Amending and supplementing the Government’s Decree No. 53/2018/ND-CP dated April 16, 2018, on amending the Government’s Decree No. 58/2016/ND-CP dated July 01, 2016, on the sale and provision of civil cryptography products and services and the exportation or importation of civil cryptography products

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Cyberinformation Security dated November 19, 2015;

At the request of the Minister of National Defense;

The Government hereby promulgates the Decree amending and supplementing the Government’s Decree No. 53/2018/ND-CP dated April 16, 2018, on amending the Government’s Decree No. 58/2016/ND-CP dated July 01, 2016, on the sale and provision of civil cryptography products and services and the exportation or importation of civil cryptography products.

Article 1. Amending and supplementing the Government’s Decree No. 53/2018/ND-CP dated April 16, 2018, on amending the Government’s Decree No. 58/2016/ND-CP dated July 01, 2016, on the sale and provision of civil cryptography products and services and the exportation or importation of civil cryptography products

To replace Appendix II – List of civil cryptography products exported and imported under license in the Government’s Decree No. 58/2016/ND-CP dated April 16, 2018, with the Appendix - List of civil cryptography products exported and imported under license to this Decree.

Article 2. Effect

1. This Decree takes effect on the date of its signing.

2. If the licenses to export and import civil cryptography products whose names match with those defined in Vietnam's nomenclature of exports and imports were granted to enterprises before the effective date of this Decree, they shall remain valid for customs procedures according to the expiry date on the licenses. The customs authority shall rely on Vietnam's nomenclature of exports and imports, the issued license to export and import civil cryptography products, and exports and imports in reality to assign HS codes and initiate customs clearance procedures in accordance with regulations.

Article 3. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of People’s Committees of provinces and centrally-run cities and related organizations, individuals shall implement this Decree./.
