Circular 25/2025/TT-BCT amend Article 3 of Circular 09/2025/TT-BCT methods for determining the electricity generation price bracket

Amending and supplementing Article 3 of the Circular No. 09/2025/TT-BCT dated February 01, 2025 of the Minister of Industry and Trade, on the dossier, order, procedures, and methods for determining and approving the electricity generation price bracket; dossier, order, procedures for developing and approving the electricity import price bracket

Pursuant to the Electricity Law dated November 30, 2024;

Pursuant to the Government’s Decree No. 40/2025/ND-CP dated February 26, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

At the proposal of the Director of the Electricity Authority;

The Minister of Industry and Trade promulgates the Circular amending and supplementing Article 3 of the Circular No. 09/2025/TT-BCT dated February 01, 2025 of the Minister of Industry and Trade, on the dossier, order, procedures, and methods for determining and approving the electricity generation price bracket; dossier, order, procedures for developing and approving the electricity import price bracket.

Article 1. Amending and supplementing Clauses 7 and 8 Article 3 of the Circular No. 09/2025/TT-BCT dated February 01, 2025 of the Minister of Industry and Trade, on the dossier, order, procedures, and methods for determining and approving the electricity generation price bracket; dossier, order, procedures for developing and approving the electricity import price bracket as follows:

“7. The electricity generation price bracket for wind power plants is developed based on offshore areas and regions on the basis of the results of wind resource surveys as prescribed by law regulations, specifically as follows:

a) The electricity generation price bracket for onshore and nearshore wind power is developed for 03 (three) regions: the North, Central, and South.

b) The determination of areas for developing the electricity generation price bracket for offshore wind power shall be based on:

b1) National marine space master plan;

b2) National power development master plan.

For the 2025 - 2035 period, the electricity generation price bracket for offshore wind power plants is developed for 03 (three) offshore areas: the Northern region, the South-Central Coast region, and the Southern region.

8. The determination of regions for developing the electricity generation price bracket for solar power plants, onshore wind power plants, and nearshore wind power plants shall be based on:

a) Socio-economic zoning in the National master plan;

b) National power development master plan;

c) Policies and decisions of competent authorities regarding the arrangement, merger, and consolidation of provincial-level administrative units.”

Article 2. Implementation provisions

1. This Circular takes effect on May 13, 2025.

2. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Industry and Trade for consideration and appropriate amendment./.
