CIRCULAR
Providing the List of potentially unsafe products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs[1]
Pursuant to the November 21, 2007 Law on Product and Goods Quality;
Pursuant to the Government’s Decree No. 132/2008/ND-CP of December 31, 2008, detailing a number of articles of the Law on Product and Goods Quality;
Pursuant to the Government’s Decree No. 74/2018/ND-CP of May 15, 2018, amending and supplementing a number of articles of the Government’s Decree No. 132/2008/ND-CP of December 31, 2008, detailing a number of articles of the Law on Product and Goods Quality;
Pursuant to the Government’s Decree No. 154/2018/ND-CP of November 9, 2018, amending, supplementing or annulling a number of provisions on business and investment conditions in the fields under the state management by the Ministry of Science and Technology and a number of provisions on specialized inspection;
Pursuant to the Government’s Decree No. 14/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
At the proposal of the Director of the Department of Work Safety;
The Minister of Labor, Invalids and Social Affairs promulgates the Circular providing the List of potentially unsafe products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs.
Article 1. Scope of regulation
This Circular provides the List of potentially unsafe products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs (below referred to as group-2 products and goods) enclosed with their HS codes and measures for state inspection of quality of imported group-2 products and goods.
Article 2. Subjects of application
This Circular applies to:
1. Domestic and foreign organizations and individuals operating in Vietnam’s territory that produce, import, use, or trade in, group-2 products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs.
2. Organizations and individuals related to the management, assessment and certification of quality of group-2 products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs.
Article 3. List of group-2 products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs
To provide together with this Circular the List of group-2 products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs and their HS codes.
Article 4. Measures for state inspection of quality of imported group-2 goods
1. Goods and products subject to the state inspection of quality upon their importation are specified in Section I of the List of group-2 products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs provided together with this Circular. The state inspection of quality of imported goods must comply with Clause 2b, Article 7 of the Government’s Decree No. 132/2008/ND-CP of December 31, 2008, detailing a number of articles of the Law on Product and Goods Quality, which was supplemented under Clause 3, Article 1 of the Government’s Decree No. 74/2018/ND-CP of May 15, 2018, amending and supplementing a number of articles of the Government’s Decree No. 132/2008/ND-CP.
2. Goods and products not subject to the state inspection of quality upon their importation are specified in Section II of the list of group-2 products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs provided together with this Circular.
Article 5. Effect
1. This Circular takes effect on July 18, 2021.
2. Circular No. 22/2018/TT-BLDTBXH of December 6, 2018, of the Minister of Labor, Invalids and Social Affairs, providing the List of potentially unsafe products and goods subject to the state management by Ministry of Labor, Invalids and Social Affairs, ceases to be effective on the effective date of this Circular.
3. In case a national technical regulation on occupational safety for a product or goods specified in Section II of the list of group-2 products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs provided together with this Circular requires quality inspection of such product or goods upon its importation, Clause 2, Article 4 of this Circular shall be applied.
Article 6. Implementation organization
1. In case legal documents and standards referred to in this Circular are revised or replaced, the new ones shall be complied with.
2. Any problems arising in the course of implementation should be reported to the Ministry of Labor, Invalids and Social Affairs for consideration and settlement.
