Circular 06/2025/TT-BNG amend Circular 01/2011/TT-BNG grant entry permits for human corpses to Vietnam

CIRCULAR

Amending and supplementing a number of articles of the Minister of Foreign Affairs’ Circular No. 01/2011/TT-BNG dated June 20, 2011 regulating procedures for granting entry permits for human corpses, remains and ashes to Vietnam

Pursuant to the Residence Law No. 68/2020/QH14 dated November 13, 2020;

Pursuant to the Government's Decree No. 28/2025/ND-CP dated February 24, 2025 defining the functions, tasks, powers and organizational structure of the Ministry of Foreign Affairs;

Pursuant to the Government's Decree No. 70/2024/ND-CP dated June 25, 2024 detailing a number of articles of and measures to implement the Law on Identity;

At the request of the Director General of the Consular Department;

The Minister of Foreign Affairs promulgates the Circular amending and supplementing a number of articles of the Minister of Foreign Affairs’ Circular No. 01/2011/TT-BNG dated June 20, 2011 regulating procedures for granting entry permits for human corpses, remains and ashes to Vietnam.

Article 1. Amending and supplementing a number of articles of the Minister of Foreign Affairs’ Circular No. 01/2011/TT-BNG dated June 20, 2011 regulating procedures for granting entry permits for human corpses, remains and ashes to Vietnam

1. To amend and supplement Point b, Clause 1, Article 6 as follows:

"b) Papers evidencing the applicant falling into a case specified in in Article 5 of this Circular:

- 01 copy of the applicant's passport or document valid for entry and exit;

- 01 copy of papers proving the family relationship with the deceased;

- 01 original power of attorney in case the applicant falls into the category specified in Clause 2, Article 5 of this Circular;

- 01 original power of attorney in case the applicant is the managing agency or unit of the deceased specified in Clause 3, Article 5 of this Circular."

2. To amend and supplement Point c, Clause 1, Article 6 as follows:

"c) Papers proving that the deceased falls into a case specified in Article 3 of this Circular:

- The original passport or document valid for entry and exit of the deceased (if any);

- 01 copy of the deceased's permanent residence card in Vietnam in case the deceased falls under the categories specified at Point c, Clause 1, Article 3 of this Circular;

- 01 copy of the death certificate issued by a competent foreign agency or a representative mission;

- 01 copy of the certificate of hygiene and medical quarantine issued by a competent foreign agency (for human corpses); excavation certificates and certificates of hygiene and medical quarantine issued by competent foreign agencies (for human remains); certificate of cremation of corpses (for human ashes);

- In case the deceased falls under the categories specified at Point b, Clause 1, Article 3 of this Circular: (i) 01 copy of the application for permission to bring the human corpses, remains and ashes of relatives for burial and preservation in the locality, using the form No. 02/NG-LS with the certification of consent of the Vietnamese People's Committee of commune, ward or township level or cemetery management agencies; and (ii) 01 copy of one of the papers of the deceased's relatives: Citizen identity card, Confirmation of residence information, Information Form provided by the National Population Database, Identity Database, Permanent Residence Card. In case the dossier-receiving agency can extract information about the permanent residence of the relatives of the deceased in the electronic civil status database or the National Population Database, it is not required to submit copies of these papers."

Article 2. Responsibility of implementation organization

The Director General of the Consular Department, the Director of the Department of Foreign Affairs of Ho Chi Minh City, the Heads of overseas Vietnamese representative missions and relevant agencies, organizations and individuals shall be responsible for organizing the implementation of this Circular. In the course of implementation, if there are any problems, the agencies are requested to promptly report to the Ministry of Foreign Affairs for review and resolution.

Article 3. Implementation provisions

1. This Circular takes effect from July 13, 2025.

2. Applications received before the effective date of this Circular shall continue to be processed according to the provisions of relevant circulars.

3. This Circular repeals Clause 1, Article 1 of the Minister of Foreign Affairs' Circular No. 06/2023/TT-BNG dated December 26, 2023 amending and supplementing a number of articles of the Ministry of Foreign Affairs' Circular No. 01/2011/TT-BNG dated June 20, 2011 regulating procedures for granting entry permits for human corpses,  remains and ashes returned to Vietnam; the Ministry of Foreign Affairs’ Circular No. 02/2011/TT-BNG dated June 27, 2011 guiding the procedures for the registration of Vietnamese citizens abroad; the Ministry of Foreign Affairs’ Circular No. 04/2020/TT-BNG dated September 25, 2020 guiding the issuance, extension and cancellation of the use of diplomatic passports, official passports and issuance of notes requesting foreign parties to grant visas./.
