CIRCULAR
On amending and supplementing a number of article of the Circular No. 34/2017/TT-BTC dated April 4, 2017 of the Minister of Finance on regulations on rates, regime of collection, remittance, management and using the assessment fee for granting licenses for survey and mapping activities and the Circular No. 196/2016/TT-BTC dated November 08, 2016 on regulations on rates, regime of collection, remittance, management and using the exploitation fee and data of survey and mapping

Pursuant to the Law on Fee and Charge dated November 25, 2015;
Pursuant to the Law on Survey and Mapping dated June 14, 2018;
Pursuant to the Decree No. 120/2016/ND-CP dated August 23, 2016 of the Government on detailing and guiding the implementation of a number of Articles of the Law on Fees and Charges;
Pursuant to the Decree No. 27/2019/ND-CP dated March 13, 2019 of the Government on detailing a number of article of the Law on Survey and Mapping;
Pursuant to the Decree No. 87/2017/ND-CP dated July 26, 2017 of the Government on defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Tariff Policy Department;
The Minister of Finance promulgates the Circular on amending and supplementing a number of article of the Circular No. 34/2017/TT-BTC dated April 4, 2017 on regulations on rates, regime of collection, remittance and management and using the assessment fee for granting licenses for survey and mapping activities and the Circular No. 196/2016/TT-BTC dated November 08, 2016 on regulations on rates, regime of collection, remittance and management and using the exploitation fee and data of survey and mapping.
Article 1. To amend and supplement Clause 1 Article 2 of the Circular No. 34/2017/TT-BTC dated April 4, 2017 of the Minister of Finance on regulations on rates, regime of collection, remittance and management and using the assessment fee for granting licenses for survey and mapping activities
“1. Organization proposes to be granted license for survey and mapping activities prescribed in Article 29, Decree No. 27/2019/ND-CP dated March 13, 2019 of the Government on detailing a number of article of the Law on Survey and Mapping shall pay the assessment fee as regulated in this Article.”
Article 2. To amend and supplement Article 3 of the Circular No. 196/2016/TT-BTC dated November 08, 2016 on regulations on rates, regime of collection, remittance and management and using the exploitation fee and data of survey and mapping
“Article 3. Fee level, exemption and reduce of fee
1. The fee level for exploiting and using the survey and mapping data is prescribed in the Table of charge rates attached with this Circular.
2. The following cases, which is proposed in written documents by the Minister, Head of Ministerial - level agencies, Government - attached agencies, Chairperson of Provincial People’s Committees to exploiting and using survey and mapping data of public properties to serve:
a) National defense and security purpose in emergency situation;
b) Natural disasters prevention in emergency situation;
Emergency situation mentioned above is determined as the provision in the Law on National Defense and natural disasters prevention laws.
3. The fee level shall equal to 60% of the fee prescribed in the table of fee attached with this Circular in cases proposed in written documents by the Minister of Public’s Security, Minister of National Defense, Chairperson of Provincial People’s Committees to exploiting and using survey and mapping data of public properties to serve national defense and security purpose which excluded from cases prescribed in Clause 2 of this Article.”
Article 3. Implementation organization and provisions
1. This Circular takes effect on August 01, 2019.
2. The Table on fee of exploiting and using of survey and mapping data attached to the Circular No. 196/2016/TT-BTC dated November 08, 2016 on regulations on rates, regime of collection, remittance and management and using the exploitation fee and data of survey and mapping shall be replaced by the Table on fee attached to this Circular.
3. In cases the legal documents mentioned above be amended, supplemented or replaced by other document, such document shall apply.
4. Any problems arising in the course of implementation should be promptly reported to the Ministry of Finance for consideration and settlement.-
