CIRCULAR

Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 02/2018/TT-BCT dated February 27, 2018, detailing the List of goods purchased and exchanged by border residents

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Government's Decree No. 40/2025/ND-CP, dated February 26, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 14/2018/ND-CP dated January 23, 2018, prescribing in detail border trade activities;

Pursuant to the Government’s Decree No. 122/2024/ND-CP dated October 4, 2024, amending and supplementing a number of articles of Decree No. 14/2018/ND-CP;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 02/2018/TT-BCT dated February 27, 2018, detailing the List of goods purchased and exchanged by border residents.

Article 1. Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 02/2018/TT-BCT dated February 27, 2018, detailing the List of goods purchased and exchanged by border residents

1. To amend and supplement Clause 1, Article 2 as follows:

“1. Border residents purchasing and exchanging goods across border specified in Clause 1, Article 1 of the Decree No. 122/2024/ND-CP”.

2. To amend and supplement Article 3 as follows:

“Article 3. Goods purchased and exchanged across border by border residents

1. Goods exported in the forms of purchase and exchange of border residents shall comply with applicable laws.

2. Goods imported in the forms of purchase and exchange by border residents are provided in Appendix I to this Circular.

3. Goods other than those in the List specified in Clause 2 of this Article shall not be imported in the forms of purchase and exchange by border residents.

4. In cases where it is necessary to ensure food safety and prevent cross-border epidemics, the Ministry of Industry and Trade, after discussing with the concerned ministries and branches, shall decide to suspend the import of a number of goods on the List of goods purchased and exchanged by border residents promulgated under Clause 2 of this Article in each locality with specific time”.

Article 2. Replacing Appendix I - List of goods imported in the forms of purchase and exchange by border residents of Circular No. 02/2018/TT-BCT

To replace Appendix I - List of goods imported in the forms of purchase and exchange by border residents of Circular No. 02/2018/TT-BCT, with the Appendix to this Circular.

Article 3. Effect

This Circular takes effect from July 21, 2025./.

I. Principles of application

1. For cases listing 2-digit HS codes, all 8-digit HS codes of this Chapter shall be applied.

2. For cases listing 4-digit HS codes, all 8-digit HS codes of such 4-digit shall be applied.

3. For cases listing 6-digit HS codes, all 8-digit HS codes of such 6-digit shall be applied.

4. For cases listing 8-digit HS codes, only 8-digit HS codes shall be applied.
