Circular 08/2023/TT-BCT amend detailed Lists of HS code-based imported and exported goods

CIRCULAR

Amending and supplementing a number of articles regulating the detailed Lists of HS code-based imported and exported goods promulgated together with a number of Circulars of the Minister of Industry and Trade^[1]

Pursuant to the Government’s Decree No. 96/2022/ND-CP of November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles regulating the detailed Lists of HS code-based imported and exported good promulgated together with a number of Circulars of the Minister of Industry and Trade.

Article 1. To amend and supplement a number of articles of the Minister of Industry and Trade’s Circular No. 12/2018/TT-BCT of June 15, 2018, detailing a number of articles of the Law on Foreign Trade Management and the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management (below referred to as Circular No. 12/2018/TT-BCT)

1. To replace Appendix I - List of used consumer goods, medical devices and vehicles banned from import as provided in Article 3 of Circular No. 12/2018/TT-BCT with Appendix I to this Circular.

2. To replace Appendix II - List of goods suspended from temporary import, re-export and border-gate transfer as provided in Clause 1, Article 4 of Circular No. 12/2018/TT-BCT with Appendix II to this Circular.

Article 2. To amend and supplement a number of articles of the Minister of Industry and Trade’s Circular No. 41/2019/TT-BCT of December 16, 2019, supplementing the detailed List of HS code-based imported and exported goods as provided in a number of Circulars of the Ministry of Industry and Trade (below referred to as Circular No. 41/2019/TT-BCT)

1. To replace Appendix I - Detailed List of HS code-based exported paddy and rice commodities as provided in Article 1 of Circular No. 41/2019/TT-BCT with Appendix III to this Circular.

2. To replace Appendix VI - Detailed List of HS code-based tobacco ingredients and cigarette paper as provided in Clause 1, Article 6 of Circular No. 41/2019/TT-BCT with Appendix IV to this Circular.

3. To replace Appendix VII - Detailed List of HS code-based specialized tobacco machinery and equipment as provided in Clause 2, Article 6 of Circular No. 41/2019/TT-BCT with Appendix V to this Circular.

Article 3. Effect

1. This Circular takes effect on May 16, 2023.

2. Any problems arising in the course of implementation of this Circular should be reported in writing to the Ministry of Industry and Trade for settlement.-
