On June 16, 2023, the Government issues Decree No. 34/2023/ND-CP on amending and supplementing a number of articles of Decree No. 112/2014/ND-CP dated November 21, 2014, of the Government providing the management of land border gates.
03 types of land border gates include:
- International border gates: are opened for the entry and exit of Vietnamese and foreign people and vehicles; export and import of goods and articles;
- Main border gates (bilateral border gates): re-opened for the entry and exit of people and vehicles of Vietnam and neighboring countries; import and export of goods and articles;
- Secondary border gates (local border gates): are opened for the entry and exit of people and vehicles of Vietnam and neighboring countries in border provinces where the border gates are located; import and export of goods and articles.
Besides, the Decree also prescribes border crossings; customs clearance, specialized roads for transporting goods belonging to international border gates, and main border gates (bilateral border gates).
Vietnamese citizens, and foreigners on entry or exit through border gates must satisfy the conditions specified in the Law on Foreigners’ Entry into, Exit from, Transit through, and Residence in Vietnam.
The restriction or suspension of cross-border movement at border gates; border crossings; customs clearance, and specialized roads for transporting goods must conform to provisions of Clause 1, Point c Clause 2, Clause 4, Clause 5, Clause 6, and Clause 7 Article 11 of the Law on Vietnam Border Defense.
This Circular takes effect on July 31, 2023.
