CIRCULAR

Promulgating the National Technical Regulations on Products, Goods of Building Materials

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007, detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;

Pursuant to the Government’s Decree No. 78/2018/ND-CP dated May 16, 2018, amending and supplementing a number of articles of the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007, detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;

Pursuant to the Government’s Decree No. 52/2022/ND-CP dated August 08, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Science, Technology and Environment Department;

The Minister of Construction issues the Circular promulgating the National Technical Regulations on Products, Goods of Building Materials.

Article 1. To promulgate together with this Circular the National Technical Regulations QCVN 16:2023/BXD on Products, Goods of Building Materials.

Article 2. The National Technical Regulations QCVN 16:2023/BXD takes effect on January 01, 2024.

Article 3. To annul the National Technical Regulations QCVN 16:2019/BXD on Products, Goods of Building Materials issued together with the Minister of Construction’s Circular No. 19/2019/TT-BXD dated December 31, 2019.

Article 4. Transitional provisions

1. In case organizations and individuals manufacturing, importing goods of building materials have been granted technical-regulation conformity certificates in conformity with the National Technical Regulations QCVN 16:2019/BXD and such certificates are still valid, they may use the technical-regulation conformity certificates and technical-regulation conformity marks until the expiration date of such certificates.

2. Organizations that have been designated to conduct technical-regulation conformity certification, testing for products, goods of building materials in accordance with the National Technical Regulations QCVN 16:2019/BXD may continue to conduct technical-regulation conformity certification, testing for products, goods of building materials that are stated in designation decisions and at the same time defined in the list of products, goods of building materials in the National Technical Regulations QCVN 16:2023/BXD until the expiration date of the designation decisions.

3. If a designation decision expires in the period when the Regulations is promulgated but has not yet taken effect, technical-regulation conformity certification, testing may continue to be conducted until the effective date of the Regulations./.
