DECREE
Annulling part of the Government's Decree No. 59/2006/ND-CP dated June 12, 2006, detailing the Commercial Law regarding goods and services banned from business, subject to business restrictions, and conditional business, and annulling the Government's Decree No. 43/2009/ND-CP dated May 7, 2009, amending and supplementing the list of goods and services banned from business of Decree No. 59/2006/ND-CP dated June 12, 2006, guiding the implementation of the Commercial Law regarding goods and services banned from business, subject to business restrictions and conditional business

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015, and the Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;
Pursuant to the Commercial Law dated June 14, 2005;
Pursuant to the Law on Investment dated June 17, 2020;
At the proposal of the Minister of Industry and Trade;
The Government hereby promulgates the Decree annulling part of the Government's Decree No. 59/2006/ND-CP dated June 12, 2006, detailing the Commercial Law regarding goods and services banned from business, subject to business restrictions, and conditional business (hereinafter referred to as Decree No. 59/2006/ND-CP), and annulling the Government's Decree No. 43/2009/ND-CP dated May 7, 2009, amending and supplementing the list of goods and services banned from business of Decree No. 59/2006/ND-CP dated June 12, 2006, guiding the implementation of the Commercial Law regarding goods and services banned from business, subject to business restrictions and conditional business (hereinafter referred to as Decree No. 43/2009/ND-CP).
Article 1. Partial annulment of Decree No. 59/2006/ND-CP, and annulment of the whole Decree No. 43/2009/ND-CP
1. To wholly annul Decree No. 43/2009/ND-CP amending and supplementing the list of goods and services banned from business of Decree No. 59/2006/ND-CP.
2. To partially annul Decree No. 59/2006/ND-CP as follows:
a) To annul Point b, Point c Clause 1 Article 4 and Article 6, Article 7 and Article 8.
b) To annul Point 1 thru Point 12, Point 14, Point 17 and Point 18 of Section A regarding goods, and the entire Section B regarding services, of Appendix I - List of goods and services banned from business.
c) To annul Appendix II - List of goods and services subject to business restrictions, and Appendix III - List of goods and services subject to conditional business.
Article 2. Implementation provisions
1. This Decree takes effect on February 15, 2025.
2. The Ministry of Natural Resources and Environment shall promulgate, or submit to the competent authority to promulgate the legal document on management of special and hazardous minerals before June 30, 2027.
3. The Ministry of Health shall promulgate or submit to the competent authority to promulgate the legal document on management of types of curative medicines for human use, vaccines and biological product materials, cosmetics, insecticidal or germicidal chemicals and preparations for household and medical use that are not permitted for use in Vietnam, and types of medical equipment not permitted for use in Vietnam before June 30, 2027.
4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, Chairpersons of People's Committees of provinces and centrally-run cities and concerned units and agencies shall implement this Decree./.
