DECREE
On policies on assistance for remediation of animal epidemic consequences

Pursuant to the Law on Organization of Local Administration dated February 19, 2025;
Pursuant to the Law on Animal Health dated June 19, 2015;
Pursuant to the Law on the State Budget dated June 25, 2015;
Pursuant to the Law on Fisheries dated November 21, 2017;
Pursuant to the Law on Animal Husbandry dated November 19, 2018;
At the request of the Minister of Agriculture and Environment;
The Government promulgates the Decree on policies on assistance for remediation of animal epidemic consequences.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
1. This Decree defines the following policies:
a) Assistance for production establishments having animals and animal products subject to compulsory destruction due to animal diseases included in the list of animal diseases subject to epidemic announcement or the list of zoonotic diseases or diseases carrying infectious pathogens newly discovered on the territory of Vietnam as determined by law regulations.
b) Assistance for individuals participating in the remediation of animal epidemic consequences.
2. Measures for animal epidemic prevention and combat shall comply with law regulations on animal husbandry and animal health.
Article 2. Subject of application
This Decree applies to:
1. Production establishments specified in Clause 1, Article 3 of this Decree.
2. Individuals participating in the remediation of animal epidemic consequences defined in Clause 2 Article 3 of this Decree.
3. Agencies, units, organizations, and individuals involved in the implementation of this Decree.
Article 3. Interpretation of terms
In this Decree, the terms below are construed as follows:
1. Production establishments are individuals, households, cooperative groups, cooperatives and unions of cooperatives, and agencies or units of the people's armed forces (excluding enterprises under the armed forces) e ngaged in animal husbandry, aquaculture, or the production and aquatic breed nursery.
2. Individuals participating in the remediation of animal epidemic consequences are those directly involved in the prevention and control of one or more animal diseases specified in Clause 1, Article 1 of this Decree, as assigned or mobilized by competent agencies or units based on the nature and scale of the epidemic, to perform one or more of the following activities:
a) Statistics; confirmation of damages caused by animal epidemics;
b) Handling of animal epidemic focus; sample collection; necropsy, diagnosis, and testing for animal diseases; investigation and verification of animal epidemics; capture, detention, transportation, and destruction of animals and animal products;
c) Vaccination, sanitation, disinfection, and sterilization for the prevention and control of animal epidemics;
d) On-duty at teams, checkpoints, and stations to control animal epidemics.
Article 4. Principles of assistance
1. The State provides partial assistance for damages caused by animal epidemics, does not provide compensation for damages.
2. Assistance shall be provided in a public, transparent, and timely manner, to eligible beneficiaries, in accordance with prescribed conditions and assistance levels, in line with local practical conditions, preventing policy abuse, corruption, and waste.
3. If production establishments and individuals participating in the remediation of animal epidemic consequences simultaneously meet the conditions for different levels of assistance for the same content of support as defined in this Decree and other relevant laws, they shall receive the highest level of assistance.
Chapter II
POLICIES, ORDER, AND PROCEDURES FOR ASSISTANCE IN REMEDIATION OF ANIMAL EPIDEMIC CONSEQUENCES
Article 5. Conditions for assistance
1. Production establishments having animals and animal products subject to compulsory destruction due to animal epidemics as specified in Clause 1, Article 1 of this Decree, and falling under one of the following cases:
a) For cases where an animal epidemic has been announced: Having animals and animal products subject to compulsory destruction as defined by law regulations within the epidemic, epidemic-threatened or buffer zones;
b) For cases where conditions for animal epidemic announcement has not been met: Having animals and animal products at the initial animal epidemic focus tested positive for a disease on the list of animal diseases subject to epidemic announcement or the list of zoonotic diseases; or animals at the subsequent animal epidemic focus in the same commune-level administrative unit (in accordance with law on the organization of local administration) that are infected or show signs of infection for the disease with the positive testing results at the initial animal epidemic focus under a conclusion by a competent agency;
c) For cases of diseases newly discovered on the territory of Vietnam but not eligible for epidemic announcement: Having a written confirmation from a competent agency, in accordance with law regulations on animal health, identifying new infectious pathogens.
2. Individuals participating in the remediation of animal epidemic consequences must be assigned or mobilized in writing by a competent state agency or unit.
Article 6. Assistance levels for production establishments
1. For terrestrial animal production establishments:
a) For buffaloes, cows, horses, goats: VND 50,000/kg of liveweight;
b) For sheep, sika deer: VND 55,000/kg of liveweight;
c) For pigs: VND 40,000/kg of liveweight;
d) For chickens, ducks, muscovy ducks, geese, pigeons: VND 35,000/kg of liveweight;
dd) For quails: VND 20,000/kg of liveweight;
e) For ostriches: VND 50,000/kg of liveweight;
g) Poultry eggs (from chickens, ducks, muscovy ducks, geese, pigeons, quails, ostriches): VND 20,000/kg.
2. For aquatic animal production establishments:
a) For juvenile lobsters: VND 10,000/individual;
b) Shrimp seed (whiteleg shrimp, giant tiger prawn) from post-larvae stage 12 (PL12) and above: VND 10,000,000/one million individuals;
c) Fish seed (marine fish, pangasius, traditional fish, tilapias, cold-water fish): VND 10,000/kg;
d) Giant tiger prawn farming areas by extensive farming (rice-shrimp farming, ecological shrimp farming, mangrove-shrimp farming, integrated shrimp farming): VND 9,000,000/ha;
dd) Giant tiger prawn farming areas by semi-intensive and intensive methods: VND 12,000,000/ha;
e) Whiteleg shrimp farming areas: VND 20,000,000/ha (stocking density from 50 to 100 individuals/m²);
VND 30,000,000/ha (stocking density over 100 to 250 individuals/m²);
VND 50,000,000/ha (stocking density over 250 individuals/m²);
g) Traditional fish and native fish farming areas: VND 10,000,000/ha;
h) Pangasius farming areas by intensive method: VND 50,000,000/ha;
i) Tilapia farming areas by intensive method: VND 30,000,000/ha;
k) Cold-water fish (sturgeon, salmon) farmed by intensive method: VND 20,000/kg;
l) Freshwater aquatic species farmed in cages and pens: VND 5,000/kg;
m) Marine species farmed in cages and rafts: VND 10,000/kg.
Article 7. Assistance levels for individuals participating in the remediation of animal epidemic consequences
1. Individuals not receiving salaries from the state budget, during the period of mobilization for animal epidemic prevention and control shall be entitled to the following support: VND 400,000/person/day for working days; VND 500,000/person/day for days off, public holidays, and Tet.
2. Individuals receiving salaries from the state budget, during the period of mobilization for animal epidemic prevention and control shall be entitled to the following support: VND 150,000/person/day for working days; VND 300,000/person/day for days off, public holidays, and Tet.
Article 8. Funding sources for implementation, principles for providing the support from the central budget to local budgets
1. Funding sources for implementation
a) State budget, including central budget and local budget;
b) Contributions, sponsorships from domestic and foreign organizations and individuals, international organizations, and other lawful financial sources as prescribed by law.
2. Principles for providing the support from the central budget to local budgets
a) For localities receiving budget-balancing transfers from the central budget, the level of financial support from the central budget to implement policies as defined in Article 6 and Clause 1, Article 7 of this Decree shall be determined by the ratio of budget-balancing transfer/total expenditure for local budget balancing, specifically: support 80% of the state budget support level for localities with the ratio of 50% or more; support 60% of the state budget support level for localities with the ratio from 30% to less than 50%; support 30% of the state budget support level for localities with the ratio of less than 30%;
b) For localities not receiving budget-balancing transfers from the central budget, the local budget shall ensure funding for policy implementation;
c) The ratio of budget-balancing transfers/total expenditure for local budget balancing specified at Point a, Point b of this Clause shall be determined according to the annual estimates of state budget revenue and expenditure decided by the National Assembly;
d) After utilizing local resources, including: contributions, sponsorships, other lawful financial sources specified at Point b, Clause 1 of this Article, 50% of the local budget contingency estimates allocated by the Prime Minister at the beginning of the year, 70% of the beginning-of-year balance of the provincial-level financial reserve fund, if the portion guaranteed by the local budget as specified at Point a, Point b of this Clause is still not ensured, the central budget shall additionally supplement the difference to ensure localities’ sufficient funds for the implementation.
3. Other provisions
a) If the total assistance funding for damages and individuals participating in the remediation of animal epidemic consequences specified in Clause 1, Article 7 of this Decree is less than VND 1 billion/year: Provinces and centrally-run cities shall proactively use their local budgets for the implementation, the central budget shall not provide support.
b) The mobilization, use, and finalization of assistance funding from the funding sources specified at Point b, Clause 1 of this Article shall comply with law regulations;
c) Agencies and units assigning and mobilizing individuals participating in the remediation of animal epidemic consequences as defined in Clause 2, Article 7 of this Decree shall use the estimates allocated by competent authorities to support their own personnel participating in the remediation of animal epidemic consequences.
d) The central budget shall ensure the assistance funding for agencies and units of the people's armed forces (excluding enterprises under the armed forces) engaged in animal husbandry, aquaculture, or aquatic breed nursery and production that suffer damages due to animal epidemics at the levels defined in this Decree.
Article 9. Order and procedures for providing assistance to production establishments suffering damages by animal epidemics
1. Order and procedures for providing assistance to production establishments suffering damages by animal epidemics, except for cases defined in Clause 2 of this Article, shall be as follows:
a) When destroying animals or animal products specified in Clause 1, Article 5 of this Decree, the commune-level People's Committee where the production takes place shall make a minutes on destruction, using the Form No. 1a for terrestrial animals and animal products, or using the Form No. 1b for aquatic animals, that are defined in the Appendix issued together with this Decree.
b) Within 30 days from the date of completion of the destruction of animals or animal products at the animal epidemic focus, the production establishment shall submit a dossier to the commune-level People's Committee in person, online, or via postal service.
c) Such a dossier includes: the application for assistance by type of production establishment, using the Form No. 2a or Form No. 2b specified in the Appendix issued together with this Decree.
If being submitted in person or via postal service, the documents in the dossier must be originals. If being submitted online, shall comply with Decree No. 45/2020/ND-CP dated April 8, 2020, of the Government on performance of administrative procedures in the electronic environment shall apply.
d) Receipt of a dossier:
In cases of direct submission of dossier: At the time of receiving the dossier, the commune-level People's Committee shall consider and examine the accuracy and completeness of the dossier; if the dossier is incomplete or inaccurate, it shall guide the production establishment to complete it according to regulations.
In cases of submission of dossier via postal service: Within 03 working days from the date of receiving the dossier, the commune-level People's Committee shall consider and examine the accuracy and completeness of the dossier; if the dossier is incomplete or inaccurate, it shall guide the production establishment to complete it according to regulations.
In cases of online submission of dossier: Within 01 working day from the date of receiving the dossier, the commune-level People's Committee shall examine and notify the receipt or request for adjustment or supplementation of the dossier.
dd) Appraisal of conditions, dossier, and public posting of appraisal results
The commune-level People's Committee shall establish an appraisal team, consisting of at least 05 members, led by a representative of the commune-level People's Committee leadership;
On a monthly basis, the appraisal team shall conduct the appraisal at least once for the dossier of request for assistance received during that month. The appraisal period shall not exceed 07 days from the date of the appraisal. The appraisal team shall conduct the appraisal according to the assistance conditions defined in Clause 1, Article 5 of this Decree;
Within 03 days from the date of completion of the appraisal, the commune-level People's Committee shall publicly post the table of proposed assistance for production establishments damaged by epidemics, using the Form No. 3a for terrestrial animals and Form No. 3b for aquatic animals, defined in the Appendix issued together with this Decree, at the headquarters of the commune-level People's Committee where the production takes place, and simultaneously disseminate the information through commune-level media. The posting period is 05 days. The commune-level People's Committee shall notify in writing production establishments that do not meet the conditions for assistance, clearly stating the reasons;
In case of petitions and reports during the posting period, within 05 days from the end of the posting period, the commune-level People's Committee shall reply in writing, clearly stating the reasons.
Within 10 days from the end of the posting period, the commune-level People's Committee shall make the dossier of assistance and issue a decision on assistance, using the Form No. 4a defined in the Appendix issued together with this Decree. A dossier of assistance includes: Written request for assistance from organizations or individuals; table of assistance for production establishments damaged by epidemics, made using the Form No. 3a for terrestrial animals and Form No. 3b for aquatic products defined in the Appendix issued together with this Decree;
The commune-level People's Committee shall organize the disbursement of assistance to eligible organizations and individuals. If the assistance funding is insufficient, the commune-level People's Committee shall send a written request to the provincial-level People's Committee for supplementation in accordance with regulations.
e) For provinces and centrally-run cities eligible for central budget support for provision of financial assistance to production establishments, based on the actual expenditure results from state budget sources of the localities (with confirmation from the State Treasury), the provincial-level People's Committees shall issue a written request to the Ministry of Finance and the Ministry of Agriculture and Environment for supplementation within their competence or submission to competent authorities for supplementation from the central budget to the local budget in accordance with regulations.
2. The Ministry of National Defence and the Ministry of Public Security shall detail the order and procedures for provision of assistance to agencies and units damaged by animal epidemics within the people's armed forces under their management.
Article 10. Order and procedures for providing assistance to individuals participating in the remediation of animal epidemic consequences
1. For individuals participating in the remediation of animal epidemic consequences who do not receive salaries from the state budget:
Based on the document on mobilization of individuals participating in the remediation of animal epidemic consequences and the time sheet, the commune-level People's Committees shall, on a monthly basis, compile the assistance funding, using the Form No. 3c, issue a support decision, made using the Form No. 4b specified in the Appendix issued together with this Decree, and organize the disbursement.
2. For individuals participating in the remediation of animal epidemic consequences who receive salaries from the state budget:
Agencies and units shall, based on assigned tasks, perform the disbursement of assistance to individuals participating in the remediation of animal epidemic consequences in accordance with Point c, Clause 3, Article 8 of this Decree and other relevant law regulations.
Chapter III
ORGANIZATION OF IMPLEMENTATION AND IMPLEMENTATION RESPONSIBILITY
Article 11. Responsibilities of central agencies
1. The Ministry of Agriculture and Environment:
a) To assume the prime responsibility for, and coordinate with the Ministry of Finance and relevant agencies in, guiding, examining, inspecting, and supervising localities in organizing the implementation of this Decree;
b) To organize the propagation and dissemination of the Decree to the subjects affected by this Decree;
c) To synthesize and report on the implementation and implementation results of this Decree.
2. The Ministry of Finance:
a) The Ministry of Finance shall, based on this Decree and the localities’ reported results of expenditure from state budget sources (confirmed by the State Treasury), provide the additionally allocated amount within its competence or submit to competent authorities for provision of the additionally allocated amount from the annual central budget contingency funding for each locality, according to the assistance principles specified in Clause 2, Article 8 of this Decree;
b) In cases where additional resources are needed for timely implementation of animal epidemic prevention and control but the dossier is not yet complete as defined, based on the request of the provincial-level People's Committees, the Ministry of Finance shall provide the additionally allocated amount within its competence or submit to competent authorities for provision of the additionally allocated amount to the local budget of 70% of the estimated central budget support level, to ensure localities’ sufficient resources for the implementation of policies for animal disease prevention and control assistance. After the localities report the results of expenditures from the state budget source (confirmed by the State Treasury), the Ministry of Finance shall provide the additionally allocated amount within its competence or submit to competent authorities for provision of the additionally allocated amount to localities the remaining assistance funding or recover any surplus funding that have been provided additionally, based on the actual support provided to beneficiaries as specified.
3. The Ministry of National Defence, Ministry of Public Security:
a) To guide the order and procedures for providing assistance to agencies and units of the people's armed forces;
b) To implement the assistance for animal disease prevention and control in accordance with law regulations.
4. The Vietnam Fatherland Front Committee at all levels shall assuming the prime responsibility for, and coordinate with political-social organizations and relevant agencies in, supervising the implementation of policies on assistance for damages caused by animal diseases specified in this Decree.
5. Relevant ministries and ministerial-level agencies shall, based on their functions and duties, implement the assistance for animal disease prevention and control in accordance with this Decree.
Article 12. Responsibilities of provincial-level People’s Committees
1. To direct, organize the implementation, inspect, supervise, and evaluate the implementation of policies defined in this Decree in the localities, and periodically report results according to regulations.
2. To direct and decentralize competent agencies in the localities to implement, synthesize needs, appraise dossiers, approve the assistance funding, and inspect and supervise the implementation of policy.
3. Based on the budget-balancing capacity, other lawful financial sources, local production characteristics and actual conditions, as well as law regulations on organization local administration and law on state budget, the provincial-level People's Committees shall submit to People's Councils of the same level for decision:
a) Assistance levels for other animals and animal products not yet specified in Article 6 of this Decree;
b) Adjusted assistance levels for animals and animal products specified in Article 6 of this Decree that are suitable for local realities, but do not exceed 1.5 times the support levels specified in this Decree;
c) Assistance for small and medium-sized enterprises at the assistance levels defined in this Decree;
d) Adjusted assistance levels for individuals participating in remediation of animal epidemic consequences in the localities, suitable to local realities, but not exceeding 02 times the assistance levels defined in Article 7 of this Decree.
4. To ensure funding for the contents specified at Point a and Point c Clause 3 of this Article and the increased funding compared to the one defined in Articles 6 and 7 of this Decree, such additional costs shall not be covered by the central budget.
5. To synthesize reports, propose support needs from the central budget, and send them to the Ministry of Finance and the Ministry of Agriculture and Environment, and be responsible for the accuracy of reported data.
6. To organize the dissemination and communication of this Decree to all levels, sectors, organizations, and individuals involved in animal husbandry and aquaculture in the provinces. To direct commune-level People’s Committees to disclose the policies and assistance levels through mass media and at villages and hamlets, ensuring that production establishments engaged in animal husbandry and aquaculture and suffering losses receive direct assistance.
7. To organize the development of animal epidemic prevention and control plans of the localities; approve and allocate funds and resources to implement the Plan, with particular attention to ensuring resources (fuel, supplies, tools, protective gear, rental of machinery, motor vehicles) for the compulsory destruction, capture, and slaughter of animals and animal products due to animal epidemics.
8. At the end of an epidemic outbreak or at the end of the year, to submit a written report on the implementation results to the Ministry of Agriculture and Environment, the Ministry of Finance, and relevant ministries and agencies for synthesis and reporting to the Prime Minister according to their functions and tasks.
9. Chairpersons of People's Committees of provinces and centrally-run cities shall be responsible before the law, the Government, and the Prime Minister for organizing the assistance, inspection, and supervision of the assistance of animal epidemic prevention and control in localities under their management.
Article 13. Responsibilities of beneficiaries from the State budget
1. Production establishments must provide full information and data as required by competent agencies and law regulations; and take responsibility before the law for the accuracy and truthfulness of the information and documents submitted for assistance.
2. Individuals participating in the remediation of animal epidemic consequences shall be responsible for complying with the requirements of the assigning and mobilizing agencies or units and the law regulations.
Article 14. Transitional provisions
1. For dossiers of request for assistance for damages caused by animal epidemics that were received by competent functional agencies but for which the disbursement has not yet been performed before the effective date of this Decree, the assistance shall comply with the Government’s Decree No. 02/2017/ND-CP dated January 9, 2017, on mechanisms and policies for agricultural production support to restore production in areas damaged by natural disasters and epidemics.
2. For dossiers of request for assistance in animal epidemic prevention and control that have been received by competent functional agencies but for which the disbursement has not yet been performed before the effective date of this Decree, the assistance shall comply with Decision No. 719/QD-TTg dated June 5, 2008, of the Prime Minister on policies for supporting the prevention and control of livestock and poultry epidemics, and Decision No. 1442/QD-TTg dated August 23, 2011, of the Prime Minister on amending and supplementing a number of articles of the Prime Minister’s Decision No. 719/QD-TTg dated June 5, 2008, on policies for supporting the prevention and control of livestock and poultry epidemics.
3. The principles for providing the support from the central budget to local budgets for damages caused by animal epidemics, as specified in the Government’s Decree No. 02/2017/ND-CP dated January 9, 2017, on mechanisms and policies for agricultural production support to restore production in areas damaged by natural disasters and epidemics shall continue to be implemented until the end of December 31, 2025.
Article 15. Implementation provisions
1. This Decree takes effect on July 25, 2025.
2. Clause 2 Article 8 of this Decree takes effect on January 01, 2026.
3. The following documents shall cease to be effective from the date this Decree takes effect:
a) Decree No. 02/2017/ND-CP dated January 9, 2017, of the Government on mechanisms and policies for agricultural production support to restore production in areas damaged by natural disasters and epidemics, excluding Article 14 of this Decree.
b) Decision No. 719/QD-TTg dated June 5, 2008, of the Prime Minister on policies for supporting the prevention and control of livestock and poultry epidemics;
c) Decision No. 1442/QD-TTg dated August 23, 2011, of the Prime Minister on amending and supplementing a number of articles of the Prime Minister’s Decision No. 719/QD-TTg dated June 5, 2008, on policies for supporting the prevention and control of livestock and poultry epidemics.
4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees of provinces, centrally-run cities and related organizations and individuals shall implement this Decree.
