On application of provisional anti-dumping duties to a number of hot-rolled steel products originating from the Republic of India and the People's Republic of China

Pursuant to the Law on Foreign Trade Management No. 05/2017/QH14 dated June 12, 2017;

Pursuant to the Government's Decree No. 10/2018/ND-CP dated January 15, 2018, detailing a number of articles of the Law on Foreign Trade Management regarding trade remedies;

Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 105/2024/ND-CP dated August 1, 2024, amending and supplementing a number of articles of the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade, and the Government’s Decree No. 26/2018/ND-CP dated February 28, 2018, on Charter of organization and operation of Vietnam Electricity;

Pursuant to the Minister of Industry and Trade’s Circular No. 37/2019/TT-BCT dated November 29, 2019, detailing a number of provisions on trade remedies;

Pursuant to the Minister of Industry and Trade's Circular No. 43/2023/TT-BCT dated December 28, 2023, amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 37/2019/TT-BCT of November 29, 2019, detailing a number of provisions on trade remedies;

Pursuant to the Minister of Industry and Trade’s Decision No. 2639/QD-BCT dated December 2, 2022, defining the functions, tasks, powers and organizational structure of the Trade Remedies Authority of Vietnam;

Pursuant to the Minister of Industry and Trade’s Decision No. 1985/QD-BCT dated July 26, 2024, on investigation for application of anti-dumping measures to a number of hot-rolled steel products originating from the Republic of India and the People's Republic of China;

At the proposal of the Director General of the Trade Remedies Authority of Vietnam.

 

DECIDES:

 

Article 1. To apply provisional anti-dumping duties on certain hot-rolled steel products originating from the People's Republic of China, classified under HS codes 7208.25.00, 7208.26.00, 7208.27.19, 7208.27.99, 7208.36.00, 7208.37.00, 7208.38.00, 7208.39.20, 7208.39.40, 7208.39.90, 7208.51.00, 7208.52.00, 7208.53.00, 7208.54.90, 7208.90.90, 7211.14.15, 7211.14.16, 7211.14.19, 7211.19.13, 7211.19.19, 7211.90.12, 7211.90.19, 7225.30.90, 7225.40.90, 7225.99.90, 7226.91.10, 7226.91.90 (Case No.:  AD20) with specific contents as prescribed in the Notice to this Decision.

Article 2. No provisional anti-dumping duties shall be applied to certain hot-rolled steel products originating from the Republic of India, classified under HS codes 7208.25.00, 7208.26.00, 7208.27.19, 7208.27.99, 7208.36.00, 7208.37.00, 7208.38.00, 7208.39.20, 7208.39.40, 7208.39.90, 7208.51.00, 7208.52.00, 7208.53.00, 7208.54.90, 7208.90.90, 7211.14.15, 7211.14.16, 7211.14.19, 7211.19.13, 7211.19.19, 7211.90.12, 7211.90.19, 7225.30.90, 7225.40.90, 7225.99.90, 7226.91.10, 7226.91.90, in accordance with Clause 3, Article 78 of the Law on Foreign Trade Management No. 05/2017/QH14.

Article 3. This Circular takes effect after 15 days from the date of its promulgation.

Article 4. The Chief of the Ministerial Office, the Director General of the Trade Remedies Authority of Vietnam and heads of units and relevant parties shall implement this Decision./.

NOTICE

On application of provisional anti-dumping duties to a number of hot-rolled steel products originating from the Republic of India and the People's Republic of China
(Attached to the Minister of Industry and Trade’s Decision No. 460/QD-BCT dated February 21, 2025)

1. Goods subject to provisional anti-dumping duties

The goods subject to provisional anti-dumping duties are hot-rolled steel products originating from the People's Republic of China (China), classified under the following characteristics and HS codes:

a) Basic characteristics

The goods include certain flat-rolled products of iron or non-alloy steel or alloy steel; hot-rolled; thickness ranging from 1.2 mm to 25.4 mm; width not exceeding 1,880 mm; not further processed beyond hot rolling; pickled or non-pickled; uncoated, non-plated, non-clad; may or may not be oiled; carbon content not exceeding 0.30% by weight.

Stainless steel products are not subject to the provisional anti-dumping duties.

b) HS Codes

The hot-rolled steel products subject to provisional anti-dumping duties are classified under HS codes: 7208.25.00, 7208.26.00, 7208.27.19, 7208.27.99, 7208.36.00, 7208.37.00, 7208.38.00, 7208.39.20, 7208.39.40, 7208.39.90, 7208.51.00, 7208.52.00, 7208.53.00, 7208.54.90, 7208.90.90, 7211.14.15, 7211.14.16, 7211.14.19, 7211.19.13, 7211.19.19, 7211.90.12, 7211.90.19, 7225.30.90, 7225.40.90, 7225.99.90, 7226.91.10, 7226.91.90.

The Ministry of Industry and Trade may modify the list of HS codes subject to provisional anti-dumping duties to align with the investigated goods description and other changes (if any).

3. Effect and duration of application of provisional anti-dumping duties

a) Effect

The provisional anti-dumping duties take effect after 15 (fifteen) days from the date on which the decision on the application of provisional anti-dumping duties is issued.

b) Duration of application

The provisional anti-dumping duty shall be applied for a period of 120 (one hundred and twenty) days from the effective date, unless extended, modified, or revoked in accordance with the law.

4. Procedures, dossiers and application of provisional anti-dumping duties

To have a ground for determining whether the imports subject to ADD or not, the customs office shall check the imports’ proofs of origin. Proofs of origin include:

a) Certificate of Origin (C/O); or

b) Origin declaration in conformity with regulations specified in:

- The Comprehensive and Progressive Agreement for Trans-Pacific Partnership;

- The Regional Comprehensive Economic Partnership;

- The Free Trade Agreement between the Socialist Republic of Vietnam and European Union;

- The Free Trade Agreement between the Socialist Republic of Vietnam and the United Kingdom of Great Britain and Northern Ireland;

- The ASEAN Trade in Goods Agreement; or

- The Free Trade Agreement between the Government of the Socialist Republic of Vietnam and the Government of the State of Israel.

Specific inspection contents:

Step 1: Verification of proofs of origin

- Case 1: If the customs declarant fails to submit the proofs of origin, the provisional anti-dumping duty rate of 27.83% shall apply.

- Case 2: If the customs declarant submit proofs of origin from a country or territory other than China, he/she shall not be liable for provisional anti-dumping duty.

- Case 3: If the customs declarant provides proofs of origin indicating that the goods originate from China, proceed to Step 2.

Step 2: Verification of the manufacturer’s quality certificate (original copy) (hereinafter referred to as the manufacturer's certificate)

- Case 1: If the customs declarant (i) fails to submit the manufacturer's certificate or (ii) submits the manufacturer's certificate, but the name of the organization or individual on the certificate does not match the name listed in Column 1, Section 2 of this Notice, the 27.83% provisional anti-dumping duty shall apply.

- Case 2: If the customs declarant submits the manufacturer's certificate, and the name of the organization or individual on the certificate matches the name listed in Column 1, Section 2 of this Notice, proceed to Step 3.

Step 3: Verification of the name of the manufacturer, exporter

- Case 1: If the name of the manufacturer or exporter (as stated in the sales contract and commercial invoice) matches the name listed in Column 1 or corresponds horizontally to the name in Column 2, the applicable duty rate shall be the one specified in Column 3, Section 2 of this Notice.

- Case 2: If the name of the manufacturer or exporter (as stated in the sales contract and commercial invoice) does not match the name listed in Column 1, Section 2 or does not correspond horizontally to the name in Column 2, Section 2, the 27.83% provisional anti-dumping duty shall apply.

5. The next orders and procedures

After the Ministry of Industry and Trade promulgates a decision on imposing provisional anti-dumping duties, the Inspection Agency shall carry out the following steps:

- To examine the responses to the investigation questionnaire;

- To hold public consultation session;

- To send draft final investigation conclusions to related parties for comments;

- To issue conclusions of the final investigation.
