CIRCULAR
Supplementing HS code Lists of imported and exported goods prescribed in some Circulars of the Ministry of Industry and Trade
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on guidelines of the Law on Foreign Trade Management;
Implementing the Decision No. 1254/QD-TTg dated September 26, 2018 of the Prime Minister on approving plan of action for promotion of National single-window system, ASEAN single-window system, reform of specialized inspections over imports and exports and trade facilitation for the period of 2018 - 2020;
At the proposal of the Director of the Agency of Foreign Trade,
The Minister of Industry and Trade hereby issues the Circular on supplementing HS code Lists of imported and exported goods prescribed in some Circulars of the Ministry of Industry and Trade as follows:
Article 1. The Circular No. 30/2018/TT-BCT dated October 01, 2018 of the Minister of Industry and Trade, detailing a number of Articles of the Government’s Decree No. 107/2018/ND-CP of August 15, 2018, on rice export (hereinafter referred to as Circular No. 30/2018/TT-BCT)
To issue with this Circular Appendix I - List of HS code of exported rice prescribed in the Circular No. 30/2018/TT-BCT.
Article 2. The Circular No. 10/2011/TT-BCT dated March 30, 2011 of the Minister of Industry and Trade on amending, supplementing, annulling a number of provisions on administration procedures in import and export field according to the Resolution No. 59/NQ-CP dated 17/12/2010 of the Government on simplification of administration procedures under the function scope of the Ministry of Industry and Trade (hereinafter referred to as Circular No. 10/2011/TT-BCT)
To issue with this Circular Appendix II - List of HS code of temporary imported for re-exported sassafras oil prescribed in the Circular No. 10/2011/TT-BCT.
Article 3. The Joint Circular No.14/2009/TTLT-BCT-BTC dated June 23, 2009 of the Minister of Industry and Trade and the Minister of Finance, guiding the certification of and procedures for import and export of rough diamonds in implementation of the Kimberley Process Certification Scheme (hereinafter referred to as Joint Circular No.14/2009/TTLT-BCT-BTC)
To issue with this Circular Appendix III - List of HS code of rough diamonds prescribed in the Joint Circular No.14/2009/TTLT-BCT-BTC.
Article 4. The Circular No. 38/2014/TT-BCT dated October 24, 2014 of the Minister of Industry and Trade, detailing a number of Articles of the Government’s Decree No. 83/2014/ND-CP of September 03, 2014 on petrol and oil trading (hereinafter referred to as Circular No. 38/2014/TT-BCT)
To issue with this Circular Appendix IV - List of HS code of petrol and oil prescribed in the Circular No. 38/2014/TT-BCT.
Article 5. The Circular No. 12/2016/TT-BCT dated July 05, 2016 of the Minister of Industry and Trade on amending and supplementing a number of Articles of the Minister of Industry and Trade’s Circular No. 41/2012/TT-BCT dated December 21, 2012, providing the export of minerals (hereinafter referred to as Circular No. 12/2016/TT-BCT)
To supplement HS codes of exported mineral prescribed in the Appendix 1 of the Circular No. 12/2016/TT-BCT as in the Appendix V - List of HS code of exported mineral attached to this Circular. Other contents about quality standards, lime limit for exporting shall comply with the Appendix 1 of the Circular No. 12/2016/TT-BCT and other relevant regulations.
Article 6. The Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade, detailing a number of Articles of Decrees related to tobacco business (hereinafter referred to as Circular No. 57/2018/TT-BCT)
1. To issue with this Circular Appendix VI - List of HS code of tobacco raw materials and rolling papers used for making tobacco prescribed in the Circular No. 57/2018/TT-BCT.
2. To supplement HS codes of machines and equipment in the fields of tobacco prescribed in the Appendix 72 of the Circular No. 57/2018/TT-BCT as in the Appendix VII - List of HS code of machines and equipment in the fields of tobacco attached to this Circular.
Article 7. The Circular No. 15/2013/TT-BCT of July 15, 2013 of the Minister of Industry and Trade on coal export (hereinafter referred to as Circular No. 15/2013/TT-BCT)
To supplement HS codes of exported coal prescribed in the Appendix I of the Circular No. 15/2013/TT-BCT as in the Appendix VIII - List of HS code of exported coal attached to this Circular. Other contents about grain size, ash on dry basis, gross calorific value, quality standards, lime limit for exporting shall comply with the Appendix I of the Circular No. 15/2013/TT-BCT and other relevant regulations.
Article 8. Principles of application
1. In case of 4-digit headings, this Circular shall apply to all 8-digit sub-headings pertaining to such 4-digit headings.
2. In case of 6-digit headings, this Circular shall apply to all 8-digit sub-headings pertaining to such 6-digit headings.
3. In case of detailing to 8-digit headings, only 8-digit sub-headings of such headings shall be applied.
Article 9. Effect
1. This Circular takes effect on January 29, 2020.
2. Any problem arising in the course of implementation should be promptly reported to the Ministry of Industry and Trade to settlement./.
