CIRCULAR
Promulgating the Regulation on organization and operation of The State Council for Professor Title, Councils for Professor Title in Specialty and Interdisciplinarity, and Grassroots-level Councils of Professor Title
Pursuant to the Government s Decree No.69/2017/ND-CP dated May 25, 2017 promulgating the functions, tasks, authorities and organization of the Ministry of Education and Training;
Pursuant to the Government s Decree No.75/2006/ND-CP dated August 2, 2006 detailing and guiding the implementation of a number of articles in Law on Education; theGovernment’s Decree No.31/2011/ND-CP dated May 11, 2011 amending and supplementing a number of articles in Decree No.75/2006/ND-CP; theGovernment’s Decree 07/2013 / ND-CP dated January 9, 2013 amending Point b, Clause 13, Article 1 of Decree No.31/2011/ND-CP;
Pursuant to the Prime Minister s Decision No. 37/2018/QD-TTg dated August 31, 2018 on standards and procedures for consideration of recognition of accreditation and appointment to professor or associate professor title; procedures for cancellation of recognition and removal of professor or associate professor title;
At the proposal of the Director of the Teachers and Educational Managers Department;
The Minister of Education and Training issues a Circular promulgating the Regulation on organization and operation of the State Council for Professor Title, Councils for Professor Title in Specialty and Interdisciplinarity, and Grassroots-level Councils of Professor Title.
Article 1.The Regulation on organization and operation of the State Council for Professor Title, Councils for Professor Title in Specialty and Interdisciplinarity, and Grassroots-level Councils of Professor Title is promulgated with this Circular.
Article 2. This Circular takes effect from May 13, 2019.
This Circular replaces Circular No.25/2013/TT-BGDDT dated July 15, 2013 of the Minister of Education and Training promulgating the Regulation on organization and operation of the State Council for Professor Title, Councils for Professor Title in Specialty and Interdisciplinarity, and Grassroots-level Councils of Professor Title and Circular No.05/2014/TT-BGDDT dated February 28, 2014 amending and supplementing a number of articles of the Regulation on organization and operation of The State Council for Professor Title, Councils for Professor Title in Specialty and Interdisciplinarity, and Grassroots-level Councils of Professor Title promulgated with Circular No.25/2013/TT-BGDDT dated July 15, 2013 of the Minister of Education and Training.
Article 3. Chief of the Ministerial Office, Director of Teachers and Educational Managers Department, Heads of relevant units under Ministry of Education and Training; Chairpersons of the State Council for Professor Title; Heads of the tertiary education institutions; related parties and individuals shall take responsibilities for implementing this Circular./.

On organization and operation of The State Council for Professor Title, Councils for Professor Title in Specialty and Interdisciplinarity, and Grassroots-level Councils of Professor Title

Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation and subjects of application
1. This Regulation prescribes the organization and operation of the State Council for Professor Title, Councils for Professor Title in Specialty and Interdisciplinarity (hereinafter referred to as Councils for Professor Title in Specialty) and Grassroots-level Councils for Professor Title.
2. This Regulation applies to the Council of State Professors, Councils for Professor Title in Specialty and Grassroots-level Councils for Professor Title (hereinafter referred to as Councils for Professor Title), universities, academies, colleges, research institutes which are allowed to undertake doctoral training (hereinafter referred to as tertiary education institutions) and related organizations and individuals.
Article 2. Operational principles of the Councils for Professor Title
1. Comply with the provisions of Article 18 of the Prime Minister s Decision No. 37/2018/QD-TTg dated August 31, 2018 onstandards and procedures forconsideration of recognition of accreditation and appointment to professor or associate professor title; procedures for cancellation of recognition and removal of professor or associate professor title (hereinafter referred to as Decision No. 37/2018/QD-TTg).
2. Openly and democratically discuss on decision of issues related to the activities of the Councils for Professor Title.
Article 3. Membership standards of Councils for Professor Title
1. Members of Councils of Professor Title are official and visiting lecturers at tertiary education institutions or practice centers of tertiary education institutions in the health sector of Vietnam, who meeting the standards prescribed in Article 17 of Decision No.37/2018/QD-TTg.
2. For the members of the Councils for Professor Title who no longer meet the standards prescribed in this Article or receive disciplinary warnings or more severe disciplinary actions, the competent authorities that set up Councils of Professor Title shall cancel their membership and appoint the substitutes.
Article 4. Inspection
1. Heads of the tertiary education institutions shall inspect and supervise the consideration of recognition of accreditation to professor or associate professor title of Grassroots-level Councils for Professor Title at the tertiary education institutions where the Council are established.
2. Inspectors of the Ministry of Education and Training assume the prime responsibilities and coordinate with relevant units under the Ministry of Education and Training to inspect and supervise the consideration of recognition of accreditation to professor or associate professor title of Grassroots-level Councils for Professor Title; to settle complaints and denunciations according to law provisions.
Article 5. Handling of violations
Organizations and individuals who make wrongdoings or violations in the process of consideration of recognition of accreditation and appointment to professor or associate professor title; cancellation of recognition and removal of professor or associate professor title shall be handled according to law provisions.
Chapter II
ORGANIZATION AND OPERATION OF THE STATE COUNCIL
FOR PROFESSOR TITLE
Article 6. Tasks and powers of the State Council for Professor Title
1. Perform the duties prescribed in Article 14 of Decision No.37/2018/QD-TTg.
2. Adopt annual plans of consideration of recognition of accreditation and appointment to professor or associate professor title proposed by the Office of the State Council for Professor Title.
3. Annually, supplement and update the necessary contents for the forms in the Appendices issued together with Decision No.37/2018/QD-TTgin consistency with the reality.
4. Advise the Chairpersons of the Councils in identifying specific branches and specialties; identifying lists of scoring scientific journals, international publishers and prestigious scientific journals and publishers for sectors; directing the quality assessment and development of domestic scientific journals.
5. Participate in developing mechanisms and policies as well as propose solutions to develop the contingent of professors and associate professors and improve the quality of doctoral training.
Article 7. Organizational structure and order of membership appointment of the State Council for Professor Title
1. The organizational structure of the Council of State Professors consists of the Standing Committee and other members. The Council s Standing Committee includes the Chairperson, the Deputy Chairperson cum Secretary General and other Deputy Chairpersons appointed by the Prime Minister.
2. The number of members of the State Council for Professor Title shall be in accordance with the number of Councils for Professor Title in Specialty and they shall be appointed by the Minister of Education and Training - Chairperson of the State Council for Professor Title.
3. Order of membership appointment of the State Council for Professor Title:
a) Councils for Professor Title in Specialty in the previous term shall introduce member candidates for the State Council for Professor Title (Form No.01 in the Appendices attached to this Regulation) and summarize their scientific backgrounds (Form No.03 in the Appendices attached to this Regulation). The maximum number of candidates is equal to the number of members of Councils for Professor Title in Specialty of the previous term;
b) Tertiary education institutions shall introduce member candidates for the State Council for Professor Title (Form No.02 in the Appendices attached to this Regulation) and summarize their scientific backgrounds (Form No.03 in the Appendices attached to this Regulation). Each specialty shall introduce up to 03 (three) candidates;
c) Teachers, scientists who are teaching and researching at tertiary education institutions shall introduce member candidates via the website of the State Council for Professor Title. Chairperson of the State Council for Professor Title shall instruct the development of online introduction plans meeting the specific annual requirements and conditions;
d) The Office of the State Council for Professor Title shall make a list of candidates introduced by organizations and individuals mentioned at Points a, b and c of this Clause and submit it to the Standing Committee of the State Council for approval of the list of members of the State Council for Professor Title;
e) Based on the approval of the Standing Committee, the Office of the State Council for Professor Title shall coordinate with the Organization and Personnel Department to submit the list to the Minister of Education and Training – Chairpersons of the Council for appointment of approved members;
e) The approved list of members of the State Council for Professor Title and the summary of their scientific backgrounds shall be publicized on the website of the State Council.
4. The change of members of the State Council for Professor Title shall be adjusted and supplemented according to the provisions of Clause 3, Article 13 of Decision No.37/2018/QD-TTg.
Article 8. Tasks and powers of the Standing Committee of the State Council for Professor Title
1. The Standing Committee of the State Council for Professor Title shall perform the tasks prescribed in Clause 1, Article 15 of Decision No.37/2018/QD-TTg.
2. They shall take the responsibility to adopt the work plans of the Council before submitting them to the Chairperson of the Council for approval.
3. They shall evaluate and decide to remove membership of members who fail to fulfill their assigned tasks or commit violations in performing their tasks; comment, select and decide on the change of members of the State Council for Professor Title according to regulations; approve the list of qualified member candidates for the State Council for Professor Title and members of Councils for Professor Title in Specialty.
4. They shall organize, instruct and guide the operation of the Councils for Professor Title.
Article 9. Tasks and powers of the Chairperson of the State Council for Professor Title
1. Perform the tasksasprescribed in Clause 2, Article 15 of Decision No.37/2018/QD-TTg.
2. Direct the implementation of work plans of the State Council for Professor Title and Councils for Professor Title in Specialty.
3. Instruct the inspection and supervision of the operation of Councils for Professor Title in Specialty and Grassroots-level Councils for Professor Title.
4. Sign decisions and accreditation papers of professor and associate professor title on behalf of the Council under the Resolutions of the State Council for Professor Title.
5. Participate in activities of the State Council for Professor Title as a member of the Council.
6. Receive remuneration in accordance with law provisions.
Article 10. Tasks and powers of the Deputy Chairperson cum Secretary General of the State Council for Professor Title
1. Perform the duties of the Standing Committee according to the provisions of Article 8 of this Circular.
2., Settle regular affairs and other related problems on behalf of the Standing Committee of the Council under the authorization of the Chairperson of the Council.
3. Organize and instruct the establishment of Councils for Professor Title in Specialty and Grassroots-level Councils for Professor Title; organize and instruct the inspection and supervision of theconsideration of recognition of accreditation to professor or associate professor titleof Councils for Professor Title in Specialty and Councils for Professor Title in Specialty.
4. Organize and conduct the quality assessment of scientific journals and publishers in the scoring list of the State Council for Professor Title for consideration of recognition of accreditation to professor or associate professor title.
5. Direct the development and implementation of plans on the application of information technology to modernize the administrative activities of the Office of the State Council for Professor Title and the Councils for Professor Title in Specialty; direct the development and implementation of plans on online introduction of member candidates for the State Council for Professor Title and the Councils for Professor Title in Specialty.
6. Develop work plans and operational budget estimates of the State Council for Professor Title, the Councils for Professor Title in Specialty and the Office of the State Council for Professor Title.
7. Directly manage and monitor the operation of the Office of the State Council for Professor Title; organize the implementation of references and policies for civil servants and employees working at the Office in accordance with law provisions.
8. Participate in activities of the State Council for Professor Title as a member of the Council.
9. Receive salaries and responsibility allowances as the Deputy Chairperson cum Secretary General of the State Council for Professor Title according to law provisions.
Article 11. Tasks and powers of the Deputy Chairpersons of the State Council for Professor Title
1. Perform the duties of the State Council for Professor Title as assigned by the Chairperson of the State Council for Professor Title.
2. Settle affairs of the Council on behalf of the Chairperson of the Council under the authorization of the Chairperson of the State Council for Professor Title.
3. Taketheaccountabilityiesfor their assigned tasks to the Chairperson of the State Council for Professor Title and the legislation.
4. Participate in activities of the State Council for Professor Title as members of the Council.
5. Receive remuneration in accordance with law provisions.
Article 12. Tasks and powers of members of the State Council for Professor Title
1. Perform the duties of the State Council for Professor Title as assigned by the Chairperson of the State Council for Professor Title.
2. Participate in activities of the State Council for Professor Title as members of the Council.
3. Receive assigned tasks from the Chairperson of the State Council for Professor Titleand be appointed as Chairpersons of Councils for Professor Title in Specialty concurrently.
4. Organize the development of operational orientations and identify professional tasks related to theCouncils for Professor Title in Specialty which they are appointed to be Chairpersonsin compliance with Decision No.37/2018/QD-TTg and this Regulation and submit them to the Standing Committee of the State Council for Professor Title for approval and implementation.
5. Taketheresponsibility for the operation of the Councils for Professor Title in Specialty which they are appointed to be Chairpersons according to regulations.
6. Receive remuneration in accordance with law provisions.
Chapter III
ORGANIZATION AND OPERATION OF COUNCILS FOR PROFESSOR TITLE IN SPECIALTY
Article 13. Tasks and powers of Councils for Professor Title in Specialty
1. Perform tasks and powers prescribed in Article 16 of Decision No.37/2018/QD-TTg.
2. Receive dossiers of candidates in the specialties under management transferred by the State Council for Professor Title.
3. Examine dossiers of candidates according to the provisions of Clause 1, Article 19 and Article 22 of Decision No.37/2018/QD-TTg.
4. Consider recognition of accreditation to professor or associate professor title for the candidates according to the provisions of Article 19 of Decision No.37/2018/QD-TTg.
5. Implement work plans of Councils for Professor Title in Specialty approved by the Standing Committee of the State Council for Professor Title.
6. Receive and settle complaints and denunciations related to Councils for Professor Title in Specialty and report them to the Standing Committee of the State Council for Professor Title.
7. Consider the cancellation of recognition or cancellation of accreditation to professor and associate professor title for subjects prescribed in Article 29 of Decision No.37/2018/QD-TTgwithin their scope of management.
8. Advise and assist the Minister of Education and Training to assess the doctoral theses on suitable specialties of Councils for Professor Title in Specialty at request.
Article 14. Organizational structure and order for establishment and membership appointment of Councils for Professor Title in Specialty
1. Councils for Professor Title in Specialty shall have 07 (seven) to 15 (fifteen) members, each of whichincludes one Chairperson, one Deputy Chairperson, one Secretary and members appointed by the Chairperson of the State Council for Professor Title based on annual task requirements.
2. Chairpersons of Councils for Professor Title in Specialty are members of the State Council for Professor Title.
3. The number of members from the same tertiary education institution participating in a Councils for Professor Title in Specialty shall not exceed 3 (three).
4. Applicants for professor title shall not participate in the Councils for Professor Title in Specialty in the same year.
5. Order for membership appointment of Councils for Professor Title in Specialty:
a) The order of introducing member candidates for Councils for Professor Title in Specialty shall comply with the provisions at Points a, b and c, Clause 3, Article 7 of this Regulation, which may be conducted independently or integrated into the candidate introduction for the State Council for Professor Title.
b) The Office of the State Council for Professor Title shall make a list of member candidates introduced from the sources mentioned at Point a, Clause 5 of this Article and submit it to the Standing Committee of the State Council for Professor Title for approval of members, Deputy Chairpersons and Secretaries of the Councils;
c) The Office of the State Council for Professor Title, on the approval of the Standing Committee of the State Council for Professor Title, shall submit the list to the Chairperson of the State Council for Professor Title for consideration and decision of establishment of Councils for Professor Title in Specialty and appointment of Vice Chairpersons, Secretaries and members of the Council.
6. In case of necessity, the Chairperson of the State Council of Professor Title shall appoint a number of specific members for Councils for Professor Title in Specialty to meet their task requirements.
7. The approved list of members of Councils for Professor Title in Specialty and the summaries of their scientific backgrounds shall be publicized and regularly updated on the State Council for Professor Title s website.
8. Funding for the operation of Councils for Professor Title in Specialty shall be covered by the State Council for Professor Title.
Article 15. Tasks and powers of Chairpersons of Councils for Professor Title in Specialty
1. Chairpersons of the Councils for Professor Title in Specialty shall participate in the State Council for Professor Title and perform his/her tasks as a member of the State Council as prescribed in Article 12 of this Regulation.
2. They shall chair the sessions of Councils for Professor Title in Specialty.
3. They shall chair the consideration of recognition of accreditation to member candidates and settle affairs of Councils for Professor Title in Specialty according to regulations.
4. Taketheaccountabilities for the activities of Councils for Professor Title in Specialty to the Chairperson of the State Council for Professor Title and the legislation.
5. Participate in activities of Councils for Professor Title in Specialty as Council members.
6. Receive remuneration in accordance with law provisions.
Article 16. Tasks and powers of Deputy Chairpersons of the Councils for Professor Title in Specialty
1. Perform the assigned tasks by the Chairpersons of Councils for Professor Title in Specialty.
2. Handle affairs on behalf of Chairpersons of Councils for Professor Title in Specialty under the authorization of the Chairpersons.
3. Participate in activities of Councils for Professor Title in Specialty as Council members.
4. Receive remuneration in accordance with law provisions.
Article 17. Tasks and powers of the Secretaries of the Councils for Professor Title in Specialty
1. Settle affairs of Councils for Professor Title in Specialty as assigned by the Chairpersons of the Councils; Develop dossiers and report to the State Council for Professor Title on membership appointment and establishment decision of Councils for Professor Title in Specialty.
2. Participate in activities of Councils for Professor Title in Specialty as Council members.
3. Receive remuneration in accordance with law provisions.
Article 18. Tasks and powers of members of the Councils for Professor Title in Specialty
1. Participate in activities of Councils for Professor Title in Specialty as Council members.
2. Receive remuneration in accordance with law provisions.
Chapter IV
ORGANIZATION AND OPERATION OF COUNCILS FOR PROFESSOR TITLE
Article 19. Tasks and powers of the Grassroots-level Councils for Professor Title
1. Perform tasks and powers as prescribed in Article 12 of Decision No.37/2018/QD-TTg.
2. Coordinate with tertiary education institutions to develop solutions for publicizing activities of the Grassroots-level Councils for Professor Title and the dossiers of member candidates on the website of tertiary education institutions.
3. Coordinate with heads of tertiary education institutions to complete the dossiers and report the consideration results of recognition of accreditation and appointment to professor or associate professor title to the State Council for Professor Title for approval.
4. Coordinate with competent state agencies to settle complaints and denunciations about consideration of recognition of accreditation, appointment, cancellation of recognition and removal of professor or associate professor title according to law provisions.
Article 20. Organizational structure and order for establishment and membership appointment ofGrassroots-level Councils for Professor Title
1. Organizational structure and order for establishment of Grassroots-level Councils for Professor Title shall comply with the provisions of Clause 1, Article 12 of Decision No.37/2018/QD-TTg.
2. Chairpersons of Grassroots-level Councils for Professor Title, which have candidates for consideration of recognition of accreditation to professor title, shall have professor title.
3. Grassroots-level Councils for Professor Title shall use the seal of a tertiary education institutions where they are established.
4. Candidates for consideration of recognition of accreditation to professor title shall not participate in Grassroots-level Councils for Professor Title in the same year.
Article 21. Establishment standards of Grassroots-level Councils for Professor Title
1. Tertiary education institution with candidates who are official lecturers applying for consideration of recognition of accreditation to professor or associate professor title and needs of establishment of Grassroots-level Councils for Professor Title.
2. Tertiary education institutions which have completed at least 03 (three) master s or doctoral level training courses.
3. Tertiary education institutions which did not violate the regulations on training and scientific research activitiesin the previous year of establishment of the Grassroots-level Councils.
4. Tertiary education institutions which have at least 09 (nine) official lecturers with professor or associate professor title. To have enough members as prescribed, Heads of the tertiary education institutions shall invite domestic and foreign professors and associate professors who are teaching at tertiary education institutions to join theGrassroots-level Councils. The number of invited members shall not exceed 1/3 (one third) of the total number of Council members.
Article 22. Tasks and powers of Chairpersons of Grassroots-level Councils for Professor Title
1. Chair the sessions and settle the affairs of Grassroots-level Councils for Professor Title as prescribed in Article 12 of Decision No.37/2018/QD-TTg.
2. Taketheaccountabilities for the consideration of recognition of accreditation to professor or associate professor title to the legislation, the Chairperson of theState Council for Professor Titleand Heads of the tertiary education institutions where Councils for Professor Title in Specialty are established.
3. Participate in activities of Councils for Professor Title in Specialty as Council members.
4. Explain and report to the State Council for Professor Title and Councils for Professor Title in Specialty on the activities of Councils for Professor Title in Specialty in case of necessity.
5. Receive remuneration in accordance with law provisions.
Article 23. Tasks and powers of Deputy Chairpersonsof Grassroots-level Councils for Professor Title
1. Perform the duties of Councils for Professor Title in Specialty as assigned by the Chairpersons of the Councils.
2. Settle the affairs on behalf of the Chairpersons of Grassroots-level Councils for Professor Title under the authorization of the Chairpersons of the Councils.
3. Participate in the activities of Councils for Professor Title in Specialty as Council members.
4. Receive remuneration in accordance with law provisions.
Article 24. Tasks and powers of Secretaries of the Council of Professor of History
1. Perform tasks and solve the work of Councils for Professor Title in Specialty as assigned by Chairpersons of Grassroots-level Councils for Professor Title.
2. Take the responsibility for the assistant team (if necessary), which shall be established by Heads of tertiary education institutions at the request of the Chairpersons of the Councils.
3. Organize the reception of dossiers of candidates, classify by specialty and submit to the Chairpersons of the Grassroots-level Councils for Professor Title.
4. Participate in the activities of Grassroots-level Councils for Professor Title as Council members.
5. Receive remuneration in accordance with law provisions.
Article 25. Tasks and powers of members of the Grassroots-level Councils for Professor Title
1. Perform tasks assigned by the Chairpersons of the Grassroots-level Councils for Professor Title.
2. Participate in the activities of Grassroots-level Councils for Professor Title as Council members.
3. Receive remuneration in accordance with law provisions./.
