DECISION

Approving the Scheme on building and managing the national planning information system and database[1]

 

THE PRIME MINISTER

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the November 24, 2017 Planning Law;

Pursuant to the June 12, 2018 Law on Cyber Security;

Pursuant to the April 6, 2016 Law on Access to Information;

Pursuant to the November 19, 2015 Law on Cyberinformation Security;

Pursuant to the June 29, 2006 Law on Information Technology;

Pursuant to the June 14, 2018 Law on Survey and Mapping;

Pursuant to the June 22, 2023 Law on E-Transactions;

Pursuant to the Government’s Decree No. 37/2019/ND-CP of May 7, 2019, detailing a number of articles of the Planning Law; and the Government’s Decree No. 58/2023/ND-CP of August 12, 2023, amending and supplementing a number of articles of the Government’s Decree No. 37/2019/ND-CP of May 7, 2019, detailing a number of articles of the Planning Law;

Pursuant to the Government’s Decree No. 47/2024/ND-CP of May 9, 2024, providing the List of national databases; the building, updating, maintenance, exploitation and use of national databases;

Pursuant to the Government’s Decree No. 85/2016/ND-CP of July 1, 2016, on level-based assurance of security for information systems;

Pursuant to the Government’s Decree No. 73/2019/ND-CP of September 5, 2019, prescribing the management of investment in information technology application using state budget funds; and the Government’s Decree No. 82/2024/ND-CP of July 10, 2024, amending and supplementing a number of articles of the Government’s Decree No. 73/2019/ND-CP of September 5, 2019, prescribing the management of investment in information technology application using state budget funds;

Pursuant to the Government’s Decree No. 39/2022/ND-CP of June 18, 2022, promulgating the Working Regulation of the Government;

Pursuant to the Government’s Decree No. 47/2020/ND-CP of April 9, 2020, prescribing the management, connection and sharing of digital data of state agencies;

Pursuant to the Government’s Decree No. 64/2007/ND-CP of April 10, 2007, on information technology application in state agencies’ operations;

At the proposal of the Minister of Planning and Investment,

 

DECIDES:

Article 1. To approve the Scheme on building and managing the national planning information system and database (below referred to as the Scheme) with the following contents:

I. VIEWPOINTS ON FORMULATION OF THE SCHEME

1. The national planning information system and database (below referred to as the National Planning Database System) shall be built and operated in a centralized and unified manner nationwide in conformity the e-Government and Digital Government Architecture Framework and in compliance with national standards and technical regulations; and the Party’s guidelines and policies and the State’s policies and laws.

2. The National Planning Database System shall be built based on the national geography and clearly define the scope and roadmap for implementation; make full use of available information and databases to avoid overlaps and waste.

3. The National Planning Database System shall be regularly, promptly and fully updated, apply advanced and modern technological solutions to meet the requirements for publicization and transparency of planning information and state management of planning work, and guarantee the rights of agencies, organizations and individuals to access and use planning information in accordance with law for the purposes of serving socio-economic development, settlement of environmental issues, and national defense and security.

II. OBJECTIVES AND SCOPE

1. Objectives

a/ General objectives

To establish the National Planning Database System that shall be connected, inter-connected and integrated into, and share information and data with, planning information and database systems of ministries, sectors, and localities in the electronic environment so as to meet the requirements of state management of planning work, serve the direction and administration of socio-economic development by the leaderships of the Government and ministries, sectors and localities, help simplify and promote the provision of online public services for administrative procedures in the field of planning, ensuring convenience for agencies, organizations and individuals to exploit and use planning information.

b/ Specific objectives

- By 2026

+ All databases on national-level, regional and provincial planning dossiers shall be collected and built on a geographic information system (GIS-enabled) technology platform to be updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

+ All e-documents of databases on district-level land-use planning and district-level area construction planning dossiers shall be collected and created for updating into the National Planning Database System and provided and shared with organizations and individuals under regulations.

+ 30% of databases on district-level land use planning dossiers and district area construction planning dossiers shall be built on a GIS-enabled technology platform to be updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

- By 2030

+ All databases on district-level land-use planning dossiers and district area construction planning dossiers shall be collected and built on a GIS-enabled technology platform to be updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

+ To complete investment in software and applications that allow state agencies, organizations, enterprises and people to connect to the National Planning Database System, serving the provision of on-demand planning information services.

- By 2035

All databases on planning dossiers of different types (including databases on technical and specialized planning dossiers) shall be collected and built on a GIS-enabled technology platform to be updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

2. Scope

The Scheme shall be implemented nationwide and applied in the state management of planning work at ministries, sectors and localities. Data shall be collected, synthesized, processed and updated in the National Planning Database System, including databases on planning dossiers and diagrams and maps of national, regional and provincial-level master plans and master plans on special administrative-economic units (if any), master plans of urban and rural areas, district-level land-use master plans, district area construction master plans, and other technical and specialized master plans in accordance with the planning law and other relevant specialized laws.

Databases on planning dossiers related to state secrets must comply with the law on protection of state secrets.

III. TASKS

1. Improving institutions, promulgating regulations and providing guidance on technical requirements to build and deploy the National Planning Database System

a/ To propose amendments to the Planning Law and formulate relevant legal documents to create the legal framework for the operation of the National Planning Database System.

b/ To formulate a Decree prescribing the building, updating, maintenance, exploitation and use of the national planning database.

c/ To formulate and promulgate Regulations on coordination in the collection, management, connection, sharing and use of information and databases in the National Planning Database System in the digital environment.

d/ To study, formulate and promulgate circulars and guiding documents on technical structure and requirements, technological solutions and regulations on data collection, processing and standardization, the updating, management, operation, connection, provision, sharing, exploitation and use of planning dossier database of the national planning databases.

dd/ To review and simplify administrative procedures related to planning work based on the exploitation and reuse of the National Planning Database System.

2. Building information technology infrastructure to ensure the deployment of the National Planning Database System

a/ To build information technology infrastructure at the Ministry of Planning and Investment to administer, operate, exploit and share the national planning databases, ensuring security for information systems at least at level 3; to concurrently build a redundant technical infrastructure system operating in parallel to serve the deployment of the national planning databases, ensuring data backup capacity and capacity to recover from catastrophic circumstances.

b/ To invest in modern equipment and utility tools for the building, collection, updating, processing and analysis of data from the National Planning Database System.

c/ To develop software for the National Planning Database System to meet the requirements for state management of planning work, serve the direction and administration of leaderships at all levels, and meet the demands of agencies, organizations and individuals for the exploitation and sharing of planning information.

3. Building national planning databases

a/ National planning databases shall comprise a collection of planning information and data that are structured and organized to facilitate the access, provision, sharing, management, exploitation and updating through electronic means, including:

- Databases on national, regional and provincial-level planning dossiers that have been approved and are stored under Article 44 of the Planning Law.

- Databases on dossiers of technical and specialized master plans prescribed in the Planning Law, dossiers of master plans of special administrative-economic units, and urban and rural planning dossiers.

- The national geographic database that is standardized and regularly updated.

- Other information and data related to planning work.

b/ Data collection and synchronization: To collect data from ministries, sectors and localities, and agencies and organizations related to planning work. To synchronize such data into a unique national database, ensuring the consistency and integration capacity.

c/ Regular updating and maintenance: National planning databases shall be regularly updated and maintained, ensuring the latest and reliable nature of planning information.

4. Managing, operating, exploiting and sharing national planning databases

a/ To develop and adopt measures to ensure cyberinformation security and cyber security for national planning databases upon connection and sharing of data with databases of ministries, sectors and localities.

b/ To manage and operate the National Planning Database System to ensure smooth and uninterrupted operation; to perform data backup and have capacity to recover from catastrophic circumstances.

c/ To arrange personnel with sufficient capacity to perform the tasks of building, collecting, processing and synchronizing data, and updating, managing, operating, connecting, sharing and exploiting the National Planning Database System.

5. Professional training and refresher training

a/ To provide professional training, further training and refresher training on planning, data science, GIS, information technology, data collection, processing and synchronization, and updating, management, operation, connection, sharing and exploitation of National Planning Database System.

b/ To provide training, further training and refresher training to raise awareness of cyberinformation security and cyber security.

c/ To learn from foreign experiences, promote cooperation with countries and international organizations to gain experience, resources and techniques for the implementation of the Scheme.

(Details are provided in the Appendix to this Decision).

IV. IMPLEMENTATION SOLUTIONS

1. Regarding the improvement of institutions, mechanisms and policies

- To review the current system of documents, summarize and evaluate shortcomings, limitations, difficulties and obstacles to the deployment of the National Planning Database System.

- To study documents, practical situations and domestic and international experience in formulating legal documents to create the legal framework for data collection, processing and synchronization; the updating, management, operation, connection, sharing and exploitation of the National Planning Database System.

2. Regarding the application of science and technology

- To use GIS technology to build the National Planning Database System.

- To apply cutting-edge technologies and data science to build the National Planning Database System in line with technology orientations set forth by the Government with the following characteristics: centralized data governance, capacity of integrating and storing data from multiple sources and in different formats, capacity of providing data visualization tools, capacity of providing and interacting with other systems through application programming interfaces so as to ensure cyberinformation security and cyber security.

- To use the data sharing and coordination platform of the National Data Center, the National Data Integration and Sharing Platform and ministerial- and provincial-level data integration and sharing platforms to share planning information and data.

- To develop shared-use tools for ministries, sectors and localities to save investment costs and allow flexible data management and exchange.

- To prioritize investment in R&D projects and project on transfer of data exploitation technology, data mining and collection applications, shared-use applications, etc., such as the development of predictive analytics models using planning data and building centralized and unified databases.

3. Regarding the building of information technology infrastructure

- To build information technology infrastructure in line with the roadmap and plan set in the Government’s Resolution No. 175/NQ-CP of October 30, 2023, approving the National Data Center Scheme.

- To ensure information security by adhering to the guidance provided by the Ministry of Information and Communications, the security standards set by the Government Cipher Committee, and the Government’s regulations on cyberinformation security and cyber security.

4. Regarding the coordination in the management, operation, connection, provision, sharing, and exploitation and use of the National Planning Database System

- To enhance coordination between ministries/sectors/localities and the Ministry of Planning and Investment in building and managing data sources for the connection and integration of databases related to planning work into national planning databases.

- To interconnect and share data among ministries, sectors and localities under regulations through the Data Sharing and Coordination Platform of the National Data Center, the National Data Integration and Sharing Database, and national, ministerial-level and provincial-level data integration and sharing platforms using the Application Programming Interface (API) of the National Planning Database System; to grant accounts and authentication keys to enhance data security and ensure proper permissions for exploitation.

- Ministries, sectors, and localities shall, based on the objectives and contents of the Scheme and the guidance of the Ministry of Planning and Investment, supplement equipment and utility tools to meet their specific requirements.

- To evaluate and monitor the implementation of the Scheme at ministries, sectors and localities under general guidance.

5. Regarding capacity buiding and awareness improvement

a/ Capacity buiding

- To formulate contents and plans on professional training, further training and refresher training on planning, information technology, data science, and GIS technology to meet the tasks of establishing, building, managing, maintaining, operating, and exploiting the National Planning Database System.

- To develop guidance, provide technical support and training for ministries, sectors, localities, organizations and individuals participating in the Scheme.

- To disseminate and replicate lessons on the Scheme implementation experience.

b/ Awareness improvement

- To formulate communication programs in the mass media to disseminate the significance, importance and benefits of the Scheme and the responsibilities of stakeholders in the course of the implementation of the Scheme.

- To organize conferences to review and report the Scheme’s implementation results so as to increase the exchange of experiences among ministries, sectors and localities.

6. Regarding international cooperation and mobilization of the participation of enterprises and experts

a/ International cooperation

- To learn from foreign experience through participation in international conferences and workshops on the building, management, operation and exploitation of the National Planning Database System.

- To cooperate with countries and international organizations in building the National Planning Database System.

- To leverage technological and professional experience in planning databases from international experts involved in formulating regulations, rules and standards, the selection of solutions and formulation of projects for the implementation of the Scheme.

b/ Mobilizing the participation of enterprises and experts

- To mobilize capable enterprises, organizations and individuals to participate in building shared utilities and tools, services providing planning data and other related contents in the Scheme in accordance with law.

- To mobilize experts and consultancy organizations to participate in formulating mechanisms and policies, designing systems, formulating plans, building architectural models and other contents concerning the formulation and implementation of the Scheme.

V. FUNDS FOR IMPLEMENTATION OF THE SCHEME

Funding sources for the implementation of the Scheme include:

1. The state budget allocations for the implementation of the Scheme in accordance with law, in which the central budget allocations shall be used for the tasks performed by ministries and central agencies; and local budget allocations, for the tasks performed by localities.

2. Other lawful donation, aid and funding sources (if any).

VI. ORGANIZATION OF IMPLEMENTATION OF THE SCHEME

1. Duration and roadmap for the implementation of the Scheme

The Scheme shall be implemented in 12 years, from 2024 to 2035, and divided into 3 phases as follows:

a/ Phase 1 (to 2026), focusing on the performance of the following tasks:

- To propose amendments to the Planning Law and formulate relevant legal documents to create a legal framework for the operation of the National Planning Database System.

- To formulate a Decree prescribing the building, updating, maintenance, exploitation and use of national planning databases.

- To formulate and promulgate Regulations on coordination in the collection, management, connection, sharing and use of information and databases in the National Planning Database System in the cyber environment. To study, formulate and promulgate circulars and guiding documents on the structure, technical requirements, technological solutions and regulations on the collection, processing and standardization of data, and the updating, management, operation, connection, provision, sharing, exploitation and use of planning dossier databases of the National Planning Database System.

- To invest in and build the information technology infrastructure and application software for the building, management and operation of the National Planning Database System.

- To collect, edit and build planning dossier databases for national-level, regional and provincial master plans on the geographic information system application platform to be updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

- To collect, edit and create databases on district-level land use planning dossiers and district area construction planning dossiers to be updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

- To synchronize planning data into a single National Planning Database System, ensuring consistency and integration capacity meeting technical requirements and within the scope of the Scheme.

- To review, develop and allocate sufficient and capable human resources to build, collect, process and standardize data; update, manage, operate, connect, provide, share and exploit and use the National Planning Database System.

- To strengthen and improve the qualifications of planning officials at all levels; to provide training and refresher training on GIS and the exploitation and use of the National Planning Database System.

b/ Phase 2 (from 2027 to 2030), focusing on the performance of the following tasks:

- To collect, edit and create databases on district-level land use planning dossiers and district area construction planning dossiers on a GIS-enabled technology platform to be updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

- To complete investment in and the building of information technology infrastructure and application software for the building, management and operation of the National Planning Database System.

- To complete investment in software and applications that allow state agencies, organizations, enterprises and people to connect to the National Planning Database System, serving the provision of on-demand planning information services.

c/ Stage 3 (from 2031 to 2035), focusing on the performance of the following tasks:

- Databases on planning dossiers of different types (including databases on dossiers of technical and specialized master plans) shall be built and updated into the National Planning Database System and provided and shared with organizations and individuals under regulations.

- To review and simplify administrative procedures related to planning work based on the exploitation and reuse of the National Planning Database System.

2. Responsibilities of ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees

a/ The Ministry of Planning and Investment

- To assume the prime responsibility for formulating an overall plan and monitor and evaluate the process and results of the implementation of the Scheme.

- To assume the prime responsibility for building, managing, using, updating and operating the National Planning Database System in line with the objectives of the Scheme.

- To guide, examine, summarize and conduct preliminary and final reviews of the implementation of the Scheme; to send periodical reports to the Prime Minister on the implementation of the Scheme, propose the modification and additions of the Scheme if necessary; to conduct preliminary and final reviews of the implementation of the Scheme.

- To share and synchronize data with the information system in service of the direction and governance of the Government and the Prime Minister and the National Synthetic Database to serve the direction and governance of the Government and the Prime Minister, settlement of administrative procedures, and provision of online public services.

- To review and simplify administrative procedures related to planning work based on the exploitation and reuse of the National Planning Database System.

- To mobilize domestic and foreign resources for the implementation of the Scheme; to focus on the allocation of sufficient resources to implement the Scheme; to assume the prime responsibility for submitting to competent authorities the allocation of funds from the annual public investment plans and recurrent expenditures under their competence to implement the Scheme in accordance with the law on public investment, the law on the state budget and other relevant laws.

b/ Ministries and ministerial-level agencies

- To implement relevant contents of the Scheme that fall under their management scope.

- To formulate a detailed plan to implement the Scheme in ministries and agencies according to the overall Plan to implement the Scheme.

- To coordinate with the Ministry of Finance and Ministry of Planning and Investment in estimating and allocating funds to implement relevant contents in the Scheme in accordance with the Law on the State Budget and the Law on Public Investment. To mobilize domestic and foreign resources to implement the Scheme in ministries and agencies.

- To build, manage and update their databases in compliance with regulations on data standards and data security; to share planning databases under their management with the National Planning Database System; to exploit and use data and information from the National Planning Database System to serve the management, governance and performance of their tasks; to be responsible for the completeness, accuracy and timeliness of the provided information and data and ensure cyberinformation security and cyber security.

- To review and simplify administrative procedures related to planning work based on the exploitation and reuse of the National Planning Database System.

- To annually conduct the inspection and evaluation of, and make reports on, the implementation results of the Scheme in ministries and agencies and send them to the Ministry of Planning and Investment for summarization and reporting to the Prime Minister.

c/ The Ministry of Finance

To assume the prime responsibility for compiling and submitting to competent authorities  the allocation of recurrent expenditures in the annual state budget estimates of ministries and central agencies to implement the Scheme in accordance with the law on the state budget, including recurrent expenditures to maintain the operation of the National Planning Database System after the Scheme is completed as prescribed in the law on the state budget.

d/ The Ministry of Information and Communications

- To coordinate with the Ministry of Planning and Investment in studying and promulgating regulations on the technical structure and requirements, technological solutions and guidance on synchronicity, compatibility, information access and sharing among state agencies, ensuring uninterrupted connection and information security of the National Planning Database System.

- To coordinate the connection and sharing of planning data with other national databases through the national data integration and sharing platform under regulations.

- To coordinate with the Ministry of Public Security and Government Cipher Committee in monitoring, emergency response and ensuring cyberinformation security and cyber security for the National Planning Database System.

dd/ The Ministry of Natural Resources and Environment

To provide the national geographic database and national system of topographic maps that have been standardized and regularly updated to create framework data for the National Planning Database System, ensuring the compliance with the law on protection of state secrets and other relevant laws.

e/ The Ministry of Public Security

- To provide guidance on ensuring cyberinformation security and cyber security for the National Planning Database System.

- To coordinate with the Ministry of Planning and Investment in reaching consensus on the roadmap, plans and solutions for infrastructure migration and system integration with the National Data Center.

g/ The Ministry of Home Affairs

To coordinate with the Ministry of Planning and Investment in considering the allocation of sufficient human resources in terms of quantity and quality to perform the assigned tasks.

h/ Provincial-level People’s Committees

- To formulate detailed plans to implement the Scheme in their localities according to the overall Plan to implement the Scheme.

- To assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment in, performing related tasks set forth in the Scheme in their localities. To direct provincial-level departments, sectors and units in their localities to implement related contents of the Scheme.

- To coordinate with the Ministry of Finance and Ministry of Planning and Investment in  estimating and allocating funds for implementing related contents in the Scheme in accordance with the Law on State Budget and Law on Public Investment. To mobilize domestic and foreign resources for the implementation of the Scheme at their ministries.

- To ensure funds for the performance of the tasks set forth in the Scheme for which the localities are responsible in accordance with the Law on the State Budget and guiding documents. To mobilize domestic and foreign resources for the implementation of the Scheme in the localities.

- To build, manage and update local planning databases in accordance with regulations on data standards and data confidentiality; to share locally managed planning databases with the National Planning Database System; to exploit and use data and information from the National Planning Database System to serve local management and governance and the performance of tasks by localities; to bear responsibility for the completeness, accuracy and timeliness of the provided information and data and ensuring cyberinformation security and cyber security.

- To build, expand and upgrade information technology infrastructure satisfying technical requirements of the Scheme to deploy local planning databases with stable and safe operation.

- To review and simplify administrative procedures related to planning work based on the exploitation and reuse of the National Planning Database System.

- To take the initiative in building a quality and efficient contingent of cadres, civil servants, public employees, and workers to perform the tasks stated in the Scheme within the scope and responsibility of the localities.

- To annually conduct the inspection and evaluation of, and send reports on, the implementation results of the Scheme in localities to the Ministry of Planning and Investment for summarization and reporting to the Prime Minister.

Article 2. This Decision takes effect on the date of its signing.

Article 3. Ministers, heads of ministerial-level agencies and government-attached agencies, chairpersons of provincial-level People’s Committees, and related organizations and individuals shall implement this Decision.-
