Approving the frame of prices for import of electricity from Laos to Vietnam from December 31, 2025

Pursuant to the Electricity Law dated November 30, 2024

Pursuant to Decree No. 40/2025/ND-CP, dated February 26, 2025, of the Government, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade

Pursuant to the Agreement on Coal and Electricity Trading signed on January 09, 2025, between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic;

Pursuant to Circular No. 09/2025/TT-BCT dated February 01, 2025, of the Minister of Industry and Trade, on the dossier, order, procedures, and methods for determining and approving the electricity generation price bracket; dossier, order, procedures for developing and approving the electricity import price bracket;

Considering the proposal of Vietnam Electricity in Document No. 1771/EVN-TTD dated March 20, 2025

At the proposal of the Director of the Electricity Authority of Vietnam.

DECIDES:

Article 1. To approve the frame of prices for import of electricity from Laos to Vietnam from December 31, 2025

The maximum purchase price (ceiling price) for electricity imported from Laos to Vietnam, applicable to power plants that commence commercial operation from December 31, 2025, is as follows:

- For the hydroelectric power plants: 6.95 US cents/kWh.

- For the coal-fired thermal power plants: 7.02 US cents/kWh.

- For the wind power plants: 6.95 US cents/kWh.

- The frame of prices for import of electricity from Laos to Vietnam applies to power plants or a part of power plants commercially operating from December 31, 2025, until the end of December 31, 2030.

- The electricity price is determined at the Vietnamese border; the parties are responsible for investing in, constructing, and operating transmission lines in each country to the border.

- The term for applying the electricity price in the power purchase agreement is 25 years.

- The levelized cost of electricity over the project lifetime at the time of negotiation as agreed upon by Vietnam Electricity with the project owners of imported electricity projects must not exceed the ceiling price (maximum price).

- For the wind power plants, Vietnam Electricity (or its authorized unit) is responsible for negotiating with the project owners of imported electricity projects and representatives of the Laos’ Ministry of Energy and Mines based on the ceiling price (maximum price) stipulated in Article 1 of this Decision.

Article 2. Implementation organization

Based on the frame of prices for import of electricity from Laos stipulated in Article 1 of this Decision, Vietnam Electricity and the Project owners of imported electricity projects from Laos shall negotiate the electricity purchase price based on the principle of harmonized benefits, shared risks, and according to market mechanisms, market prices, ensuring the principle of saving electricity purchase costs.

Article 3. Effect

1. This Decision takes effect from the date of its signing.

2. Decision No. 2647/QD-BCT dated October 08, 2024, of the Ministry of Industry and Trade, approving the frame of prices for import of electricity from Laos to Vietnam for the period from December 31, 2025, is repealed .

3. The Chief of the Ministry Office, the Director of the Electricity Authority of Vietnam, the Director General of the Legal Department, the General Director of Vietnam Electricity Group, and relevant organizations and individuals are responsible for implementing this Decision./.

The Chief of the Office, Director of the Electricity Authority of Vietnam, Director of the Legal Department, General Director of the Vietnam Electricity, and related organizations and individuals shall implement this Decision./.
