DECIDES
Providing the list of scrap permitted for import from overseas for use as production materials

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Environmental Protection dated November 17, 2020;
Pursuant to the Government’s Decree No. 08/2022/ND-CP dated January 10, 2022 on detailing a number of articles of the Law on Environmental Protection;
At the request of the Minister of Natural Resources and Environment;
The Prime Minister promulgates the Decision providing the list of scrap permitted for import from overseas for use as production materials.
Article 1. To promulgate together with this Decision the list of scrap permitted for import from overseas for use as production materials.
Article 2. Organizations and individuals that directly import scrap for use as production materials may only import scrap for use as production materials for their establishments according to the design capacity to produce products and goods.
Article 3. Transitional provisions
1. Scrap paper with HS code 4707 90 00 permitted for import from overseas according to component environmental licenses (Certifications of eligibility for environmental protection in the import of scrap for use as production materials) granted by the competent agencies before the effective date of this Decision shall continue to be imported until the expiration date of the component environmental licenses.
2. Waste and scarp of plastics with HS code 3915 90 00 permitted for import from overseas according to the component environmental licenses or environmental licenses granted by the competent agencies before the effective date of this Decision shall continue to be imported until the expiration date of the component environmental licenses or environmental licenses according to the corresponding HS codes specified in Section 2.3 or Section 2.5 of the list of scrap permitted for import from overseas for use as production materials issued together with this Decision.
3. Scrap types permitted for import from overseas according to the component environmental licenses or environmental licenses granted by the competent agencies before the effective date of this Decision that have other names (but with the same HS codes) compared with the scrap types mentioned in this Decision shall continue to be imported until the expiration date of the environmental licenses or component environmental licenses.
Article 4. Implementation provisions
1. This Decision takes effect on June 01, 2023 and replaces the Prime Minister's Decision No. 28/2020/QD-TTg dated September 24, 2020 providing the list of scrap permitted for import from overseas for use as production materials.
2. From the effective date of this Decision, the import of granulated slag (slag sand) from the manufacture of iron or steel (with HS code 2618 00 00) as materials for cement production shall comply with laws on products and goods on building materials.
3. Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of People’s Committees of provinces and centrally-run cities and related organizations, individuals shall take responsibility for the implementation of this Decision.
