SUMMARY

32 occupations subject to strict requirements on occupational safety and health

The Ministry of Labor, War Invalids and Social Affairs issues the Circular No. 06/2020/TT-BLDTBXH on promulgating the List of occupations subject to strict requirements on occupational safety and health on August 20, 2020.

Specifically, the List of occupations subject to strict requirements on occupational safety and health including:

Firstly, working at the height of over 2 meters above the ground, on mobile platforms or at precarious places;

Secondly, working in confined spaces or places that with potential release poison gases such as vaults, tunnels, tanks, wells, sewers and underground works; operating and maintaining gas pipelines, industrial cleaning, environmental cleaning, cage cleaning; sewage and waste treatment, draining.

Thirdly, directly cooking and processing food at collective kitchens with 300 food portions/day or more.

Fourthly, medical examination and treatment; taking care of the disabled and patients; pathology, forensic examination, microbiological testing; jobs in the pharmaceutical sector, etc.

Besides, occupations such as: Circus performers, animal circus; professional athletes, professional fitness and sports coaches; Jobs direct related to cremation and burial; directly operating, manufacturing and processing of beer, wine, beverage, cigarettes, cooking oil, cookies and milk, etc. also subject to strict requirements on occupational safety and health.

This Circular takes effect on October 05, 2020.

CIRCULAR

On promulgating the List of occupations subject to strict requirements on occupational safety and health

Pursuant to the Law on Occupational Safety and Health No. 84/2015/QH13 dated June 25, 2015;

Pursuant to the Government’s Decree No. 14/2017/ND-CP dated February 17, 2017 on defining the functions, rights, responsibilities and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

At the proposal of the Director of the Bureau for Safe Work;

The Minister of Labor, War Invalids and Social Affairs hereby promulgates the Circular on promulgating the List of occupations subject to strict requirements on occupational safety and health.

 

Article 1. List of occupations subject to strict requirements on occupational safety and health

1. To promulgate together with this Circular the List of occupations subject to strict requirements on occupational safety and health.

2. This Circular applies to entities prescribed in Article 2 of the Law on Occupational Safety and Health, except for Vietnamese employees working abroad under contracts.

Article 2. Effect

1. This Circular takes effect on October 05, 2020.

2. The Circular No. 13/2016/TT-BLDTBXH dated March 06, 2014 of the Ministry of Labor, War Invalids and Social Affairs on promulgation of the list of occupations bound by strict requirements for occupational safety and hygiene shall be invalid from the effective date of this Circular.

3. Any difficulties arising in the course of implementation of this Circular shall be reported to the Ministry of Labor, War Invalids and Social Affairs for review and settlement./.

LIST OF OCCUPATIONS SUBJECT TO STRICT REQUIREMENTS ON OCCUPATIONAL SAFETY AND HEALTH

(Attached to the Circular No. 06/2020/TT-BLDTBXH dated August 20, 2020 of the Ministry of Labor, War Invalids and Social Affairs)

 

1. Manufacturing, assembling, operating, maintaining, repairing, dismantling of machinery and equipment, examining and verifying of occupational safety techniques, supervising of operations of machinery and equipment in the List of machinery, equipment, supplies and substances subject to strict requirements on occupational safety and health promulgated by the Ministry of Labor, War Invalids and Social affairs.

2. Directly manufacturing, using, storing and transporting of dangerous and hazardous chemicals as classified by the Globally Harmonized System of Classification and Labeling of Chemicals.

3. Testing, manufacturing, using, storing and transporting of explosives of all types and explosive accessories.

4. Operating, maintaining, repairing, dismantling, inspecting and supervising of machinery and equipment, including: Machine hammers, sludge dredging vessels or machines, pumps; mortar pump, mortar mixer, mortar and concrete grouting machines, grinding machines, concrete grinding, cutting and sanding machines; multi-purpose demolition machine; portable drilling machines; concrete mixing plant; building material grinding and screening stations; excavators, bulldozers, pushed, graders, rollers, compactors; self-dumping trucks with a load of more than 5 tons.

5. Directly assembling, operating, maintaining, repairing and cleaning of grinders, sawing, milling machines, planers, lathe, bending, sawing, cutting, shredding, punching, stamping, chiseling, beating, shaping, feeding, blending, crushing, grinding, mixing, rolling, centrifugal , drying, screening, pressing, rolling, coating, rolling, peeling, bagging machines; hydraulic jacks of all types; polishing machines, sanding machines, conveyors, water guns, pneumatic guns; industrial printers.

6. Mold making, refining, rolling, mounding, cleaning, plating and cleaning of metal surface; processing of metal; ore refining, coke refining; performing of jobs at cement-producing rotary kilns, furnaces or combustion chambers for burning of refractory materials or refining of calcium carbide; operating, repairing, examining, supervising, feeding of materials, discharging of products, wastes from incinerators, kilns, furnaces.

7. Working at the height of over 2 meters above the ground, on mobile platforms or at precarious places.

8. Works on river, at sea, on water, on rig, scuba diving or supervising diving houses; manufacturing, building, operating, repairing, maintaining, and inspecting machinery and equipment in ship’s holds and water transport.

9. Working in contact with ionizing radiation, radioactive, nuclear; operating scanners, projection and imaging machines that use nuclear radiation and electromagnetic field.

10. Working in contact with electromagnetic field at high frequency bands of 3 Khz or more.

11. Forest plan investigating, geological and topographic surveying, marine surveying, geophysical surveying; surveying, exploring, extracting and processing of minerals and petroleum; manufacturing, using, operating, maintaining and repairing of buildings and equipment for the extraction of minerals, petroleum and petroleum products at sea and on land.

12. Construction works including: Construction supervision; construction survey; construction and installation of works; repairing, rehabilitating, relocating, renovating, demolishing of buildings; warranty, construction maintenance; commissioning and testing of works.

13. Working in confined spaces or places that with potential release poison gases such as vaults, tunnels, tanks, wells, sewers and underground works; operating and maintaining gas pipelines, industrial cleaning, environmental cleaning, cage cleaning; sewage and waste treatment, draining.

14. Operating, maintaining, repairing, testing of, verifying of electrical equipment safety, power lines, power plants; operating of the accumulator stations, repairing and maintaining of accumulators.

15. Welding and cutting of metals.

16. Directly operating trains and electric locomotives; driving, repairing and warranty of cars of all types.

17. Directly manufacturing and processing building materials, terracotta, ceramics, glass and plastics.

18. Professional rescue.

19. Directly manufacturing, processing leather and feather; dyeing and processing silk.

20. Directly cutting, sawing, splitting of wood, exploiting and processing of industrial wood; regular manual handling of objects weighing 30 kg or more.

21. Directly cooking and processing food at collective kitchens with 300 food portions/day or more.

22. Medical examination and treatment; taking care of the disabled and patients; pathology, forensic examination, microbiological testing; jobs in the pharmaceutical sector.

23. Testing and manufacturing of veterinary drugs; conservation of genes, strains of microorganisms, parasites; sterilizing and disinfecting of the environment; food inspection, sterilization.

24. Animal slaughter, taking care of and raising of large animals in production and business establishments; raising and training of sniffing dogs, wild animals, snakes, crocodiles and destroying of epidemic animals.

25. Directly operating of petrol, oil and liquefied gas pumps; repairing of petrol tanks, oil tanks, petroleum delivering, receiving, wholesaling and retailing.

26. Directly processing latex and resin.

27. Directly operating, manufacturing and processing of beer, wine, beverage, cigarettes, cooking oil, cookies and milk.

28. Circus performers, animal circus; professional athletes, professional fitness and sports coaches.

29. Working with computer monitors, including: Air traffic control, operating, remote control via screens.

30. Jobs direct related to cremation and burial.

31. Specialized jobs in military area, subject to the list of heavy, hazardous and dangerous occupations and extremely heavy, hazardous and dangerous occupations.

32. Directly operating machinery with engines in agriculture, including:  Threshers, rice reapers, harrow machines, lawn mowers, plant protection spraying machines and water pumps./.
