SUMMARY

To announce the List of purchased and exchanged goods of the border residents

The List of goods purchased, sold and exchanged by border residents is issued by the Minister of Industry and Trade under the Circular No. 02/2018/TT-BCT dated February 27, 2018.

This List comprises some types of goods such as: Fish; Natural honey; Maize; Rice; Soya beans; Sesamum seeds; Table salt; Coal; Toilet or tissue stock; Shoes, sandals; Bicycles designed to be ridden by children...

Goods that are not in the above List shall not be imported in the forms of purchase, sale and exchange of border residents. In cases where it is necessary to ensure food safety and prevent cross-border epidemics, the Ministry of Industry and Trade, after discussing with the concerned ministries and branches, shall decide to suspend the import of a number of goods on this List.

This Circular takes effect on the signing date.

CIRCULAR

Detailing the List of goods purchased, sold and exchanged by border residents

------------------

Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 14/2018/ND-CP dated January 23, 2018 prescribing in detail border trade activities;

At the proposal of the Director of the Agency of Foreign Trade,

The Minister of Industry and Trade hereby promulgates the Circular on detailing the List of goods purchased, sold and exchanged by border residents.

Article 1. Scope of regulation

This Circular provides detailing provisions on the List of goods purchased, sold and exchanged by border residents as prescribed in Clause 2, Article 12 of the Government’s Decree No. 14/2018/ND-CP dated January 23, 2018 prescribing in detail border trade activities.

Article 2. Subjects of application

1. Border residents purchasing, selling and exchanging goods across border specified in Clause 3, Article 3 of the Decree No. 14/2018/ND-CP.

2. Agencies and organizations managing and administering border trade activities.

3. Other agencies, organizations and individuals involved in border trade activities.

Article 3. List of goods imported in the forms of purchase, sale and exchange across border of border residents

1. To issues the List of goods imported in the forms of purchase, sale and exchange of border residents in Appendix I attached to this Circular.

2. Goods that are not in the List specified in Clause 1 of this Article shall not be imported in the forms of purchase, sale and exchange of border residents.

3. In cases where it is necessary to ensure food safety and prevent cross-border epidemics, the Ministry of Industry and Trade, after discussing with the concerned ministries and branches, shall decide to suspend the import of a number of goods on the List of goods purchased, sold and exchanged by border residents promulgated under Clause 1 of this Article in each locality with specific time.

Article 4. Organization of implementation

1. The Ministry of Public Security shall be responsible for:

Guiding and examining agencies, organizations and individuals concerned to the implementation of this Circular.

2. The People’s Committee of provinces having border shall be responsible for:

a) To direct the Department of Industry and Trade to preside, coordinate with agencies concerned to the organization and implementation of this Circular and related agencies in provinces, to formulate the coordination mechanism to manage the purchase, sale and exchange of goods of border residents in area.

b) To assign the Department of Industry and Trade to preside and coordinate with relevant agencies of the province to implement the information and reporting regime to the Agency of Foreign Trade (the Ministry of Industry and Trade) periodically before the 10th of every month and irregular reports upon request. Statistical forms attached to the periodic reports on the purchase, sale and exchange of goods of border residents shall comply with Appendix II issued with this Circular.

Article 5. Effect

1. This Circular takes effect on the signing date.

2. To repeals the Circular No. 54/2015/TT-BCT dated December 30, 2015 of the Ministry of Industry and Trade providing the List of goods purchased, sold and exchanged by border residents specified in the Decision No. 52/2015/QD-TTg dated October 20, 2015 of the Prime Minister on the management of the border trade activities with neighboring countries.

3. Any difficulties arising in the course of deployment and implementation should be promptly reported in writing to the Ministry of Industry and Trade (the Agency of Foreign Trade) for settlement./.
