On May 22, 2023, the Prime Minister issues the Decision No. 13/2023/QD-TTg providing the list of scrap permitted for import from overseas for use as production materials. Below are a number of remarkable contents:

1. List of scrap permitted for import from overseas for use as production materials, including:

- Scrap of iron, steel, cast iron: Waste and scrap of cast iron; Waste and scrap of alloy steel; Waste and scrap of tinned iron or steel; Other waste and scrap: Turnings, shavings, etc.

- Waste and scarp of plastics: Of polymers of styrene: Others Polystyrene (PS), Acrylonitrile Butadiene Styrene (ABS); High Impact Polystyrene (HIPS); Expanded Polystyrene (EPS);…

- Scrap paper: Unbleached kraft paper or paperboard or corrugated paper or paperboard; Other paper or paperboard made mainly of bleached chemical pulp, not colored in the mass; Paper or paperboard made mainly of mechanical pulp (for example, newsprints of newspapers, journals and similar printed matter).

- Scrap of glass: Cullet and other waste and scrap of glass, excluding glass from cathode-ray tubes or other activated glass of heading 85.49.

- Scrap of non-ferrous metal: Copper waste and scrap; Nickel waste and scrap; Aluminium waste and scrap; Zinc waste and scrap; Tin waste and scrap; Manganese waste and scrap.

2. Organizations and individuals that directly import scrap for use as production materials may only import scrap for use as production materials for their establishments according to the design capacity to produce products and goods.

This Decision takes effect on June 01, 2023.

DECISION

Promulgating the List of wastes permitted for import from overseas for use as production materials[1]

 

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the November 17, 2020 Law on Environmental Protection;

Pursuant to the Government’s Decree No. 08/2022/ND-CP of January 10, 2022, detailing a number of articles of the Law on Environmental Protection;

At the proposal of the Minister of Natural Resources and Environment;

The Prime Minister promulgates the Decision promulgating the list of wastes permitted for import from overseas for use as production materials.

 

Article 1. To promulgate together with the Decision the List of wastes permitted for import from overseas for use as production materials.

Article 2. Organizations and individuals directly importing wastes for use as production materials may only import wastes for use as production materials for their establishments according to the capacity designed for manufacture of products and goods.

Article 3. Transitional provisions

1. Wastes of paper of HS code 47079000 that are permitted for import from overseas under a component environmental license (a written certification of satisfaction of environmental protection conditions in the import of wastes for use as production materials) granted by a competent agency before the effective date of this Decision may continue to be imported until the component environmental license expires.

2. Wastes and scraps of plastics of HS code 39159000 that are permitted for import from overseas under a component environmental license or an environmental license granted by a competent agency before the effective date of this Decision may continue to be imported until the component environmental license or the environmental license expires under the corresponding HS codes specified in Section 2.3 or Section 2.5 of the List of wastes permitted for import from overseas for use as production materials promulgated together with this Decision.

3. Wastes that are permitted for import from overseas under a component environmental license or an environmental license granted by a competent agency before the effective date of this Decision and bear the names different from those specified in this Decision (but their HS codes remain unchanged) may continue to be imported until the environmental license or component environmental license expires.

Article 4. Implementation provisions

1. This Decision takes effect on June 1, 2023, and replaces the Prime Minister’s Decision No. 28/2020/QD-TTg of September 24, 2020, promulgating the List of wastes permitted for import from overseas for use as production materials.

2. From the effective date of this Decision, the import of granulated slag (slag sand) from the manufacture of iron or steel (of HS code 26180000) for use as materials for cement production must comply with the law applicable to products and goods being construction materials.

3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and related organizations and individuals shall implement this Decision.-
