SUMMARY

The import tariff quotas for raw tobacco in 2023 is 68,414 tons

On May 8, 2023, the Ministry of Industry and Trade issues Circular No. 11/2023/TT-BCT providing the 2023 import tariff quotas of raw tobacco. To be specific:

1. The import tariff quotas for raw tobacco (HS code 2401) in 2023 is 68,414 tons.

2. The import tariff quotas of raw tobacco shall comply with the allocation method specified in the Government's Decree No. 69/2018/ND-CP dated May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management, and the Ministry of Industry and Trade's Circular No. 12/2018/TT-BCT dated June 15, 2018, detailing a number of articles of the Law on Foreign Trade Management and the Government’s Decree No. 69/2018/ND-CP of May 15, 2018.

3. The raw tobacco import tariff quota shall be allocated to traders licensed for cigarette production by the Ministry of Industry and Trade that have the demand to use imported raw tobacco for cigarette production.

This Circular takes effect from June 23, 2023, to the end of December 31, 2023.

CIRCULAR

Providing for the import tariff-rate quotas for leaf tobacco in 2023^{^[1]}

Pursuant to the 2017 Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 96/2022/ND-CP of November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular providing for the import tariff-rate quotas for leaf tobacco in 2023.

Article 1. Import tariff-rate quota volume for leaf tobacco in 2023

The import tariff-rate quota volume for leaf tobacco (HS code 2401) in 2023 is 68,414 tons.

Article 2. Methods of allocation of import tariff-rate quotas for leaf tobacco

The allocation of import tariff-rate quotas for leaf tobacco must comply with the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management, and the Minister of Industry and Trade’s Circular No. 12/2018/TT-BCT of June 15, 2018, detailing a number of articles of the Law on Foreign Trade Management and the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management.

Article 3. Subjects eligible for allocation of import tariff-rate quotas for leaf tobacco

Import tariff-rate quotas for leaf tobacco shall be allocated to traders that possess cigarette production permits granted by the Ministry of Industry and Trade and wish to use imported leaf tobacco for cigarette production.

Article 4. Effect

This Circular takes effect from June 23, 2023, through December 31, 2023.-
