Circular 11/2024/TT-BGTVT service prices for preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption

CIRCULAR

On the service prices for preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption and re-printing of motor vehicle inspection certificates and stamps^[1]

Pursuant to the November 13, 2008 Law on Road Traffic;

Pursuant to the June 20, 2012 Law on Price;

Pursuant to the November 25, 2015 Law on Charges and Fees;

Pursuant to the Government’s Decree No. 177/2013/ND-CP of November 14, 2013, detailing and guiding the implementation of a number of articles of the Law on Price; and the Government’s Decree No. 149/2016/ND-CP of November 11, 2016, amending and supplementing a number of articles of the Government’s Decree No. 177/2013/ND-CP of November 14, 2013;

Pursuant to the Government’s Decree No. 139/2018/ND-CP of October 8, 2018, on the provision of motor vehicle inspection services; and the Government’s Decree No. 30/2023/ND-CP of June 8, 2023, amending and supplementing a number of articles of the Government’s Decree No. 139/2018/ND-CP of October 8, 2018, on the provision of motor vehicle inspection services;

Pursuant to the Government’s Decree No. 56/2022/ND-CP of August 24, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Finance and Director of the Vietnam Register,

The Minister of Transport promulgates the Circular on the service prices for preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption and re-printing of motor vehicle inspection certificates and stamps.

Article 1. Scope of regulation

This Circular provides the service prices for preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption and re-printing of motor vehicle inspection certificates and stamps.

Article 2. Subjects of application

1. Organizations and individuals eligible for preparation of vehicle dossiers for their motor vehicles eligible for initial inspection exemption and re-printing of motor vehicle inspection certificates and stamps by inspection units.

2. Inspection units of motor vehicles in circulation.

3. Other organizations and individuals related to the preparation of vehicle dossiers for their motor vehicles eligible for initial inspection exemption and re-printing of motor vehicle inspection certificates and stamps.

Article 3. Interpretation of terms

In this Circular, the terms below are construed as follows:

1. Motor vehicle eligible for initial inspection exemption means a motor vehicle (including automobiles, trailers and semi-trailers pulled by automobiles) eligible for initial inspection exemption under the Minister of Transport’s Circular No. 16/2021/TT-BGTVT of August 12, 2021, on inspection of technical safety and environmental protection of road motor vehicles (amended and supplemented under Circular No. 02/2023/TT-BGTVT of March 21, 2023, and Circular No. 08/2023/TT-BGTVT of June 2, 2023).

2. Preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption means the inspection and evaluation of a vehicle dossier for preparation of the vehicle dossier and issuance of an inspection certificate and stamp for a motor vehicle eligible for initial inspection exemption by an inspection unit under the Minister of Transport’s Circular No. 16/2021/TT-BGTVT of August 12, 2021, on inspection of technical safety and environmental protection of road motor vehicles (amended and supplemented under Circular No. 02/2023/TT-BGTVT of March 21, 2023, and Circular No. 08/2023/TT-BGTVT of June 2, 2023).

3. Re-printing of motor vehicle inspection certificates and stamps means the re-printing of a motor vehicle inspection certificate and stamp by an inspection unit for an owner of the motor vehicle or a person bringing the motor vehicle to the inspection unit for inspection under the Minister of Transport’s Circular No. 16/2021/TT-BGTVT of August 12, 2021, on inspection of technical safety and environmental protection of road motor vehicles (amended and supplemented under Circular No. 02/2023/TT-BGTVT of March 21, 2023, Circular No. 08/2023/TT-BGTVT of June 2, 2023).

Article 4. Service prices for preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption and re-printing of motor vehicle inspection certificates and stamps

1. The service price for preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption is VND 46,000/vehicle; the service price for re-printing of motor vehicle inspection certificates and stamps is VND 23,000/issuance/vehicle.

The service prices specified in this Clause are inclusive of expenses for the organization of collection of fees for issuance of certificates of inspection of technical safety and environmental protection for motor vehicles but exclusive of value-added tax in accordance with law.

2. Inspection units shall use invoices for service provision specified in the Government’s Decree No. 123/2020/ND-CP of October 19, 2020, on invoices and documents; the Minister of Finance’s Circular No. 78/2021/TT-BTC of September 17, 2021, guiding the implementation of a number of articles of the June 13, 2019 Law on Tax Administration, and the Government’s Decree No. 123/2020/ND- CP of October 19, 2020, on invoices and documents.

3. Inspection units shall publicize information on, and post up service prices in accordance with the law on price, implement tax policies, and pay taxes in accordance with the current laws on tax and tax administration.

4. Organizations and individuals provided with the services of preparation of vehicle dossiers for motor vehicles eligible for initial inspection exemption and re-printing of motor vehicle inspection certificates and stamps by inspection units shall pay the service prices to the latter based on the price levels specified in this Circular.

Article 5. Organization of implementation

1. This Circular takes effect on June 15, 2024.

2. In case the legal documents referred to in this Circular are replaced, amended or supplemented, the replacing, amending or supplementing ones shall prevail.

2. The Chief of the Office, the Chief of the Inspectorate, Directors of related Departments, and the Director of the Vietnam Register under the Ministry of Transport, Directors of provincial-level Departments of Transport, heads of related agencies, and related organizations and individuals shall implement this Circular.-
