the Minister of Transport’s Circular No. 36/2015/TT-BGTVT dated July 24, 2015, on management of domestic air transport freight and aviation service prices

Pursuant to the Vietnam Civil Aviation Law No. 66/2006/QH11 dated June 29, 2006 and the Law Amending and Supplementing a Number of Articles of the Vietnam Civil Aviation Law No. 61/2014/QH13 dated November 21, 2014;

Pursuant to the Law on Prices No. 11/2012/QH13 dated June 20, 2012;

Pursuant to the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013, detailing and guiding a number of articles of the Law on Prices and the Government’s Decree No. 149/2016/ND-CP dated November 11, 2016, on amending and supplementing a number of articles of the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013, detailing and guiding a number of articles of the Law on Prices;

Pursuant to the Government’s Decree No. 05/2021/ND-CP dated January 25, 2021, on management and operation of airports;

Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017, defining functions, rights, responsibilities and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Transport and the Director of the Civil Aviation Authority of Vietnam;

The Minister of Transport promulgates the Circular amending and supplementing a number of articles of the Minister of Transport’s Circular No. 36/2015/TT-BGTVT dated July 24, 2015, on management of domestic air transport freights and aviation service prices.

Article 1. Amending and supplementing a number of articles of the Minister of Transport’s Circular No. 36/2015/TT-BGTVT dated July 24, 2015, on management of domestic air transport freight and aviation service prices (hereinafter referred to as the Circular No. 36/2015/TT-BGTVT).

1. To add Point i Clause 3 Article 5 as follows:

“i) Franchise of aviation services include franchise of the following services: passenger terminals; cargo terminals and warehouses; ground services; avionic maintenance and repair; aviation technical services, catering services and aviation refueling services.”

2. To amend, supplement Article 8 as follows:

"Article 8. Making price declaration

1. Organizations and individuals providing services on the list as specified in Article 7 of this Circular shall take responsibility for declaring prices.

2. The Civil Aviation Authority of Vietnam shall take responsibility for receiving the service price declarations from the service-providing organizations and individuals as specified in Clause 1 of this Article.

3. Methods of making and receiving price declarations as prescribed in the Minister of Finance’s Circular No. 56/2014/TT-BTC dated April 28, 2014, on guiding the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013, detailing and guiding the implementation of a number of articles of the Law on Prices dated April 28, 2014; the Minister of Finance’s Circular No. 233/2016/TT-BTC dated November 11, 2016, amending, supplementing a number of articles of the Minister of Finance’s Circular No. 56/2014/TT-BTC dated April 28, 2014, on guiding the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013, detailing and guiding the implementation of a number of articles of the Law on Prices.”

3. Section 3 of chapter II is renamed into: “PRICE LISTING AND PUBLIC ANNOUNCEMENT”

Article 2. To replace, annul a number of Points, Clauses, Articles, Appendices of the Circular No. 36/2015/TT-BGTVT

1. To annul Article 9, Article 10 and Clause 2 Article 16.

2. To annul Appendix 2.

Article 3. Effect

1. This Circular takes effect on July 15, 2022.

2. To annul the Minister of Transport’s Circular No. 07/2017/TT-BGTVT dated March 14, 2017, amending and supplementing a number of articles of the Minister of Transport’s Circular No. 36/2015/TT-BGTVT dated July 24, 2015, on management of domestic air transport freight and aviation service prices.

3. In case any legislative documents referred to in this Circular are amended, supplemented or replaced, the new one shall prevail.

4. The Chief of the Ministry Office, the Chief Inspector, the General Directors, the Directors of the Civil Aviation Authority of Vietnam, and the heads of the relevant agencies, organizations, and individuals shall be responsible for the implementation of this Circular./.
